JANUARY 16, 2007THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, January 16, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen and Monson; Walish was absent. Staff members present were Karen James, Board Administrator, Bobbier Johnson, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

Meeting called to order.
Motion by Batcheller second by Monson to approve the Board minutes of the January 9, 2007 meeting as submitted. Carried 4-0. Copy filed.
The Board approved the temporary assignment of Faye E. Hill, Temporary Secretary, Secondary Roads Dept., $17.44/hour, effective 01/16/2007. Temporary interim assignment per AFSCME Courthouse contract agreement. Copy filed.
The Board approved the appointment of Aaron M. Bobier, Sheriffs Reserve Volunteer, County Sheriff Dept., $1.00/year, effective 01/17/2007. Per Iowa Code 80D.11. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an Authorization To Initiate Hiring Process for a Senior Assistant Director, Juvenile Detention Dept. Entry level: Wage Plan, range $44,000-$50,000/year. Carried 4-0. Copy filed.
The Board discussed Woodbury Countys safety plan with Bob Schmeckpepper from Western Iowa Tech, and J. D. Pellersels, Human Resources Director.
Motion by Monson second by Batcheller to receive the County Recorders Report of Fees Collected for the period ending 12/31/2006. Carried 4-0. Copy filed.
Motion by Monson second by Boykin to receive the appointment of Harry E. Jahn, 1936 Hancock Avenue, Moville, Iowa, to serve as Moville Township Trustee, to fill the office vacancy until the 2008 General Election and to receive the appointment of Arthur Ralston, 2629 200th Street, Moville, Iowa, to serve as Moville Township Clerk, to fill the office vacancy until the 2008 General Election. Carried 4-0.
Motion by Boykin second by Batcheller to receive the County Auditors Quarterly Report for the period ending 12/31/2006. Carried 4-0. Copy filed.
Motion by Monson second by Boykin to receive the Semi-Annual Report of Funds in the hands of the County Treasurer, at the close of business on December 31, 2006. Carried 4-0. Copy filed.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Utility Accommodation Permit, submitted by Frontier Communications, Fort Dodge, Iowa, per recommendation of the County Engineer. Carried 4-0. Copy filed.
A public hearing was held at 10:15 a.m. for the sale of excess right-of-way real estate owned by Woodbury County.
Motion by Boykin second by Batcheller to close the hearing. Carried 4-0.
Motion by Boykin second by Batcheller to authorize the Chairman to sign a Resolution authorizing the Chairman to sign a Quit Claim Deed, conveying property to John W. Dolphin. Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
John M. Dolphin in the sum Seven Thousand Five Hundred And No/100 ($7500.00) Dollars.
For the following described real Estate, to Wit:
All that part of the Southwest of section 9, Township 88 North, Range 47 West of the Fifth Principal Meridian, Woodbury County, Iowa, described as follows:

BE IT RESOLVED that per Code of Iowa Section 306.22, a parcel of right-of-way the County holds by Quit Claim Deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives fee title.
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser gives fee title.

RESOLUTION #10,126
CONSTRUCTION EVALUATION RESOLUTION
WHEREAS, Iowa Code Section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a construction evaluation resolution relating to the construction of a confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution and submitted and
adopted recommendation may contest the DNRs decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2007 and January 31, 2008 and submit an adopted recommendation regarding that application to the DNR; and
WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the boards recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, in accordance with Iowa Code Section 459.304(3), that the Board of Supervisors hereby adopts this Construction Evaluation Resolution.

The Board discussed additional work on the sidewalk reconstruction project with Patty Erickson-Puttman.
Motion by Batcheller second by Monson to approve painting new concrete walls and existing masonry walls and to fund the additional work from the infrastructure fund. Carried 4-0.
Sherry Mc Gill, Woodbury County Extension, presented the Board with an update on the Kids A Cookin program.
The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Batcheller second by Boykin to receive the Administration budget reduced by $1,500.00. Carried 4-0.
Motion by Boykin second by Monson to receive the Edward Byrne Grant budget as submitted. Carried
4-0.
Motion by Batcheller second by Boykin to receive the Juvenile Division budget reduced by $2,400.00. Carried 4-0.
County Attorney (General Supplemental)
Motion by Monson second by Batcheller to receive the Jury and Witness Fees budget reduced by $4,100.00. Carried 4-0.
County Attorney (Other Funds)
Motion by Boykin second by Batcheller to receive the County Attorney Forfeitures budget as submitted. Carried 4-0.
Conservation (General Basic)
Motion by Boykin second by Batcheller to receive the Administration budget reduced by $20,000.00. Carried 4-0.
Motion by Batcheller second by Boykin to receive the Parks budget reduced by $55,971.00. Carried 4-0.
