The Board of Supervisors met on Tuesday, August 8, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

Motion by Batcheller second by Walish to approve the Board minutes of the August 1, 2006 meeting as submitted. Carried 5-0. Copy filed.
The Board approved the resignation of Neliesha A. Daws, Reserve Member, County Sheriff Dept., effective 07/31/2006. Resignation. Copy filed.
The Board approved the resignation of Kenneth M. Giese, Equipment Operator, Secondary Roads Dept., effective 08/04/2006. Resignation. Copy filed.
The Board approved the appointment of Daniel M. Whitlock, Temporary Correctional Officer, County Sheriff Dept., $14.32/hour, effective 08/10/2006. Not to exceed 120 days. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for:
Custodian, Building Services Dept.
Entry level: AFSCME Courthouse Grade 1: $10.45/hour.
Equipment Operator, Secondary Roads Dept.
Entry level: CWA: $16.02/hour.

The Board discussed the Countys participation as co-sponsor for the Sioux City Community Schools Career, College and Leadership Conference on October 17, 2006.
Motion by Monson second by Boykin to approve the Countys participation as co-sponsor for the Career, College and Leadership Conference. Carried 5-0.
Motion by Walish second by Batcheller to receive the County Recorders report of fees collected for the period of 04/01/2006 through 06/30/2006. Carried 5-0. Copy filed.
Motion by Boykin second by Batcheller to approve and receive for signatures, a Resolution setting the public hearing date for the Starcom tower lease, per recommendation of Gary Brown, Emergency Services Director. Carried 5-0.
WOODBURY COUNTY, IOWA
RESOLUTION # 10,081
NOTICE OF PUBLIC HEARING
WHEREAS, Siouxland Tri-State Area Radio Communications System (STARCOMM) provides public safety radio services to Woodbury County, Iowa, Dakota County, Nebraska, Union County, South Dakota, the City of Sioux City, Iowa, the City of Sergeant Bluff, Iowa, the City of North Sioux City, South Dakota, and the City of South Sioux City, Nebraska; and,
WHEREAS, Woodbury County owns telecommunications towers and shelters located at 4647 Stone Avenue, Sioux City, Iowa; 3430 West 23rd Street, Sioux City, Iowa; 2100 Platt Road, Homer, Nebraska, as part of the communications system operated by STARCOMM; and,
WHEREAS, Woodbury County is authorized by Ordinance No. 21 to offer to a private telecommunication enterprise, which competes with other businesses in the telecommunications industry, the opportunity to lease space on the telecommunications towers owned by Woodbury County and operated by STARCOMM for telecommunications equipment and lease space for equipment in the compounds owned by Woodbury County and operated by STARCOMM; and,
WHEREAS, Section 331.361(2) of the Code of Iowa grants Woodbury County the power to dispose of interests in real property by lease
IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposed leases shall be held on the 29th day of August, 2006 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse, 620 Douglas Street, Sioux City, Iowa.
2. That said Board proposes to lease the said property to Long Lines Wireless LLC for a term of five (5) years, with an option to renew the leases for four (4) additional terms of five (5) years, for at least $1250.00 per month through the initial term for the following three sites, following the closing of the public hearing.
3. That drafts of said leases are available for public inspection in the office of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
4. That this resolution, preceded by the caption Notice of Public Hearing and except for subparagraph 4 be published as notice of the aforesaid proposal, hearing and action.

The Board discussed a beer keg registration ordinance with Bobbier Johnson, Assistant County Attorney.
A public hearing was held regarding a petition for rezoning parcel GIS #884704376001, received from Landmark Holdings, LLC.
The Chairman called on anyone wishing to be heard.
Motion by Monson second by Boykin to close the public hearing. Carried 5-0.
Motion by Monson second by Batcheller to approve the rezoning of parcel GIS# 8847 04 376 001, better known as 1421 170th St., Sioux City to General Commercial-Planned Development. Said planned development use is to be limited to any use meeting the definition of office building as referred to in ordinance Section 16(A)(2)(u.1). Carried 5-0.
Motion by Walish second by Monson to approve and authorize the Chairman to sign a 28E agreement between Woodbury County SHIP and Juvenile Court Services for partial funding of at-risk youth in Woodbury County. Carried 4-0; Boykin abstained. Copy filed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Motion by Monson second by Walish to reconsider the motion to approve the rezoning of parcel GIS#
8847 04 376 001 at a later date. Carried 5-0.
The Board adjourned the regular meeting until August 15, 2006.
