The Board of Supervisors met on Tuesday, October 9, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Monson second by Clausen to approve the Board minutes of the October 2, 2007 meeting as submitted. Carried 4-0; Walish abstained. Copy filed.
The Board approved the separation of Ryan M. Hansen, Temporary Correctional Officer, County Sheriff Dept., effective 09/25/2007. End of temporary status. Full-time appointment 09/26/2007. Copy filed.
The Board approved the appointment of Bruce D. Schmidt, Equipment Operator, Secondary Roads Dept., $16.55/hour, effective 10/15/2007. Job vacancy posted 08/14/2007. Entry level salary: $16.55/hour. Copy filed.
The Board approved the reclassification of Levi L. Harry, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 10/18/2007. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution approving petition for suspension of taxes for Willie Earl Rucker, 213 Main Street, Sioux City, IA. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES
WHEREAS, Willie Earl Rucker, is the titleholder of property located at 213 Main Street, City of Sioux City, Woodbury County, Iowa, and legally described as follows:
Parcel # 8947 29 259 016
South 27.6 Feet Lot Ten (10) & East 15 Feet South 27.6 Feet Lot Eleven (11) Block Eight (8) Sioux City Addition
WHEREAS, Willie Earl Rucker as titleholder of the aforementioned real estate have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 23rd Day of October, 2007 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 23rd Day of October, 2007, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 80.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Batcheller second by Monson to receive the Commission of Veteran Affairs Quarterly Assistance Report for the period ending September 30, 2007. Carried 5-0. Copy filed.
Chris McGowan with The Siouxland Initiative addressed the Board requesting an annual County pledge of $2,000.00.
Motion by Batcheller second by Monson to approve the $2,000.00 annual pledge to The Siouxland Initiative funded from the Infrastructure and Economic Development Fund. Carried 5-0.
The Board discussed restoration and use of original Courthouse lead glass windows, with Patty Erickson-Puttmann.
Motion by Monson second by Batcheller to approve retaining Larry Ericsson to draft specifications for the display of stored courthouse windows and to use Infrastructure and Economic Development funds for the cost of doing so. Carried 5-0.
Motion by Monson second by Batcheller to approve change order #10 for phase 8 of the Courthouse Restoration Project. Carried 5-0, copy filed.
Motion by Boykin second by Clausen to authorize the chairman to sign the Certificate of Substantial Completion for phase 8 of the Courthouse Restoration Project. Carried 5-0. Copy filed.
Motion by Clausen second by Monson to receive and approve the contractors application for final payment of the phase 8 renovations. Carried 5-0. Copy filed.
Motion by Boykin second by Clausen to close a public hearing held pursuant to Iowa Code Section 459.304 for the Confinement Feed Operation structures and operations by Larry Guthridge, GIS #8944 04 400 001 and 8944 04 400 004. Carried 5-0.
The Board discussed possible recommendations regarding the Matrix to the Iowa Department of Natural Resources.
Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign documentation providing the Boards recommendation to the Iowa Department of Natural Resources. Carried 5-0.
Motion by Boykin second by Clausen to approve and authorize the Chairman to sign the final plat for Kaufman Addition Subdivision, per recommendation by the Zoning Commission and subject to the addition meeting state standards for septic systems. Carried 5-0.

RESOLUTION ACCEPTING AND APPROVING KAUFMAN ADDITION, WOODBURY COUNTY, IOWA.
WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 27TH DAY OF AUGUST, 2007, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS KAUFMAN ADDITION, WOODBURY COUNTY, IOWA; AND
WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 15TH DAY OF SEPTEMBER, 2007, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS BAILEYS PLAT, A REPLAT OF LOT 1 AND A PART OF LOT 2 OF RIDGEVIEW II SUBDIVISION IN THE NEW OF NE OF SECTION 31, T89N, R45W, WOODBURY COUNTY, IOWA; AND

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a telephone contract with Evercom Systems, Incorporated (Securus Technologies), to provide centralized net centric, VOIP, digital transmitted call management system service to the Woodbury County Jail. Carried 5-0. Copy filed.
The Board discussed the possible sale of the old Danbury facility and County radio tower site, with County Engineer Richard Storm.
Motion by Boykin second by Monson to approve the recommendation of the county engineer to develop a proposal to sell the old Danbury facility and County radio tower site. Carried 5-0.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.
Patty Redmond addressed the Board with a request to post items in the Trosper-Hoyt Building.
Motion by Boykin second by Batcheller to place the request on the agenda for the next board meeting. Carried 5-0.
Motion by Clausen second by Monson to go into Closed Session per Iowa Code Section 21.5 (1) (c). Carried 5-0 on a roll-call vote.
Motion by Boykin second by Clausen to go out of Closed Session per Iowa Code Section 21.5 (1) (c). Carried 5-0 on a roll-call vote.
The Board adjourned the regular meeting until October 16, 2007.
