DECEMBER 19, 2006FORTY-NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, December 19, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Patrick Jennings, County Attorney and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Motion by Batcheller second by Monson to go into closed session per Iowa Code 20.17 (3). Carried 5-0 on a roll-call vote.

Motion by Boykin second by Monson to go out of closed session per Iowa Code 20.17 (3). Carried 5-0 on a roll-call vote.

Motion by Batcheller second by Monson to approve the Board minutes of the December 12, 2006 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of William E. Adkins, Temporary Equipment Operator, Secondary Roads Dept., $16.05/hour, effective 12/18/2006. Amended hire date from 12/13/2006 to 12/18/2006. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of Kelly J. Frisch, Part-Time Youth Worker, Juvenile Detention Dept., $14.05/hour, effective 12/21/2006. Per AFSCME Juvenile Detention contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.

The Board approved the reclassification of Amy J. Johnson, Correctional Officer, County Sheriff Dept., $16.09/hour, effective 01/09/2007. Per DSA contract agreement, from Class 2 to Class 1.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign an Authorization To Initiate Hiring Process for an Equipment Operator, Secondary Roads Department. Entry level: CWA $16.05/hour. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve the request of Margaret Crow, retiring County employee, to remain on the County health insurance plan at her own expense, effective 12/29/2006. Carried 5-0.

The Board discussed worker compensation annual premium rates, with JD Pellersels, Human Resources Director.

Motion by Walish second by Batcheller to approve option one for worker compensation rates, as recommended by the human resources director. Carried 5-0.

The Board discussed reinsurance coverage and administration of health and dental insurance fee quotations for 2007, with Joy Caudron, Human Resources Administrative Assistant.

Motion by Boykin second by Batcheller to approve, as recommended by the human resources director. Carried 5-0.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign an amendment to Woodbury Countys Fiscal Agent Agreement with SEAT. Carried 5-0. Copy filed.

The Board discussed appointments for terms expiring on various boards and commissions.

Motion by Boykin second by Batcheller to approve the appointment of Greg Grupp to the Conservation Board. Carried 5-0.

Motion by Batcheller second by Walish to approve the appointment of Merle Muller to the Siouxland District Board of Health. Carried 5-0.

Motion by Boykin second by Walish to approve the appointment of Leo Jochum, Donald H. Johnson, Elleen Oberreuter, Wallace Sorenson, Thomas Ullrich, Ronald Michener, and John Small to the Commission to Assess Damages, Category A-Owners/Operators of Agricultural Property. Carried 5-0.

Motion by Batcheller second by Walish to approve the appointment of G.R. Batcheller Jr., Peter Macfarlane, Wayne B. Ducommun, Ruth A. Groth, Kathleen F. Fenceroy, Susan Feathers, and Jean C. Huff to the Commission to Assess Damages, Category B-Owners of City Property. Carried 5-0.

Motion by Boykin second by Monson to approve the appointment of Colleen R. Baker, Terry Kroeger, Cleo Pottorff, Duke OHern, Anita Small, and Nancy Henry, C.P.S., to the Commission to Assess Damages, Category C-Licensed Real Estate Salesman of Real Estate Broker. Carried 5-0.

Motion by Monson second by Boykin to approve the appointment of Patrick Curry, Robert Huisenga, Leon Ortner, and Jon Wilke, to the Commission to Assess Damages, Category D-Persons Having Knowledge of Property Values in the County by Reason of Their Occupation. Carried 5-0.

Motion by Monson second by Boykin to approve lifting the tax suspension for Julie Ann Edward, 1419 Court Street, Sioux City, as the property has been foreclosed. Carried 5-0.

Motion by Walish second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date of real estate parcel #554895 (3512 Floyd Boulevard). Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Auditors Plat of vacated and unplatted parts of 11-89-47, vacated alley adjacent southwesterly 53 ft. vacated street between Tax Lots 6 and 7, Woodbury County, Iowa (3512 Floyd Blvd.)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 2nd Day of January, 2007 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 2nd Day of January, 2007, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 53.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

A RESOLUTION THANKING AND COMMENDING
Daniel Meister

FOR HIS SERVICE TO WOODBURY COUNTY

WHEREAS, Daniel Meister has capably served Woodbury County as an employee of the Woodbury County Secondary Roads Department for 31 years from December 19th, 1975 to January 5th of 2007; and

WHEREAS, the service given by Daniel Meister as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Daniel Meister for his thirty one years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Daniel Meister; and

BE IT SO RESOLVED this 19th day of December 2006.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a Statement of Understanding, documenting a partnership between Woodbury County and Comprehensive Strategy for Positive Youth Development Community Planning Team. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve the appointment of George Boykin as Woodbury Countys representative on the Comprehensive Strategy for Positive Youth Development Community Planning Team. Carried 5-0.

The Board discussed Change Order #4 for jail alterations at the Woodbury County Law Enforcement Center with Regina Smith, RML Architects. Change Order #4 is for refinishing E Block floor, to meet the modified standards set by Block F.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign Change Order #4 for jail alterations, in the amount of $1,727.00. Carried 5-0. Copy filed.

The Board reviewed a proposal from Holtze Construction for Change Order #3 for Courthouse basement restoration, with Patty Erickson-Puttmann, Social Service Coordinator. Change Order #3 is for additional labor costs for installation of 8 tandem light fixtures in the storage area under the sidewalk. Lights were furnished by Building Services Dept.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign Change Order #3 and accept the proposal from Holtze Construction for installing light fixtures, in the amount of $368.00. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to receive and approve for signatures a Resolution thanking and commending L. Donald Groves for his volunteer service to Woodbury County. Carried 5-0.

WHEREAS, L. Donald Groves has capably served Woodbury County as a past member of the Countys Zoning Commission compiling twenty years of community service to the County and;

WHEREAS L. Donald Groves has faithfully completed the following Board of Supervisor appointments:

Zoning Commission:

January 1, 1986 to December 31, 1990 1st Term
January 1, 1991 to December 31, 1995 2nd Term
January 1, 1997 to December 31, 2001 1st Term
January 1, 2002 to December 31, 2006 2nd Term

WHEREAS, L. Donald Groves tenure as a member of the Board of Adjustment and Zoning Commission has been characterized by dedication to the best interests and level of service for the citizens of Woodbury County and;

WHEREAS, the members of the Woodbury County Board of Supervisors appreciate the full and constructive input that L. Donald Groves has provided toward the Zoning Commissions quest for the proper solution to issues presented before the Commission.

Motion by Boykin second by Walish to approve the appointment of Brian Crichton to fill the expiring term on the Woodbury County Board of Adjustments, for the term expiring on December 31, 2011. Carried 5-0.

The Board reviewed applicants applying for the expiring term on the Woodbury County Zoning Commission.

Motion by Boykin second by Walish to approve the appointment of David McWilliams to fill the expiring term on the Woodbury County Zoning Commission, for the term expiring on December 31, 2010.
Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Mr. Batcheller excused himself at 10:45 a.m.

Motion by Boykin second by Monson to go into closed session per Iowa Code 21.5 (1) (j), at the request of an employee, for a performance evaluation. Carried 5-0 on a roll-call vote.

Motion by Boykin second by Monson to go out of closed session per Iowa Code 21.5 (1) (j). Carried 5-0 on a roll-call vote.

The Board adjourned the regular meeting until January 2, 2007.
