SEPTEMBER 26, 2006THIRTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 26, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

The meeting was called to order to canvass the Western Iowa Tech Community College Election held on September 12, 2006.

Victoria Ritz, Deputy Commissioner of Elections, presented the canvass as follows:

For the office of Western Iowa Tech Community College Board Member, Director District II 1 Vacancy, there were five-hundred, ninety-two (592) ballots cast as follows:

Michael D. Hunter
received Three-hundred, fifty-seven (357) votes

Rodney Ludwig
received Two-hundred, thirty-four (234) votes

Scattered Write-In Votes
received One (1) vote

We therefore declare Michael D. Hunter duly elected to the office of Western Iowa Tech Community College Board Member, Director District II, for the term of three (3) years.


For the office of Western Iowa Tech Community College Board Member, Director District VIII 1 Vacancy, there were five-hundred, ninety-seven (597) ballots cast as follows:

Russell C. Wray
received Five-hundred, eighty-six (586) votes

received Eleven (11) votes

We therefore declare Russell C. Wray duly elected to the office of Western Iowa Tech Community College Board Member, Director District VIII, for the term of three (3) years.

Motion by Batcheller second by Walish to receive and approve the official canvass results of the Western Iowa Tech Community College Election. Carried 5-0.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of the September 19, 2006 meeting as submitted. Carried 4-0; Clausen abstained. Copy filed.

The Board approved the separation of Daniel M. Whitlock, Temporary Correctional Officer, County Sheriff Dept., effective 09/24/2006. End of temporary status due to full-time regular appointment Copy filed.

The Board approved the appointment of Daniel M. Whitlock, Correctional Officer, County Sheriff Dept., $14.32/hour, effective 09/25/2006. Job vacancy posted 08/16/2006. Entry level salary: $14.32/hour. Copy filed.

The Board approved the reclassification of Brent E. DeVries, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 10/01/2006. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.

The Board approved the reclassification of Amy L. Ellis, Assistant County Attorney, County Attorney Dept., $52,112/year, effective 10/02/2006. Per AFSCME Assistant County Attorney contract agreement, from Step 4 to Step 5. Copy filed.

The Board approved the reclassification of Lisa M. Welte, Part-time Youth Worker, Juvenile Detention Dept., $17.02/hour, effective 10/03/2006. Per AFSCME JD contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

The Board approved the reclassification of Mat R. Cook, Correctional Officer, County Sheriff Dept., $16.09/hour, effective 10/10/2006. Per DSA contract agreement, from Class 2 to Class 1. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for a Temporary Correctional Officer, County Sheriff Dept.
Entry level: DSA comparability, $14.32/hour. Carried 5-0. Copy filed.

The Board discussed flu and tetanus vaccinations for County employees, with JD Pellersels, Human Resources Director.

Motion by Walish second by Batcheller to approve and authorize flu vaccinations to those employees who want them. Carried 5-0.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution authorizing tax suspension for Sophia K. McGinnis , 1211 S. Fairmont Street, Sioux City. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Sophia K. Mc Ginnis, is the titleholder of property located at 1211 S. Fairmont Street. City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Lots Eleven & Twelve (11, & 12) Block Three (3) West Morningside Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Sophia K. McGinnis as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Board discussed Woodbury Countys 2006 United Way Campaign

Motion by Batcheller second by Monson to approve the request of up to $500.00 to fund the internal marketing campaign. Carried 5-0.

Motion by Walish second by Monson to approve the appointment of John Pylelo, Peggy Napier and Jackie Bates to Woodbury Countys 2006 United Way Campaign Committee. Carried 5-0.

Motion by Monson second by Boykin to approve an insert in the countys payroll endorsing Woodbury Countys 2006 United Way Campaign. Carried 5-0.

A public hearing was held at 10:15 a.m. on the Western Iowa Tech Community College lease agreement.

Motion by Boykin second by Batcheller to close the hearing. Carried 5-0.

The Chairman called on anyone wishing to be heard on said lease agreement.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign the lease of farm land to Western Iowa Tech Community College for the purpose of organic farming courses. Carried 5-0. Copy filed.

County Sheriff Glenn Parrett and Assistant County Attorney Bobbier Johnson addressed the Board regarding a 28E agreement for law enforcement mutual aid.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a 28E agreement, between Woodbury County and the City of Sergeant Bluff, for law enforcement mutual aid.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a National Incident Management Systems compliance document, per recommendation of Emergency Services Director, Gary Brown. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a Resolution approving the audit firm of Ernst and Young, used by Argosys Belle of Sioux City per Iowa Code 99F.13. Carried 4-0; Monson abstained.

WOODBURY COUNTY , IOWA
RESOLUTION #10,099

WHEREAS, on April 19, 2004, the Iowa Legislature passed House File 2302, which the Governor signed into law on May 6, 2004.

WHEREAS, House File 2302 amends Iowa Code 99F.13 (2003) and provides that the Board of Supervisors of each county where gambling operations are conducted must select a certified public accountant licensed within the State to conduct the annual audit of certain licensed gambling establishments within the county, specifically providing,

99F.13 ANNUAL AUDIT OF LICENSEE OPERATIONS. Within ninety days after the end of the licensee's fiscal year, the licensee shall transmit to the commission an audit of the financial transactions and condition of the licensee's total gambling operations, including an itemization of all expenses and subsidies. All audits shall be conducted by certified public accountants registered or licensed in the State of Iowa under chapter 542 who are selected by the board of supervisors of the county in which the licensee operates.

WHEREAS, the certified public accounting firm of Ernst & Young, is experienced in performing audits of gambling operations, is registered and/or licensed to perform such services in the State of Iowa.

NOW THEREFORE BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby appoints the Ernst & Young certified public accounting firm to conduct the annual audit for the licensee, Belle of Sioux City, L.P.

IT IS FURTHER RESOLVED that this appointment of the Ernst & Young firm shall remain in effect and renew automatically each year until the Board of Supervisors receives a request from the licensee, Belle of Sioux City, L.P., to appoint another certified public accounting firm to perform the annual audits contemplated under Iowa Code 99F.13.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a fiscal agent agreement between Woodbury County and State Wide Election Administration Training, per recommendation of Patrick F. Gill, County Auditor, Recorder and Commissioner of Elections. Carried 5-0. Copy filed.

Snyder and Associates, Ankeny, Iowa, gave a presentation to the Board regarding a preliminary study of the U. S. Highway 20/Buchanan Avenue interchange.

The Board discussed a request by ISAC to assist with legal expenses, in response to a Washington County lawsuit with Union Pacific Railroad, with County Engineer Richard Storm.

Motion by Boykin second by Monson to approve and authorize Woodbury County to contribute $2,000.00 to Washington County, to assist in legal expenses, due to the lawsuit between Washington County and Union Pacific Railroad. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Batcheller to go into closed session per Iowa Code 21.5(1)(c). Carried 5-0 on a roll-call vote.

Motion by Boykin second by Walish to go out of closed session per Iowa Code 21.5(1)(c). Carried on a roll-call vote.

Motion by Boykin second by Walish to seek an injuction on the behalf of Woodbury County to prevent the implementation HF 2780. Carried 5-0.

The Board adjourned the regular meeting until October 3, 2006.
