SEPTEMBER 19, 2006THIRTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 19, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Monson, and Walish; Clausen was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.
The Claims were approved as presented. Copy filed.
Mr. Boykin assumed the chair and asked that Mr. Clausen be excused for a medical necessity.
Meeting called to order.
Motion by Batcheller second by Monson to approve the Board minutes of the September 12, 2006 meeting as submitted. Carried 4-0. Copy filed.
Motion by Walish second by Boykin to approve the Board minutes of the September 15, 2006 meeting to canvass the school board election as submitted. Carried 4-0. Copy filed.
The Board approved the reclassification of Joseph D. Moravek, Correctional Officer, County Sheriff Dept.,
$17.48/hour, effective 09/25/2006. Per DSA contract agreement, from Class 2 to Senior Class, due to
4- year college degree, plus 4 years of service. Copy filed.
The Board and County Engineer Richard Storm, presented a Resolution to Jon Hess, thanking and commending him for his years of service to Woodbury County.
Motion by Batcheller second by Walish to accept and award the bid for an Engineering vehicle to Charlie Zook Motors for a 2007 Dodge Durango at a net bid of $19,526.00, per recommendation of the County Engineer. Carried 4-0. Copy filed.
Motion by Monson second by Walish to accept and approve the quote received from Wheeler Lumber, West Des Moines, for creosote treated timber piling at a cost of $38,802.00, per recommendation of the County Engineer. Carried 4-0. Copy filed.
Motion by Batcheller second by Monson to accept and approve the quote received from Ovel Forest Products, New Hampton, for CCA treated bridge planks at a cost of $35,100.00, per recommendation of the County Engineer. Carried 4-0. Copy filed.
The Board discussed prioritization of capital improvement projects with County Engineer, Richard Storm.
A public hearing was held at 10:15 a.m. for the sale of excess road right-of-way real estate owned by Woodbury County.
Motion by Batcheller second by Walish to close the hearing. Carried 4-0.
The Chairman called for bids.
Harlan Vandezandschulp bid the minimum bid of $500.00 plus recording fees.
There were no further bids.
Motion by Batcheller second by Walish to accept the bid of Harlan Vandezandschulp for $500.00 plus recording fees. Carried 4-0.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution authorizing the sale of excess road right-of-way real estate to Harlan J. and Judy E. Vandezandschulp. Carried 4-0.

WOODBURY COUNTY, IOWA
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
HARLAN J. AND JUDY E. VANDEZANDSCHULP in the sum of FIVE HUNDRED AND 00/100 ($500.00) dollars.
For the following described real estate, To Wit:
Part of the NE of the NW of Section 20, Township 88 North, Range 47 West of the 5th P.M., Woodbury County Iowa described as follows: Commencing at the SW Corner of the NE of the NW of said Section 20; thence N 88 01 13 E along the South line of said NE of the NW for 386.94 feet to the Southwesterly Corner of a parcel described on a Warranty Deed, recorded in Book 1028 Page 418 in Woodbury County Recorders Office, the point of beginning; thence continuing N 88 01 13 E along the South line of said NE of the NW and the South line of said parcel for a distance of 60.18 feet to the Southeasterly Corner of said parcel, the centerline of the original alignment of Old Lakeport Road; thence N 6 25 41 W along the said centerline and the Easterly line of said parcel for 152.90 feet to the Northeasterly Corner of said parcel; thence S 83 34 19 W along the North line of said parcel for a distance of 33.00 feet to the Northwesterly Corner of said parcel; thence S 10 00 33 W along the Westerly line of said parcel for a distance of 93.29 feet; thence S 5 50 24 E along the Westerly line of said parcel for a distance of 58.76 feet to the Southwesterly Corner of said parcel, a point on the South line of said NE of the NW of said Section 20, and the North line of Lot 3 Layhee Addition the point of beginning. Note: The South line of said NE of the NW is assumed to bear N 88 01 13 E.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and the resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 306.22, a parcel of right-of-way the County holds by quit claim deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title.
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Public Hearing and Sale of real estate property parcel #524310 (a.k.a. 2112 Douglas Street) was held at 10:30 a.m. The Chairman called on anyone wishing to be heard on said sale.
Motion by Monson second by Batcheller to close the public hearing and sale of property parcel #524310 (a.k.a. 2112 Douglas Street). Carried 4-0.
The Chairman called for bids on real estate parcel #524310.
There were no bids.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until September 26, 2006.
