MARCH 20, 2007TWELFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 20, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Bobbier Johnson, Assistant County Attorney, and Jean Jessen, Deputy/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Clausen second by Monson to approve the Board minutes of the March 13, 2007 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the separation of Amber D. Wilkinson, Full-time Youth Worker, Juvenile Detention Dept., effective 03/27/2007. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for an In-House, Full-time, Female, Youth Worker, Juvenile Detention Dept. Entry level: AFSCME J. D. $13.52/hour or current wage. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve the request by the Woodbury County Area Solid Waste Agency to allow them to become part of the Woodbury County health insurance program, effective 04/01/2007. Health insurance premiums would be paid by the Woodbury County Area Solid Waste Agency and the employees. Carried 5-0.

Motion by Monson second by Batcheller to acknowledge the appointment of Mark Nelson, 108 S. 3rd Avenue, Anthon, Iowa, for the office of Council Member for the City of Anthon, to fill a vacancy until the General Election of 2007, for the office previously held by Beulah Sand. Carried 5-0.

Motion by Batcheller second by Monson to acknowledge the appointment of Patricia Hopkins, 305 S. Hickory Street, Smithland, Iowa, for the office of Mayor for the City of Smithland, to fill a vacancy until the General Election of 2007, for the office previously held by Dennis Claus. Carried 5-0.

The Board discussed the replacement of Nancy Hodge on the Tri-State Behavioral Insolvency Protection Account with Karen James.

Motion by Clausen second by Batcheller to approve the replacement of Nancy Hodge with Karen James. Carried 5-0.

Jane Gilbert with SIMPCO discussed a support letter for SIMPCO to submit a grant proposal to USDA.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a support letter for SIMPCO submitting a grant proposal to DSA. Carried 5-0.

The Board reviewed preliminary platting for Ty Estates Addition Subdivision with John Pylelo, Planning/Zoning Director.

Motion by Batcheller second by Monson to refer the preliminary platting for Ty Estates Addition Subdivision to the Zoning Commission public hearing and recommendations. Carried 5-0.

The Board reviewed preliminary platting for Sandhill Estates Second Addition Subdivision with John Pylelo, Planning/Zoning Director.

Motion by Boykin second by Clausen to approve the preliminary platting for Sandhill Estates Second Addition Subdivision, and to refer the final platting to the Zoning Commission for review and recommendations. Carried 5-0.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a contract for engineering services with Shuck-Britson, Incorporated, Des Moines, Iowa, for preliminary plans of replacing three bridges in one location, into one bridge and one culvert, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a performance bond on contracts for a maintenance gravel contract with Hallett Materials, Lake View, Iowa. Carried 5-0.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a performance bond on contracts for a contract with Weise Construction, Cushing, Iowa, for the Danbury maintenance facility. Carried 5-0.

The Board held a continuance of the public hearing from the March 13, 2007 Board meeting, for vacation of unused right-of-way, of a portion of 150th Street, established as Road #216.

The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Clausen to close the hearing. Carried 5-0.

Motion by Batcheller second by Boykin to approve and receive for signatures, a Resolution authorizing the vacation of the unused right-of-way. Carried 4-1, Clausen opposed.

WOODBURY COUNTY, IOWA
RESOLUTION NO. 10,146
A RESOLUTION VACATING ROADWAY RIGHT-OF-WAY

WHEREAS, Woodbury County relocated and reconstructed a section of 150th Street in Banner and Arlington Township from County Route D-22 (Old U.S. 20) northeasterly and now desires to vacate a section of established roadway; and,

WHEREAS, the Woodbury County Board of Supervisors in accordance with Section 306.10, Code of Iowa (2006), as amended, has determined that a portion of the roadway right-of-way is no longer needed for roadway purposes. The portion of roadway to be vacated is legally described as follows:

County road right-of-way, more commonly known as 150th Street established as Road No. 216 and described as: Beginning at N Section 36-89-45 proceeding easterly to SE Corner of SWSE Section 25-89-45, excepting the right-of-way acquired in 1996 from Ray Ragan as shown on the attached drawing.

WHEREAS, the owners of land abutting the section of roadway, Davis Livestock and Mr. Ray Ragan, have consented to the vacation of said roadway.

NOW THEREFORE BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, in accordance with Section 306.10, Code of Iowa, hereby vacates that right-of-way described above. From and after the moment this resolution is recorded, the identified property shall no longer constitute a street, highway, or public right-of-way, but shall revert to private ownership pursuant to the operation of law.
