SEPTEMBER 12, 2006THIRTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 12, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson, Deputy/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the August 29, 2006 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the separation of Jon C. Hess, Equipment Operator, Secondary Roads Dept., effective 09/08/2006. Retirement. Copy filed

The Board approved the separation of Brian J. Bruckner, R. E. D. Temporary Internship, Rural Economic Development Dept., effective 09/11/2006. End of temporary work. Copy filed

The Board approved the appointment of Lindsey M. Fiksdale, Social Services Internship, Social Services Dept., $7.00/hour, effective 09/14/2006. Per Board approval 09/22/2006, 9-month internship @$7.00/hour. Copy filed.

The Board approved the reclassification of Lori A. Morgan, Legal Secretary III, County Attorney Dept., $17.44/hour, effective 09/26/2006. Per AFSCME Courthouse contract agreement, from Grade 6, Step 4 to Grade 6, Step 5. Copy filed.

The Board approved the reclassification of Jeremy S. Peterson, Assistant County Attorney, County Attorney Dept., $45,262/year, effective 09/27/2006. Per AFSCME Assistant Attorney contract agreement, from Step 1 to Step 2. Copy filed.

Motion by Walish second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for an Equipment Operator, Secondary Roads Dept. Entry level: C. W. A. $16.05/hour. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve retiring employee, Jon Hess, with the Secondary Roads Dept., remain on County health and dental insurance plan, for himself and spouse, at his own expense. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to receive the Commission of Veteran Affairs quarterly report, for the quarter ending 06/30/2006. Carried 5-0. Copy filed.

The Board reviewed Courthouse Phase 8 basement/sidewalk renovation project bids with Patty Erickson-Puttman, Social Services Coordinator.

Motion by Batcheller second by Boykin to accept and award the bid to Holtze Construction Company, in the amount of $463,705.00, plus the alternate bid of $84,500.00 for a snow-melt system. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to obtain the balance of funds needed ($35,000.00) from infrastructure funds. Carried 5-0.

The Board discussed the approval of the Iowa Supreme Court Investiture Reception being held at the Woodbury County Courthouse.

Stewart Huff addressed the Board regarding the Reception.

Motion by Batcheller second by Walish to approve holding the Iowa Supreme Court Investiture Reception at the County Courthouse. Carried 5-0.

Motion by Monson second by Walish to approve and authorize the Chairman to sign a Resolution approving the abatement of taxes for County property, parcels: 864414100003, 86441410004, 864414300001, 864414300002, 864414300003, 864414300004, 864414300005, 864415400005, and 864415400008. Carried 5-0.

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcel is owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the Woodbury County, Iowa, is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Mark Olsen, Juvenile Detention Director, presented the Board with an update of Detention State Reimbursement.

Mark Olsen, Juvenile Detention Director, discussed a transfer of funds into the Juvenile Detention Emergency Fund line item.

Motion by Monson second by Walish to approve the transfer of $20,000.00 to the Juvenile Detention Emergency Fund. Carried 5-0.

The Board reviewed propane bids with County Engineer Richard Storm.

Motion by Batcheller second by Monson to award the bid for propane use for 2006-2007 season, to Ferrell Gas, South Sioux City, in the amount of $1.36/gallon. Carried 5-0.

Motion by Boykin second by Walish to approve and receive for signatures, a Resolution thanking and commending Jon Hess, for his years of service to Woodbury County. Carried 5-0.

JON C. HESS
FOR HIS SERVICE TO WOODBURY COUNTY

WHEREAS, Jon C. Hess has capably served Woodbury County as an employee of the Woodbury County Secondary Roads Department for 35 years and 1 month, from July 26, 1971 to September of 2006; and

WHEREAS, the service given by Jon C. Hess as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Jon C. Hess for his thirty five years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Jon C. Hess; and

BE IT SO RESOLVED this 12th of September, 2006.

Linda Drey, Siouxland District Mental Health Department, requested a modification to the fiscal year 2007 Local Public Health Services Contract grant activity.

Motion by Boykin second by Monson to approve the request to modify grant activities as specified. Carried 4-0. Copy filed.

Rob Marqusee, Rural Economic Development Director, announced to the Board that Whole Foods Market of Omaha has formed a working relationship with Woodbury County Food Producers and the sponsorship of the 2nd Annual Organic Growers Conference.

Tom Marciniak and Lori Tatreau, Whole Foods Market, addressed the Board concerning a request for a kitchen renovation grant for Floyd Boulevard Local Foods Market, in the amount of $13,000.00-$20,000.00.

Jack Buright addressed the Board.

Pat Garrity with Floyd Boulevard Local Foods Market, addressed the Board.

Motion by Walish second by Monson to approve a $20,000.00 grant to Floyd Boulevard Local Foods Market, to be paid for from infrastructure funds. Carried 3-1, Clausen opposed.

Rob Marqusee announced to the Board the partnership of Woodbury County with the University of Nebraska Extension and Center for Rural Affairs, the Farm Beginnings Program.

Linda Kleinschmit, from the University of Nebraska Extension, addressed the Board regarding the Farm Beginnings Program.

The Board reviewed information regarding the Conservation Reserve Program property transition to organic production, with Rob Marqusee.

Pat Garrity provided the Board with a report on Floyd Boulevard Local Foods Market sales and future prospects to Woodbury County under the local food purchase policy.

Rob Marqusee announced to the Board that the Second Annual Organic Growers Conference will be held November 2nd and November 3rd, at the Sergeant Bluff Area Family Center.

Awokee Dillisso, from Western Iowa Tech Community College, addressed the Board regarding the lease
of farm land to Western Iowa Tech Community College for the purpose of organic farming courses.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution setting 09/26/2006 as the public hearing date for the lease of farm land to Western Iowa Tech Community College
for the purpose of organic farming courses. Carried 4-0.

WOODBURY COUNTY, IOWA
RESOLUTION #10,096
NOTICE OF PUBLIC HEARING

WHEREAS, Woodbury County desires to support the Organics Conversion Policy by granting a lease to Western Iowa Tech Community College (WITCC) to help educate students in the methods of organic farming; and,

WHEREAS, Woodbury County owns 15 acres of farmland located in Woodbury County, Iowa; and,

WHEREAS, Section 331.361(2) of the Code of Iowa grants Woodbury County the power to dispose of interests in real property by lease; and,

WHEREAS, Woodbury County approved a resolution to authorize the leasing of 15 acres of farmland to WITCC in connection with educational courses on organic farming on May 23, 2006.

IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposed leases shall be held on the 26th day of September, 2006 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse, 620 Douglas Street, Sioux City, Iowa.

2. That said Board proposes to lease the said property to WITCC for a term of ten (10) years for $1.00 per year throughout the term on the condition that the land only be used in connection with educational courses in organic farming offered WITCC, following the closing of the public hearing.

3. That draft of said lease is available for public inspection in the office of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

4. That this resolution, preceded by the caption Notice of Public Hearing and except for subparagraph 4 be published as notice of the aforesaid proposal, hearing and action.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign an Addendum to the farm lease to Western Slopes Farm, to allow approximately fifteen acres of that land, to be leased to Western Iowa Tech Community College for use in a dedicated course in organic farming. The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
