MARCH 13, 2007ELEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 13, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Bobbier Johnson, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the March 6, 2007 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Elven C. Merritt, Jr., Temporary Aide, Social Services Dept., $5.50/hour, effective 03/15/2007. Not to exceed 120 days. Copy filed.

The Board approved the appointment of Elizabeth A. Schermerhorn, Assistant Director, Juvenile Detention Dept., $42,500/year, effective 03/21/2007. Job vacancy posted 01/03/2007. Entry level salary: $42,500/year. Copy filed.

The Board approved the appointment of Ryan M. Weber, Assistant Director, Juvenile Detention Dept., $42,500/year, effective 03/21/2007. Job vacancy posted 01/03/2007. Entry level salary: $42,500/year. Copy filed.

The Board approved the reclassification of Sage M. Lewis, Correctional Officer, County Sheriff Dept., $14.87/hour, effective 03/22/2007. Per DSA contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the appointment of Cindy L. Weber-Blair, Assistant County Attorney, County Attorney Dept., $49,829/year, effective 03/30/2007. Job vacancy posted 02/05/2007. Salary range: $43,087-$49,829/year, based on experience. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution urging the repeal of the residency requirement in Iowa Code Section 692A.2A, per recommendation of County Sheriff Glenn Parrett as amended. Carried 5-0.

A RESOLUTION URGING REPEAL OF THE RESIDENCY
REQUIREMENT IN IOWA CODE SECTION 692A.2A

WHEREAS, the Board of Supervisors of the County of Woodbury Iowa, has considered the issues of ineffectiveness and expenditure of law enforcement resources related to sex offender residency restrictions, and

WHEREAS, the Iowa County Attorneys Association, the Iowa Sheriffs and Deputies Association, the Iowa Coalition Against Sexual Abuse, the Prevent Child Abuse Iowa organization, the Iowa State Association of Counties, and not less than eleven other professional Iowa groups and associations support repeal, and

WHEREAS, the Board of Supervisors of the County of Woodbury desires to express its support for the repeal of Iowa Code Section 692A.2A and replace it with legislation establishing child safe zones.

NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Woodbury, Iowa:

Section 1: That the Legislature of Iowa and the Governor of Iowa should repeal Iowa Code Section 692A.1A.

The Board discussed with Patty Erickson-Puttmann, Social Service Coordinator, the Project Safe Neighborhoods Grant Application.

Motion by Batcheller second by Boykin to approve Project Safe Neighborhoods Grant Application for FY 2008. Carried 5-0.

Rob Marqusee, Rural Economic Development Director, announced the establishment of the Woodbury County Northwest Iowa Organic Exchange Board website.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a certificate of completion for project #L-R02(1)73-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a final voucher for project #STP-S-CO97(78)5E-97, per recommendation of the County Engineer. Carried 5-0.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a final voucher for project #FM-CO97(79)55-97, per recommendation of the County Engineer. Carried 5-0.

A public hearing was held at 10:30 a.m. regarding a proposed vacation of unused right-of-way, of a portion of 150th Street, established as Road #216.

The Chairman called on anyone wishing to be heard.

Patrick Phipps representing Davis Livestock and Stewart Huff representing Ray Ragan, 2581 150TH St., discussed the proposed vacation at the public hearing.

Motion by Batcheller second by Boykin to continue the hearing for one week. Carried 5-0.

The Board reviewed County Compensation Board recommendations.

Motion by Boykin second by Clausen to approve the recommendations of the County Compensation Board. Carried 4-1; Batcheller opposed.

A public hearing was held at 10:45 a.m. for the fiscal year 2008 Woodbury County budget.

The Chairman called on anyone wishing to be heard.

Janeese Martin, of the Tax Research Conference, presented recommendations to the Board.

Jack Burright, 1198 Minnesota Ave., representing the Farm Bureau, presented their concerns.

Motion by Batcheller second by Monson to close the hearing. Carried 5-0.

Motion by Batcheller second by Boykin to approve and adopt the fiscal year 2008 Woodbury County budget. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Lea Herbold, 1074 Ida Ave. presented concerns about erosion problems.

The Board adjourned the regular meeting until March 20, 2007.
