JULY 18, 2006TWENTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 18, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Batcheller second by Boykin to approve the Board minutes of the July 11, 2006 meeting as submitted. Carried 5-0. Copy filed.
The Board approved the reclassification of Joseph P. Bukovich, Deputy Sheriff, County Sheriff Dept., $18.76/hour, effective 07/25/2006. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.
The Board approved the end of probation salary increase for Michael D. Jarabek, Engineering Technician I, Secondary Roads Dept., $16.28/hour, effective 08/01/2006. Per CWA contract agreement, end of probation salary increase. Copy filed.
The Board approved the reclassification of Dawn N. Zahnley, Secretary, Disaster Services Dept., $13.33/hour, effective 08/02/2006. Per Wage Plan comparability with AFSCME Courthouse contract. Copy filed.
The Board approved the reclassification of Susan P. OMeara, Elections Clerk II, County Auditor/Recorder Dept., $12.05/hour, effective 08/02/2006. Per AFSCME Courthouse contract agreement, from Grade 3, Step 1 to Grade 3, Step 2. Copy filed.
The Board approved the reclassification of Chad L. Heckert, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 08/06/2006. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.
Motion by Boykin second by Walish to approve the appointment of Patrick Jennings, as interim County Attorney, effective immediately.
Steve Salem, Chairperson of Woodbury County Republican Party addressed the Board and spoke in opposition to the motion.
Motion carried 4-1, on a roll call vote, Batcheller opposed.
Motion by Boykin second by Monson to set the Public Hearing and Sale of property parcel #440850 (a.k.a. 1009 Mulberry Street) on August 1, 2006 at 10:15 a.m. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:
Lots 7 and 8, Block 3, Robsons Addition, City of Sioux City, Woodbury County, Iowa
(1009 Mulberry St.)
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 1st Day of August, 2006 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 1st Day of August, 2006, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 286.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Batcheller second by Walish to receive the County Sheriffs Report of Unadjudicated Condemnation Funds for cases under appeal for the fiscal year ending June 30, 2006. Carried 5-0. Copy filed.
Motion by Walish second by Boykin to receive the County Sheriffs Report of Unadjudicated Condemnation Funds for cases not under appeal for the fiscal year ending June 30, 2006. Carried 5-0. Copy filed.
The Board discussed a petition for rezoning received from Landmark Holdings, LLC, with John Pylelo, Planning and Zoning Administrator.
Motion by Boykin second by Batcheller to refer the rezoning petition to the Zoning Commission for review and recommendations. Carried 5-0.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign contract #5887CO97 with the Iowa Department of Public Health, for local public health services funding for fiscal year 2007. Carried 5-0. Copy filed.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign a 28E agreement with the Iowa Treasurers Association, and to receive for signatures, a Resolution authorizing the Woodbury County Treasurer to sign an intergovernmental agreement for joint and cooperative action, per recommendation of Bob Knowler, County Treasurer. Carried 5-0.

RESOLUTION AUTHORIZING WOODBURY COUNTY TREASURE TO SIGN INTERGOVERNMENTAL AGREEMENT FOR JOINT AND COOPERATIVE ACTION
BE IT RESOLVED, and it is hereby resolved, that the INTERGOVERNMENTAL AGREEMENT FOR JOINT AND COOPERATIVE ACTION, attached hereto is approved and adopted by Woodbury County.
BE IT FURTHER RESOLVED, that the Woodbury County Treasurer is authorized to participate as a Sponsor in the attached agreement in his capacity and consistent with his authority as County Treasurer of this County.
BE IT FURTHER RESOLVED, that the Woodbury County Treasurer is authorized to take any additional actions and execute any documents that are, in his discretion, necessary to facilitate this Resolution.

RESOLUTION NO. 10,075
A RESOLUTION VACATING EXCESS ROADWAY RIGHT-OF-WAY
WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.10 (Code of Iowa), as amended, has determined that a portion of the roadway right-of-way on the North Line of part of the NW of Section 20, T88N, R47 Woodbury Township, Woodbury County, Iowa is no longer needed for roadway purposes. The portion to be vacated is described as follows and shown on the attached aerial photo.
Vacate a portion of the excess right-of-way lying between the East Right-of-Way of Lakeport Street easterly to the West right-of-way of Old Lakeport Road on the North Line of part of the NW of Section 20, T88N, R47W of the 5th Principal Meridian (P.M.), Woodbury County, Iowa. Established as Road No. 137 AKA Yeomans Road, now known as Donner Avenue or extension of Derocher Path. All utility easements occupying said section shall remain.
NOW THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors, in accordance with Section 306.10 (Code of Iowa), as amended, hereby vacates that excess right-of-way described above. From and after the date this resolution is recorded, the identified property shall no longer constitute a street or highway, or public right-of-way, but shall revert to private ownership pursuant to operation of law.

Motion by Boykin second by Walish to approve the quote from Kookier Inc. Crane and dragline service for repairs to a bridge on 170th Street in Wolf Creek Township. Carried 5-0.
Motion by Boykin second Monson to reconsider the previous motion at the next Board Meeting to allow the item to be placed on the agenda. Carried 5-0.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
County Attorney Appointee Patrick Jennings was sworn in by Chief Judge Duane Hoffmeyer.
The Board toured County Roads.
The Board adjourned the regular meeting until July 25, 2006.
