MAY 30, 2006TWENTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 30, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson; and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Boykin to approve the Board minutes of the May 23, 2006 meeting as submitted. Carried 4-0; Walish abstained. Copy filed.

The Board approved the separation of Marvin E. Flewelling, Temporary Equipment Operator, Secondary Roads Dept., effective 05/24/2006. End of temporary work. Copy filed.

The Board approved the appointment of Gloria A. Mollet, Human Resources/Safety Aide, Human Resources Dept., $12.48/hour, effective 05/31/2006. Job vacancy posted 03/15/2006. Entry level salary $12.48/hour. Copy filed.

The Board approved the appointment of Cody F. Forch, Temporary Summer Laborer, Secondary Roads Dept., $7.50/hour, effective 05/31/2006. Not to exceed 120 days. Copy filed.

The Board approved the appointment of Jeffrey D. Sailer, Temporary Summer Laborer, Secondary Roads Dept., $7.50/hour, effective 05/31/2006. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of Kimberlee K. Koepke, Part-time Youth Worker, Juvenile Detention Dept., $13.65/hour, effective 06/06/2006. Per AFSCME J. D. contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a Resolution approving tax abatement for St. Thomas Episcopal Church, 1206 and 1209 Pierce Street, Sioux City. Carried 4-0; Boykin abstained.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, St. Thomas Episcopal Church. is the titleholder of real estate Parcels #894728108007 and #894728108008 located in Woodbury County, Iowa and legally described as follows:

Parcel # 894728108007

Lot Nine (9) Block Seventy-one (71) Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

Parcel # 894728108008

North Forty feet (40 ft.) Lot Eight (8) Block Seventy-one (71) Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, the above stated property has taxes owing for the 2005/2006 tax year and the parcel is owned by St. Thomas Episcopal Church and

WHEREAS, the organization, namely the St. Thomas Episcopal Church is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 26th day of May, 2006.

Motion by Monson second by Batcheller to approve lifting a tax suspension for Joanne Cakebread, 3008 E. 9th Street, Sioux City. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve the final reading of an ordinance authorizing Woodbury County to lease property to a private enterprise, competing against another private enterprise, doing business in the telecommunications industry. Carried 5-0.

Motion by Walish second by Monson to approve the lease ordinance. Carried 5-0. Copy filed.

The Board discussed with Assistant County Attorney Bobbier Johnson, an ordinance establishing school infrastructure local option sales and service tax.

Motion by Batcheller second by Boykin to approve the first reading of an ordinance establishing school infrastructure local option sales and services tax. Carried 5-0.

Motion by Boykin second by Walish to suspend the requirement for the second and third reading of the proposed ordinance. Carried 5-0.

Motion by Boykin second by Monson to receive for signatures the ordinance establishing school infrastructure local option sales and services tax. Carried 5-0.

The public hearing on fiscal year 2006 budget amendment #2 was held at 10:15 a.m.

Motion by Boykin second by Walish to close the public hearing. Carried 5-0.

Motion by Boykin second by Monson to approve fiscal year 2006 budget amendment #2. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign an application for use of highway right-of-way for underground tile line facility, submitted by Carl and Gayle Palmquist, per recommendation by the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to postpone for one week action to approve and authorize the Chairman to sign a Resolution authorizing vacating excess roadway right-of-way, at the intersection of County Route K-49 (Fayette Avenue) and County Route D-12 (110th Street) per recommendation by the County Engineer. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until June 6, 2006.
