JUNE 6, 2006TWENTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 6, 2006 at 9:00 a.m. Board members present were Batcheller, Clausen, Monson; and Walish; Boykin was absent. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson, Deputy/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Walish second by Batcheller to approve the Board minutes of the May 30, 2006 meeting as submitted. Carried 4-0. Copy filed.
The Board approved the appointment of Luke S. Jenkins, Temporary Summer Laborer, Secondary Roads Dept., $7.50/hour, effective 06/07/2006. Not to exceed 120 days. Copy filed.
The Board approved the reclassification of Cynthia L. Foxhoven, Custodian, Building Services Dept.,
$11.20/hour, effective 06/15/2006. Per AFSCME Courthouse contract agreement from Grade1, Step 2 to Grade 1, Step 3. Copy filed.
The Board discussed planning of health and dental reserves with Cathy Mengel, First Administrators.
Joy Caudron, Administrative Assistant, Human Resources Department, introduced new employee Gloria Mollet, HR/Safety Aide.
Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a Resolution approving tax suspension for Elem Ford, 1303 W. 6th Street, Sioux City. Carried 4-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES
WHEREAS, Elem Ford as titleholder of property located at 1303 W 6th Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

East Sixty Feet (E60) Lot Five-Six (5-6) Block Five (5) Tredways Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Elem Ford as titleholders of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution authorizing vacating excess roadway right-of-way, at the intersection of County Route K-49 (Fayette Avenue) and County Route D-12 (110th Street) per recommendation by the County Engineer. Carried 4-0.

RESOLUTION #10,062
A RESOLUTION VACATING EXCESS ROADWAY RIGHT-OF-WAY
WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.10 (Code of Iowa), as amended, has determined that a portion of the roadway right-of-way at the intersection of County Route K-49 (AKA Fayette Avenue) and County Route D-12 (AKA 110th Street) is no longer needed for roadway purposes. The portion to be vacated is described as follows and shown on the attached plan detail:
The portion of road right-of-way to be vacated is located in the SE corner of the SE SE of Section 4, T89N, R45W, Banner Township, Woodbury County, Iowa. Vacate that portion lying west of the south 450 feet and west of the east 60 feet of the east line of the SE SE of said Section 4 and north of the east 450 feet and north of the south 60 feet of the south line of the SE SE of Section 4, containing 1.15 acres, more or less.
NOW THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors, in accordance with Section 306.10 (Code of Iowa), as amended, hereby vacates that excess right-of-way described above. From and after the date this resolution is recorded, the identified property shall no longer constitute a street or highway, or public right-of-way, but shall revert to private ownership pursuant to operation of law.

Motion by Monson second by Walish to approve and authorize the Chairman to sign a utility accommodation permit submitted by Lieber Construction Company, on behalf of Brian Peterson Farms, for installing a drain pipe across and under 180th Street, per recommendation by the County Engineer. Carried 4-0. Copy filed.
A public hearing was held at 10:15 a.m. in regards to a confinement feeding operation construction permit for Oswego Dairy, LLC.
The Chairman called on anyone wishing to be heard on said permit.
Randy Hunt, Oswego Dairy, LLC, gave a presentation.
Jim Redmon, Sierra Club, asked questions and expressed concerns regarding the confinement.
John Herbst, Oswego Dairy, LLC, addressed the Board and responded to questions.
Dale Vermilyea, Luton, expressed concerns regarding the confinement.
Don Salman, Lawton, expressed concerns regarding the confinement.
Motion by Batcheller second by Walish to close the public hearing. Carried 4-0.
Motion by Batcheller second by Walish to authorize the Chairman to sign a document that details what transpired at the public hearing, and what Planning and Zoning has done, in regards to the construction permit, to be submitted to the Iowa Department of Natural Resources. Carried 4-0.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until June 13, 2006.
