AUGUST 29, 2006THIRTY-FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, August 29, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Monson second by Boykin to approve the Board minutes of the August 22, 2006 meeting as submitted. Carried 5-0. Copy filed.
The Board approved the separation of Christopher C. Cox, Part-time Youth Worker, Juvenile Detention Dept., effective 08/14/2006. Separation. Copy filed
The Board approved the reclassification of David J. Kyte, Correctional Officer, County Sheriff Dept., $14.87/hour, effective 09/07/2006 per DSA contract agreement, from Class 4 to Class 3. Copy filed.
Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for Social Services Internship, Social Services Dept. Entry level: 9 month temporary part-time status, $7.00/hour. Carried 5-0. Copy filed.
The Board discussed a request from the Sergeant Bluff Historical Society to abate property taxes for Sergeant Bluff City Blairs additions 10 and 11, block 6.
Larry Sargent spoke in favor of the request.
Motion by Batcheller second by Walish to deny the request to approve and authorize the chairman to sign Resolution to abate taxes on Sergeant Bluff City Blairs additions 10 and 11, block 6 for the Sergeant Bluff Historical Society. Carried 5-0.
Motion by Monson second by Batcheller to approve the third and final reading of an ordinance requiring keg registration. Carried 5-0. Copy filed.
Linda Phillips of Siouxland Cares thanked the Board for the passage of the ordinance.
A public hearing was held at 10:20 a.m. for approval of Starcomm Leases.
Motion by Boykin second by Walish to close the hearing. Carried 5-0.
The Chairman called on anyone wishing to be heard.
Motion by Batcheller second by Monson to approve leasing tower space to Long Lines Wireless with a letter of clarification attached. Carried 5-0.
Bid letting was held at 10:20 a.m. for propane for the 2006-2007 season.
Bids were as follows:

$1.360/Gallon = $59,160.00

$1.380/Gallon = $60,030.00
Sapp Bros. Petroleum, Incorporated, Sioux City

Motion by Batcheller second by Walish to receive the bids and refer them to the County Engineer for recommendation. Carried 5-0. Copy filed.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution establishing road closures for 2006 construction projects, per recommendation of the County Engineer. Carried 5-0.
WOODBURY COUNTY, IOWA
RESOLUTION #10,088
BE IT RESOLVED, by the Woodbury County Board of Supervisors, duly assembled, pursuant to Section 306.41 of the Code of Iowa, 2005, as amended, that the following section of highway described below and shown on Exhibit B attached hereto and by this reference made a part hereof, will become closed for a period of time for construction and thereupon the County Engineer is directed to cause signs and partial or total barricades to be erected in the roadway at each end of said described highway and on said highway where intersected by other highways, reading Road Closed. Said described highway shall become closed effective upon erection of signs and barricades, and shall remain closed until said signs and barricades are removed.

A public hearing and sale of property parcel #524310 (aka 2112 Douglas Street, Sioux City) was held at 10:30 a.m. The Chairman called on anyone wishing to be heard on said sale.
Nick Corey addressed concerns about a clear title to the property.
Motion by Boykin second by Batcheller to close the public hearing and sale of property parcel #524310 (aka 2112 Douglas Street, Sioux City). Carried 5-0.
There were no bids.
Motion by Monson second by Boykin to republish and sell the property in three weeks. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES
WHEREAS, Margaret A. Roark, is the titleholder of property located at 306 W. Main Street. City of Anthon, Woodbury County, Iowa, and legally described as follows:

Anthon City Of Moores Addition Lot Six (6) Block Two(2)
WHEREAS, Margaret A. Roark as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Batcheller second by Monson to approve lifting the tax suspension for Elaine J. Menefee, 2525 S. Martha Street, Sioux City, as the property has been foreclosed. Carried 5-0.
John Torbert, Executive Director of the Iowa Drainage District Association, presented the Board with an annual update.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until September 12, 2006.
