FEBRUARY 20, 2007EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 20, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Bobbier Johnson, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the February 13, 2007 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the salary adjustment for Faye E. Hill, Clerk II, Secondary Roads Dept., $14.78/hour, effective 02/12/2007. End of interim secretary position. Copy filed.

The Board approved the appointment of Jason C. Kurtz, Full-time Youth Worker, Juvenile Detention Dept., $14.05/hour, effective 02/21/2007. In-house vacancy posting 02/05/2007. From Part-time to Full-time status 02/21/2007. Copy filed.

The Board approved the appointment of Kyle R. Evans, Sheriffs Reserve Volunteer, County Sheriff Dept., $1.00/year, effective 02/21/2007. Per Iowa Code 80D.11. Copy filed.

The Board approved the reclassification of Deborah Fuller, Part-time Youth Worker, Juvenile Detention Dept., $14.54/hour, effective 03/14/2007. Per AFSCME Juvenile Detention contract agreement, from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for:

1 Temporary Summer Engineering Aide, Secondary Roads Dept.
Entry level: Wage Plan $7.50-$12.50/hour based on education and experience with Woodbury County.

6 Temporary Summer Laborers, Secondary Roads Dept.
Entry level: Wage Plan $7.50-$9.50/hour based on prior experience with Woodbury County.

The Board discussed the Countys health and dental insurance with Cathy Mengel, First Administrators.

Motion by Clausen second by Monson to approve the recommendation of First Administrators Inc. to increase the contribution rate to the Countys dental plan by fifteen percent. Carried 5-0.

Motion by Batcheller second by Monson to receive for signatures a Resolution appointing a Housing Authority Commissioner. Carried 5-0.

RESOLUTION NO 10,135
RESOLUTION APPOINTING HOUSING AUTHORITY COMMISSIONER

WHEREAS, the County of Woodbury, Iowa has previously entered into Articles of Agreement with the Siouxland Regional Housing Authority, and

WHEREAS, these Articles provide that the County of Woodbury, Iowa shall be represented upon the governing commission of the Siouxland Regional Housing Authority, and further said Articles provide said County to appoint one authority commissioner to said governing commission.

NOW, THEREFORE, BE IT RESOLVED by the County Board of Supervisors of Woodbury County, Iowa, that Karen James_ of the County of Woodbury, Iowa, be and hereby is appointed as housing authority commissioner to represent the interests of the county of Woodbury, Iowa, upon the Siouxland Regional Housing Authority Commission. Said appointment shall be for the term and under the conditions as provided in the Articles of Agreement previously signed between the County of Woodbury, Iowa and Siouxland Regional Housing Authority.

RESOLUTION NO. 10,136
RESOLUTION CONFIRMING APPOINTMENT OF HOUSING AUTHORITY COMMISSIONER

WHEREAS, the County of Woodbury, Iowa has previously passed a Resolution appointing Karen James_ the County of Woodbury, Iowa, as commissioner of the governing body of the Siouxland Regional Housing Authority.

NOW, THEREFORE, BE IT RESOLVED by the County of Woodbury, Iowa, the appointment of Karen James, of the County of Woodbury, Iowa as authority commissioner to the governing body of the Siouxland Regional Housing Authority is hereby approved, confirmed and ratified for the number of years designated in the Articles of Agreement previously entered into by and between the County of Woodbury, Iowa, and Siouxland Regional Housing Authority.

Motion by Batcheller second by Clausen to approve lifting the tax suspension for Verle R. Bales and Catherine Bales, 601 S. Cecelia Street, Sioux City, IA, as the property has been sold. Carried 5-0.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date of a section of real estate at the corner of 2nd Street and Miller Boulevard, Moville, IA. Carried 5-0.

RESOLUTION #10,137
NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa is the owner under a tax deed of certain parcel of real estate described as:

Jones 2nd Addition used for street ex. N. 50 Ft. Lot 10, Block 9, Town of Moville, Woodbury County,

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 6th day of March, 2007, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. The said Board proposes to sell the said parcel of real estate on the 6th day March, 2007, immediately following the closing of the public hearing, to the City of Moville, Iowa only per Code of Iowa 331.361(3).

3. That said Board proposes to sell the said real estate to the City of Moville, Iowa only for consideration of $1.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale and except for this subparagraph 4, be published as notice of the aforesaid proposal, hearing and sale.

The Board discussed payment funding of the Countys telephone conversion invoice.

Motion by Batcheller second by Monson to approve payment of the $1,225.00 invoice from Baker Communications from Riverboat funds. Mr. Batcheller asked to withdraw his motion and it was done so without objection.

The invoice will follow the Countys normal procedure.

Bid letting was held at 10:20 a.m. for Secondary Roads Department Project #L-EWP07(2)73-97, for a stream stabilization structure on the west fork of the Little Sioux, Section 3, T87N, R45W.

The bids were as follows:

Onawa, IA - $100,060.00

There were no other bids.

Motion by Batcheller second by Boykin to receive the bids and to award the project to Elk Horn Construction, Onawa, IA, the low bidder. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a Resolution advancing locally funded project from the Priority List to the Accomplishment Year of the fiscal year 2007 Five Year Road Program, per recommendation by the County Engineer. Carried 5-0.

BE IT RESOLVED: That the Board of Supervisors of Woodbury County, Iowa, initiates and recommends that the advancement of the following project(s) to the Accomplishment year (FY 2007) be approved by the Iowa Department of Transportation (Iowa DOT) for improvement with local funds for the period covering the current secondary road construction program.

Motion by Batcheller second by Monson to approve and receive for signatures a proposal for engineering services with Calhoun-Burns and Associates, Incorporated, West Des Moines, IA, for 2007 bridge inspection and rating program, per recommendation by the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to award the bid for a front end loader for Secondary Roads Dept. to Titan Equipment, Sioux City, IA, for a Case 821E front end loader in the amount of $132,220.00, per recommendation by the County Engineer. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until February 27, 2007.
