APRIL 18, 2006--SIXTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 18, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Jean Jessen, Deputy/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the April 11, 2006 meeting as submitted. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve and receive for signatures, a Resolution adopting and levying a special assessment in the Little Sioux Inter-County Drainage District. Carried 5-0.

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE LITTLE SIOUX INTER-COUNTY DRAINAGE DISTRICT
RESOLUTION #10,045

WHEREAS, the Board of Trustees of the Little Sioux Inter-County Drainage District, in session on the 9th day of March, 2006, requested that the Board of Supervisors levy a special assessment of Forty-two (42%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona, Woodbury and Harrison Counties, Iowa, acting as a Drainage Board for the Little Sioux Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties, Iowa, a special assessment in the amount of Forty-two (42%) Percent of the Original Assessment, and the Auditors of Monona, Woodbury and Harrison Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2006-2007.

IN THE MCCANDLESS INTERCOUNTY DRAINAGE DISTRICT
RESOLUTION #10,046

WHEREAS, the Board of Trustees of the McCandless Inter-County Drainage District, in session on the 15th day of February, 2006, requested that the Board of Supervisors levy a special assessment of eighty percent (80%) of the Original Assessment on all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

IN THE SANDHILL-LAKEPORT DRAINAGE DISTRICT
RESOLUTION #10,047

WHEREAS, the Board of Trustees of the Sandhill-Lakeport Inter-County Drainage District, in session on the 22nd day of March, 2006, requested that the Board of Supervisors levy a special assessment of Twenty-One (21%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

Motion by Walish second by Monson to approve and authorize the Chairman to sign a Memorandum of Understanding with the Iowa Department of Public Health for a $10,000 award to Woodbury County to be used for DARE continuation. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to receive applications to the Iowa Office of Drug Control Policy for Project Safe and Neighborhoods and Anti-Gang Initiative for federal grant awards. Carried 5-0.

Motion by Monson second by Walish to approve the 3-year strategic plan for Woodbury County Mental Health, for submittal to the Iowa Department of Human Services. Carried 5-0.

Motion by Batcheller second by Boykin to approve a cigarette/tobacco permit for Twenty-Seven Flags Golf Course, 2299 Alicia Avenue, Sergeant Bluff. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution for suspension of taxes for Dorothy L. Buckholtz, 4200 Military Road, Sioux City. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Dorothy L. Buckholtz, is the titleholder of property located at 4200 Military Road, City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Vacant Lots 1 & 2 & 4 Block 12 Fairview Addition North 1/2 NW 24-89-48 LL-SC Comm. City of Sioux City, Woodbury County, Iowa

WHEREAS, Dorothy L. Buckholtz as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Public Hearing and Sale of real estate parcel #554820 (3245 Floyd Blvd.) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Boykin to close the public hearing and sale of parcel #554820. Carried 5-0.

The Chairman called for bids on real estate parcel #554820.

Don Kessler bid $110.00 plus recording fees.

There were no other bids.

Motion by Batcheller second by Monson to accept the bid of $110.00 plus recording fees, from Don Kessler. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Boykin to sign Change Order #1, for jail alterations, in the amount of $3,600.00 to be paid from Capital Note funding. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until April 25, 2006.
