APRIL 11, 2006--FIFTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 11, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of the April 4, 2006 meeting as submitted. Carried 5-0. Copy filed.

The Board approved an unpaid medical leave of absence effective 03/29/2006 for Denise M. Fletcher, Executive Secretary/Public Bidder, Board Administration Dept. Copy filed.

The Board approved the reclassification of Kenneth E. Grimes, Correctional Officer, County Sheriff Dept., $15.31/hour, effective 04/23/2006. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.

The Board approved the reclassification of Brent R. Eickholt, Correctional Officer, County Sheriff Dept., $15.31/hour, effective 04/30/2006. Per DSA contract agreement, from Class 3 to Class 2. Copy filed.

The Board approved the reclassification of Mary E. Peters, Full-time Youth Worker, Juvenile Detention Dept., $16.54/hour, effective 04/30/2006. Per AFSCME JD contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign an updated Statement of Agreement for Woodbury Countys Workers Compensation Program. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to receive the minutes from the February 7, 2006 Mental Health public meeting. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign the final plats for Ellis First Addition Subdivision (parcel #878947), per recommendation by the Zoning Commission. Carried 4-1, Clausen opposed.

ACCEPTING AND APPROVING ELLIS FIRST ADDITION TO WOODBURY COUNTY, IOWA.

WHEREAS THE OWNERS AND PROPRIETORS DID ON THE 1st DAY OF FEBRUARY, 2006, FILE WITH THE WOODBURY COUNTY AUDITOR OF WOODBURY COUNTY, IOWA, A CERTAIN PLAT DESIGNATED AS ELLIS FIRST ADDITION TO WOODBURY COUNTY, IOWA AND WHEREAS IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME.

NOW THEREFORE, BE IT RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF ELLIS FIRST ADDITION TO WOODBURY COUNTY, IOWA, BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISIORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

The Board discussed the preliminary plats for Kollbaums Re-subdivision (parcel #GIS 8846-32-300-004), with John Pylelo, County Zoning Administrator.

Motion by Batcheller second by Walish to approve the recommendation of the Zoning Administrator regarding the preliminary plats for Kollbaums Re-subdivision (parcel #GIS 8846-32-300-004) and refer it to the Zoning Commission for review and recommendations. Carried 5-0.

The Public Hearing and Sale of real estate parcel #503565 (3403 Marshall Avenue) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Walish to close the public hearing and sale of parcel #503565. Carried 5-0.

The Chairman called for bids on real estate parcel #503565.

Scott Weigel bid the minimum bid of $150.00 plus recording fees.

There were no other bids.

Motion by Batcheller second by Monson to accept the bid of $150.00 plus recording fees, from Scott Weigel. Carried 5-0.

RESOLUTION #10,044

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public
auction of:

By SCOTT AND KRIS WEIGEL, HUSBAND AND WIFE, AS JOINT TENANTS WITH FULL RIGHTS OF SURVIVORSHIP AND NOT AS TENANTS IN COMMON in the sum of ONE HUNDRED FIFTY & 00/100 ($150.00) dollars.

For the following described real estate, To Wit:

Parcel #503565
West Sixty-three Feet (W 63 ft) of Lot Five (5) and Vacated East One-Half (E ) South Cornelia Street Abutting Lot Five (5) in Block Sixteen (16) of Table
Addition, City of Sioux City, Woodbury County, Iowa (3403 Marshall Ave.)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or
this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed
shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the
purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested
to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to
execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Walish to deny a request for suspension of taxes for Phan Thi Nguyen for buildings at 809 W. 7th Street and 401 W. 7th Street, both in Sioux City. Carried 5-0.

Motion by Batcheller second by Walish to postpone action to authorize the Chairman to sign a Resolution for suspension of taxes for Dorothy L. Buckholtz, 4200 Military Road, Sioux City. Carried 5-0.

Motion by Monson second by Walish to approve and authorize the Chairman to sign a Class C Liquor License, allowing on-premises consumption of liquor, wine, beer, carryout beer, outdoor service, and Sunday Sales privileges for Hoo Haa, Incorporated/Twenty-Seven Flags Golf, 2299 Alicia Avenue, Sergeant Bluff. Carried 5-0. Copy filed.

Motion by Walish second by Monson to approve and authorize the Chairman to sign a Class A Liquor License, allowing on-premises consumption of liquor, wine, beer, and Sunday Sales privileges for White Horse Patrol Club, 1689 Old Highway 141, Sergeant Bluff. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to receive the County Auditors Quarterly Report for the period of 01/01/2006 to 03/31/2006. Carried 5-0. Copy filed.

The Board discussed Siouxland District Board of Health rules for isolation and quarantine, with Fran Sadden, Siouxland District Health.

Motion by Batcheller second by Walish to approve and adopt the Siouxland District Board of Health rules for isolation and quarantine. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to receive and approve the recommendations of County Engineer Richard Storm to accept the quote and award the bid for the 2006 maintenance paint striping program to Dakota Traffic Services LLC, Sioux City, in the amount of $85,435.00. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by B & B Services, Sloan, to bore and jack a waterline under Poplar Street in Salix, per recommendation of the County Engineer. Carried 5-0. Copy filed.

The County Engineer presented the Board with a proposed Woodbury County Jake Brake Ordinance, for a section of Iowa 141 outside the corporate limits of Sloan, for the first hearing.

Motion by Boykin second by Walish to close the first hearing of the Jake Brake Ordinance. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to suspend the requirement for the second and third reading of the Jake Brake Ordinance. Carried 5-0.

Motion by Boykin second by Monson to approve the Jake Brake Ordinance. Carried 5-0

Motion by Walish second by Boykin to approve and authorize the Chairman to sign an application for use of highway right-of-way for underground tile line facility submitted by Lundell Construction, Cherokee, per recommendation by the County Engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to receive and approve the recommendations of County Engineer, Richard Storm, to accept the quote and award the bid for truck dump boxes, hoists, and hydraulics to Northern Truck Equipment, Sioux Falls, in the amount of $101,928.00. Carried 4-1, Boykin opposed. Copy filed.

Mr. Batcheller excused himself at 10:40 AM.

The Board discussed problems with farming in the County right of Way.

Nancy Countryman of the County Landfill invited the Board to an open house at the landfill.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board toured the third floor of the Trosper-Hoyt Building.

The Board adjourned the regular meeting until April 18, 2006.
