NOVEMBER 28, 2006FORTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, November 28, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of the November 21, 2006 meeting as submitted. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale of real estate parcel #016755 (606 W. 1st Street). Carried 5-0.

NOTICE OF PROPERTY SALE
Parcel #016755

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Auditors Plat Lots 33 and 34 Sioux City and
Tax Lots 9, 10, 11 and Part Tax Lot E, Lot 1,
Sioux City Outlots to Sioux City, Woodbury County, IA (606 W. 1st St.)

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 12th Day of December, 2006 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 12th Day of December, 2006, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 55.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Rick Schneider, Woodbury County Conservation Board Director, presented the Board with their annual report.

Motion by Boykin second by Monson to receive the Woodbury County Conservation Boards annual report. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a proposal from Northwest Environmental Services, Incorporated, for clean-up at the former Davidson Oil Company site in Moville, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Monson second by Walish to approve and authorize the Chairman to sign a utility accommodation permit submitted by Ag Processing, Incorporated, Omaha, NE, to install a wastewater force main in the right-of-way of Port Neal Road, from the existing line near Gelita to Ag Processing Plant, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Bid letting was held at 10:20 a.m. for project #L-C05(6)73-97.

Bids were as follows:

Christensen Brothers Construction $130,886.40
Dixon Construction $89,804.96
Graves Construction $93,134.50
GUS Construction $99,815.25
LA Carlson $127,204.90

There were no other bids.

Motion by Batcheller second by Monson to receive the bids and submit them to the County Engineer for review and recommendations. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Batcheller, Monson, and Karen James excused themselves from the meeting.

Motion by Boykin second by Walish to go into closed session per Iowa Code 21.5 (1) (j). Carried 3-0 on a roll-call vote.

Motion by Boykin second by Walish to go out of closed session per Iowa Code 21.5 (1) (j). Carried 3-0 on a roll-call vote.

Motion by Boykin second by Walish to go into closed session per Iowa Code 21.5 (1) (j). Carried 3-0 on a roll-call vote.

Monson joined the closed session.

Motion by Boykin second by Monson to go out of closed session per Iowa Code 21.5 (1) (j). Carried 4-0 on a roll-call vote.

The Board adjourned the regular meeting until November 28, 2006.
