JANUARY 2, 2008FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Wednesday, January 2, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Motion by Boykin second by Batcheller to go into Closed Session per Iowa Code 21.5 (1) (c). Carried 5-0 on a roll-call vote.

Meeting called to order.
Motion by Boykin second by Clausen to appoint Doug Walish Chairman. Carried 5-0.
Motion by Clausen second by Boykin to approve the Board minutes of the December 18, 2007 meeting as submitted. Carried 5-0. Copy filed.
Motion by Batcheller second by Boykin to approve the appointment of Richard Storm as County Engineer. Carried 5-0.
Motion by Monson second by Clausen to approve the appointment of Dr. Thomas Carroll as County Medical Examiner. Carried 5-0.
Motion by Batcheller second by Boykin to approve the appointment of Mark Monson as Representative to the Third Judicial District Department of Correctional Services. Carried 5-0.
Motion by Batcheller second by Boykin to approve the appointment of Kerby G. Weber as County Weed Commissioner. Carried 5-0.
Motion by Clausen second by Monson to approve the appointment of Sioux City Journal, Moville Record, and The Sergeant Bluff Advocate, as the official County newspapers for legal publications. Carried 5-0.
The Board discussed approval of Supervisor appointments to various committees for 2008.
The Board discussed expansion of garage/storage space at the Prairie Hills facility, with Greg Logan, Chief Deputy Sheriff.
Motion by Batcheller second by Boykin to approve expansion of garage/storage space at Prairie Hills. Carried 5-0.
The Board approved the separation of Kathleen A. Ludwig, Clerk II, Build Services Dept., effective 12/26/2007. Resignation. Copy filed.
The Board approved the separation of Elven C. Merritt Jr., Temporary Shredder, Social Services Dept., effective 12/26/2007. End of temporary work. Copy filed.
The Board approved the reclassification of Frank W. Taylor, Motor Vehicle Clerk II, County Treasurer Dept., $12.60/hour, effective 01/03/2008. Per AFSCME Courthouse contract agreement, from Grade 4, Step 1 to Grade 4, Step 2. Copy filed.
The Board approved the reclassification of Patrick E. Hinrichsen, Deputy Sheriff, County Sheriff Dept., $23.23/hour, effective 01/03/2008. Per DSA contract agreement, from Class 1 to Senior Class. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for a Full-time Clerk II, Building Services Dept. Entry level: AFSCME Courthouse, Grade 3, Step 1, $11.88/hour. Carried 5-0. Copy filed.
J. D. Pellersels, Human Resources Director, presented the Board with a report on premium and claim history for Woodbury County workers compensation insurance.
Motion by Monson second by Boykin to receive the appointment of Amy Savary, 2586 Knox Avenue, Oto, Iowa, to the office of Grant Township Clerk, to fill a vacancy until the 2008 General Election. The appointment is to fill the office previously held by Freda McGuire. Carried 5-0.
Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution, pursuant to Iowa Code Section 459.304(3), allowing the Board to participate in the formal recommendation process of new livestock confinement feeding operations, per recommendation by Planning and Zoning Director, John Pylelo. Carried 5-0.

CONSTRUCTION EVALUATION RESOLUTION
WOODBURY COUNTY, IOWA
WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a construction evaluation resolution relating to the construction of a confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNRs decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2008 and January 31, 2009 and submit an adopted recommendation regarding that application to the DNR; and
WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the boards recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).
