JULY 25, 2006TWENTY-NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 25, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson, Deputy/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Batcheller to approve the Board minutes of the July 18, 2006 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the separation of Patrick A. Jennings, Assistant County Attorney, County Attorney Dept., effective 07/17/2006. Separation. Copy filed.

The Board approved the appointment of Patrick A. Jennings, Interim County Attorney, County Attorney Dept., $33,690/4 months, effective 07/18/2006. 4-month appointment as Interim County Attorney. Copy filed.

The Board approved the appointment of Joshua R. Brunsting, Correctional Officer, County Sheriff Dept., $14.32/hour, effective 07/26/2006. Job vacancy posted 06/14/2006. Entry level salary: $14.32/hour. Copy filed.

The Board approved the appointment of Bryan E. Wilson, Correctional Officer, County Sheriff Dept., $14.32/hour, effective 08/01/2006. Job vacancy posted 06/14/2006. Entry level salary: $14.32/hour. Copy filed.

The Board approved the separation of Elven C. Merritt, Jr., Temporary Shredder, effective 08/05/2006. End of temporary work. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for an Assistant County Attorney, County Attorney Dept. Entry level salary: Assistant County Attorney AFSCME $43,087-$49,829/year, based on experience. Carried 5-0. Copy filed.

Motion by Walish second by Monson to receive the 4th quarter Sheriffs Civil Division year-to-date report for period ending June 30, 2006. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a retail liquor license renewal for Shop-N-Go, 1863 Hwy 141, Sloan. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and receive for signatures a Resolution naming depositories for the Woodbury County Conservation Department. Carried 5-0.

BE IT RESOLVED by the Woodbury County Board of Supervisors in Woodbury County, Iowa: That we do hereby designate the following named banks to be depositories of the Woodbury County funds in amounts not to exceed the
amount named opposite each of said designated depositories and Rick Schneider, Woodbury County Conservation is hereby authorized to deposit the Woodbury County funds in amounts not to exceed in the aggregate the amounts named

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a letter of support for the City of Correctionville in the construction of a trail system to connect the city to the Little Sioux Park Trail Project. Carried 5-0.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign the final plats for Tomoson Division and Subdivision (parcel GIS #8847 21 101 001), per recommendation by the Zoning Commission. Carried 5-0.

RESOLUTION #10,077
RESOLUTION ACCEPTING AND APPROVING TOMOSON ADDITION
TO WOODBURY COUNTY, IOWA

WHEREAS, the owner and proprietor did on the 17th day of July, 2006, file with the Woodbury County Zoning Commission a certain plat designated as Tomoson Addition to Woodbury County, Iowa; AND

WHEREAS, it appears that said plat conforms with all of the provisions of the code of the State of Iowa and ordinances of Woodbury County, Iowa, with reference to the filing of same; AND

WHEREAS, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; AND

WHEREAS, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.

NOW THEREFORE, BE AND IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, that the plat of Tomoson Addition to Woodbury County, Iowa be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, are hereby directed to furnish to the owner and proprietor a certified copy of this resolution as required by law.

The Board reviewed a proposal from Kooiker, Incorporated, Le Mars, for a bridge maintenance repair project, with County Engineer Richard Storm.

Motion by Batcheller second by Boykin to approve the proposal, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to receive and approve a quote from Sta-Bilt Construction Company, Harlan, for maintenance slurry level repairs, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a Resolution, authorizing vacating excess roadway right-of-way for a section of Correctionville Road, per recommendation of the County Engineer. Carried 5-0.

RESOLUTION #10,078
A RESOLUTION VACATING EXCESS ROADWAY RIGHT-OF-WAY

WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.10 (Code of Iowa), as amended, has determined that a portion of the roadway right-of-way of a section of Correctionville Road located in the N of Section 33, T89N, R46W Concord Township, Woodbury County, Iowa is no longer needed for roadway purposes. The portion to be vacated is described as follows and shown on the attached plat map.

Vacate a portion of the excess right-of-way along relocated Correctionville Road and or the right-of-way of the Sioux City and Correctionville Road, AKA County Road 390 said tract lying north of relocated Correctionville Road in part of the North of Section 33, T89N, R46W of the 5th Principal Meridian (P.M.), Woodbury County, Iowa. Beginning at Station 160+00, thence easterly for a distance of 850.00 feet along the centerline of relocated Correctionville Road to the Westerly Right-of-Way of Carroll Avenue in part of Section 33, T89N, R46W of the 5th P.M., Woodbury County, Iowa. Woodbury County retains easement to 70.00 feet normally distant north of present centerline. Said area containing 1.13 acres, more or less.

NOW THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors, in accordance with Section 306.10 (Code of Iowa), as amended, hereby vacates that excess right-of-way described above. From and after the date this resolution is recorded, the identified property shall no longer constitute a street or highway, or public right-of-way, but shall revert to private ownership pursuant to operation of law.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Adam Finzen, Alex Solsma, Emily Nelson, and Carolyn Goodwin, Adult Advisor, representing the Mayors Youth Commission, addressed the Board regarding the Boards position on beer keg registration. This item will be placed on next weeks meeting agenda.

Bid letting was held at 10:30 a.m. for Courthouse freight elevator replacement.

Motion by Batcheller second by Boykin to close the bid letting. Carried 5-0.

Regina Smith, RML Architects, addressed the Board concerning the freight elevator replacement.
Melanie Raap, West Plains Engineering, addressed the Board concerning the freight elevator replacement.

One bid was received from Holtze Construction Company.

Discussion took place regarding the fact that only one bid was received.

Motion by Boykin second by Walish not to receive any and all bids. Carried 3-2, Batcheller and Monson opposed.

The Board Chairman directed Karen James, Board Administrative Coordinator, to return Holtze Construction Companys unopened bid, along with a letter of explanation.

Motion by Batcheller second by Boykin to go into closed session per Iowa Code 21.5 (1) (c). Carried 5-0 on a roll-call vote.

Motion by Batcheller second by Walish to go out of closed session per Iowa Code 21.5 (1) (c). Carried 5-0 on a roll-call vote.

The Board adjourned the regular meeting until August 1, 2006.
