FEBRUARY 14, 2006--SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 14, 2006 at 9:00 a.m. Board members present were Clausen, Batcheller, Boykin, and Monson; Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

The Board toured the County Jail.

Meeting called to order.

Motion by Boykin second by Monson to approve the Board minutes of the February 7, 2006 meeting as submitted. Carried 4-0. Copy filed.

The Board approved the reclassification of Nancy M. Carstensen, Part-time Motor Vehicle Clerk II, County Treasurer Dept., $14.57/hour, effective 02/26/2006. Per AFSCME Courthouse contract agreement from Grade 4, Step 4 to Grade 4, Step 5. Copy filed.

The Board approved the promotion of David D. Bridenbaugh, Lead Custodian, Building Services Dept., $13.37/hour, effective 02/15/2006. In-house posting 10/27/2005. Per AFSCME Courthouse contract from Grade 1, Step 4 to Grade 2, Step 5. Copy filed.

The Board discussed Woodbury Countys employee life insurance benefit plan with J. D. Pellersels, Human Resources Director.

Motion by Batcheller second by Monson to approve and receive for signatures, a Resolution thanking and commending Richard Mercer for his years of service to Woodbury County. Carried 4-0.

A RESOLUTION THANKING AND COMMENDING
Richard Mercer

FOR His SERVICE TO WOODBURY COUNTY

WHEREAS, Richard Mercer has capably served Woodbury County as an employee of the Woodbury County Secondary Roads Department for 28 years and 9 months, from June of 1977 to March 2006; and

WHEREAS, the service given by Richard Mercer as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Richard Mercer for his twenty eight years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Richard Mercer; and

BE IT SO RESOLVED this 14th of February, 2006.

Leo Miller, Gang Task Force Specialist, gave an update to the Board on gang activities.

The Public Hearing and Sale of Property for Parcel #299640 (aka 2019 1/2 Ingleside Avenue) was held at
10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Batcheller to close the Public Hearing and Sale of Parcel #299640.
Carried 4-0.

The Chairman called for bids on Real Estate Parcel #299640.

Jim Parks bid $350.00 plus recording fees; Tony Blair bid $400.00 plus recording fees; Jim Parks bid $401.00 plus recording fees; Tony Blair bid $410.00 plus recording fees; Jim Parks bid $420.00 plus recording fees; Tony Blair bid $421.00 plus recording fees; Jim Parks bid $450.00 plus recording fees; Tony Blair bid $460.00 plus recording fees; Jim Parks bid $470.00 plus recording fees; Tony Blair bid $500.00 plus recording fees. Motion by Batcheller second by Monson to accept the bid of $500.00 plus recording fees, from Tony Blair.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Tony and Adrienne Blair as joint tenants and not as tenants in common in the sum of Five Hundred Dollars and 00/100 ($500.00)

For the following described real estate, To Wit:

Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 28th Day of February, 2006 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 28th Day of February, 2006, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 305.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

The Board discussed funding for the Loess Hills National Scenic Byway.

Motion by Boykin second by Monson to approve the funding for a request of $2,500.00 a year for three years. Failed 2-2; Batcheller and Clausen opposed.

Motion by Boykin second by Monson to approve the funding for a request of $2,500.00 for one year. Carried 3-1; Batcheller opposed.

Bob Lee of RML Architects presented his recommendations on the jail expansion bids.

Motion by Boykin second by Monson to award the contract for the jail expansion project base bid and alternatives 1 and 2 to Chris Hansen Construction. Carried 3-1; Clausen opposed.

Motion by Boykin second by Batcheller to request the Treasurer to proceed with an $800,000.00 Capital Loan Note to fund the contract for the Jail Expansion Project and others to be determined. Carried 3-1; Clausen opposed.

There was no action taken to appoint a representative to the District Associate Judge Selection Committee.

Court Administrator Leesa Mc Neil and Sheriff Glenn Parrett presented the Board with an update on Program Phoenix.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Randy Hammond, 2728 280th St., Hornick, presented a petition to the Board of Supervisors concerning the termination of Patrick Benjamin.

Motion by Monson second by Boykin to receive the petition. Carried 4-0.

The Board adjourned the regular meeting until February 21, 2006.
