OCTOBER 23, 2007FORTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 23, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, and Walish; Monson arrived at 10:15 a.m. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Boykin second by Clausen to approve the Board minutes of the October 16, 2007 meeting as submitted. Carried 3-0, Batcheller abstained. Copy filed.

Motion by Clausen second by Walish to approve the Board minutes of the October 11, 2007 special meeting as submitted. Carried 2-0; Batcheller and Boykin abstained. Copy filed.

The Board approved the reinstatement of Vincent T. Dvorak, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 10/14/2007. Reinstatement; end of active military leave of absence. Copy filed.

The Board approved the appointment of Whitney M. Carlson, Sheriffs Reserve Volunteer, County Sheriff Dept., $1.00/year, effective 10/15/2007. Per Iowa Code 80D.11. Copy filed.

The Board approved the reclassification of Daren J. Vande Vegte, Correctional Officer, County Sheriff Dept., $14.87/hour, effective 11/08/2007. Per DSA contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Matthew P. Plummer, Part-time Operations Officer, Disaster Services Dept., $16.61/hour, effective 11/14/2007. Per Wage Plan Matrix: 6 year level. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a Request to Deauthorize County Position for a Night Shift Supervisor, Building Services Dept. Carried 4-0. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for the following Building Services Dept. positions:

1) Maintenance Worker. Entry level: AFSCME Courthouse. Salary range: $11.88-$13.01/hour (based on experience).

2) Custodian. Entry level: AFSCME Courthouse. Entry level: $10.77/hour.

Motion by Boykin second by Batcheller to approve designating Monday, December 24, 2007 as a Wage Plan floating Christmas holiday. Carried 4-0.

Motion by Batcheller second by Boykin to receive as submitted the County Recorders Report of Fees Collected for the period of 07/01/2007 through 09/30/2007. Carried 4-0. Copy filed.

Motion by Boykin second by Clausen to receive as submitted the County Sheriffs Civil Division 1st Quarter and Year-To-Date report for the period ending 09/30/2007. Carried 4-0. Copy filed.

Leo Miller, Gang Specialist, reviewed gang programs with the Board.

A public hearing was held at 10:15 a.m. for the sale of property parcel #053985 (aka 1122 W. 19th Street, Sioux City, Iowa). The Chairman called on anyone wishing to be heard.

Motion by Clausen second by Batcheller to close the hearing. Carried 5-0.

The Chairman called for bids on parcel #053985.

Jim Parks, 821 Jennings Street, Sioux City, on behalf of Kent Meyer, 1124 W. 19th Street, Sioux City, offered the minimum bid.

Motion by Batcheller second by Clausen to accept the offer of Jim Parks on behalf of Kent Meyer in the amount of $80.00, plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By KENT J. MEYER in the sum of EIGHTY & 00/100 ($80.00)------------------------------- dollars.

For the following described real estate, To Wit:

Parcel #053985
The E. 1 Ft. of the W. 26 Ft. of Lot 12, Block 10 in North Sioux City Addition to City Of Sioux City,
Woodbury County, Iowa
(1122 W. 19th St.)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a contract and bond with L. A. Carlson Contracting, Incorporated, Moville, Iowa, for project #L-C01(2)73-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an application for underground tile line facility, per recommendation of the County Engineer. The application was submitted by Lundell Construction, Cherokee, Iowa, on behalf of David Linn, 1410 Michigan Avenue, Correctionville, Iowa, Gary Hoppe/Kenny Bainbridge, 1219 Osceola Avenue, Correctionville, Iowa. Carried 5-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Jim Parks, 821 Jennings, Sioux City approached the Board with a proposal to sell vacant county parcels.

The Board adjourned the regular meeting until October 30, 2007.
