JULY 11, 2006TWENTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 11, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Batcheller second by Monson to approve the Board minutes of the June 27, 2006 meeting as submitted. Carried 4-0, Walish abstained. Copy filed.
Motion by Boykin second by Monson to receive the resignation of Thomas S. Mullin, Woodbury County Attorney, effective July 11, 2006. Carried 5-0.
Motion by Batcheller second by Walish to approve publication of the vacancy appointment date of July 18, 2006 at 10:15 a.m. at the regular Board meeting. Carried 5-0.

The Board approved the reclassification of Katie A. Tucker, Part-time Youth Worker, Juvenile Detention Dept., $14.05/hour, effective 07/13/2006. Per AFSCME Juvenile Detention contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.
The Board approved the reclassification of Anthony J. Fitch, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 07/15/2006. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.
The Board approved the reclassification of Justin J. Renner, Correctional Officer, County Sheriff Dept., $15.46/hour, effective 07/16/2006. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.
The Board approved the reclassification of Lisa M. Drum, Part-time Youth Worker, Juvenile Detention Dept., $14.05/hour, effective 07/20/2006. Per AFSCME Juvenile Detention contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.
Motion by Monson second by Walish to approve lifting the tax suspension for Dorothy E. Lane, as the property (4513 Military Road, Sioux City) has been sold. Carried 5-0.
Motion by Monson second by Walish to receive the County Auditors Quarterly Report for the 4th quarter ending 06/30/2006. Carried 5-0. Copy filed.
Patty Erickson-Putmann reviewed a notification with the Board, of a grant award received under the ODCP application guidelines for Project Safe Neighborhoods Anti-Gang Initiative. The award is for $17,491 and is to be utilized for the purchase of: laptop projector, the development and presentation of 24 public educational programs, and development of public education materials.
Motion by Boykin second by Walish to receive the notification. Carried 5-0.
The Board discussed the preliminary plats for Tomoson Addition Subdivision (Parcel #GIS 8847 21 101 001), with Peggy Napier, County Zoning.
Motion by Boykin second by Batcheller to approve the recommendation of the Zoning Administrator regarding the preliminary plats for Tomoson Addition Subdivision (Parcel #GIS 8847 21 101 001) and refer the final plat to the Zoning Commission for review and recommendations. Carried 5-0.
Motion by Walish second by Monson to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Qwest Corporation, Omaha, NE, to install a new section of underground telephone line, per recommendation by the County Engineer. Carried 5-0. Copy filed.
Motion by Boykin second by Monson to approve and authorize the Chairman to sign an agreement for engineering services to be provided by HGM Associates, Inc., Omaha, NE, for providing design and plans for a proposed bridge replacement on County Route K-49 north of Lawton, per recommendation of the County Engineer.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign contracts with Fred Carlson, Decorah, IA for projects #HDP-CO97(55)6B-97 and L-R02(1)73-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Boykin second by Walish to approve and authorize the Chairman to sign a first amendment to the State of Iowa Lease Agreement for the Trosper-Hoyt ICN Room. Carried 5-0. Copy filed.
A public hearing was held at 10:15 a.m. for the sale of excess road right-of-way real estate owned by Woodbury County.
Motion by Batcheller second by Walish to close the hearing. Carried 5-0.
The Chairman called for bids.
Mark Pottorff, 113 Pioneer Valley Drive, Sergeant Bluff, bid $750.00.
There were no further bids.
Motion by Boykin second by Walish to accept the bid of Mark Portoff for $750.00, plus recording fees. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
MARK POTTORFF in the sum of SEVEN HUNDRED FIFTY AND 00/100 ($750.00) dollars.
For the following described real estate, To Wit:
All that part of the Northwest Quarter (NW ) of Section 20, Township Eighty Seven (87) North, Range Forty Six (46) West of the Fifth (5th) Principal Meridian, Woodbury County, Iowa, described as commencing at the Southeast (SE) Corner of the NW , (also known as the Center Quarter Corner) of Section 20-87-46: thence North 89 27 00 West along the South line of the NW of said Section 20, a distance of 204.47 feet; thence North 39 54 59 West a distance of 932.00 feet; thence North 50 05 01 East a distance of 181.82 feet to the Point of Beginning; thence North 39 54 59 West a distance of 167.70 feet; thence North 50 05 01 East a distance of 75.00 feet; Thence North 39 54 59 West a distance of 359.81 feet; thence North 50 05 01 East a distance of 43.18 feet: Thence South 39 54 59 East a distance of 527.51 feet; thence South 50 05 01 West a distance of 118.18 feet to the Point of Beginning.

BE IT RESOLVED that per Code of Iowa Section 306.22, a parcel of right-of-way the County holds by quit claim deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title.
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.
