FEBRUARY 7, 2006--SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 7, 2006 at 9:00 a.m. Board members present were Clausen, Batcheller, Boykin, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of the January 31, 2006 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Brent L. Trometer, Temporary Custodian, Building Services Dept., $10.16/hour, effective 02/08/2006. Not to exceed 120 days. Copy filed.

The Board approved the appointment of Marvin E. Flewelling, Temporary Equipment Operator, Secondary Roads Dept., $15.60/hour, effective 02/13/2006. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of David C. Skilling, Assistant County Attorney, County Attorney Dept., $57,086/year, effective 02/17/2006. Per AFSCME Attorney contract agreement, from Step 6 to Step 7. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign the Iowa Individual Health Benefit Reinsurance Program 2005 Annual Reporting form. Carried 5-0.

Motion by Walish second by Monson to set the Public Hearing and Sale of Real Estate Parcel #503670 on February 21, 2006 at 10:15 a.m.. Carried 5-0.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total
minimum bid of $ 280.00 plus recording fees.

the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 21st Day of February,
2006, immediately following the closing of the public hearing, to Ronald Seibold, Sr. and
Joyce Seibold only as previously sold on September 20, 2005 for a matter of record.

3. That said Board proposes to sell the said real estate to Ronald Seibold, Sr. and Joyce Seibold
only for consideration of $238.00 plus recording fees for a matter of record.

Motion by Monson second by Batcheller to receive the County Sheriffs Civil Division 2nd quarter and year-to-date report. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a liquor license renewal application with Sunday Sales Privileges for Salix Gas, 1556 27th Street, Salix, Iowa. Carried 5-0. Copy filed.

Gary Brown, Emergency Services, gave a presentation to the Board regarding the Iowa Mutual Aid Compact.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution adopting the Statewide Mutual Aid Compact. Carried 5-0.

RESOLUTION #10,009

WHEREAS, emergencies and disasters transcend jurisdictional boundaries, making intergovernmental coordination essential in successful emergency response efforts; and

WHEREAS, there will inevitably be emergencies which require immediate access to outside resources due to the fact that few individual governments have all of the resources they may need in every type of emergency; and

WHEREAS, Senate File 2124, approved by the Second Session of the 79th General Assembly in 2002, creates Iowa Code section 29C.22, the Statewide Mutual Aid Compact; and

WHEREAS, the Statewide Mutual Aid Compact allows participating counties, cities and other political subdivisions to provide in advance for mutual assistance in managing any emergency or disaster;

THEREFORE, BE IT RESOLVED BY THE BOARD SUPERVISORS OF WOODBURY COUNTY that in order to maximize the prompt, full and effective use of resources of all participating governments in the event of an emergency or disaster, Woodbury County hereby adopts the Statewide Mutual Aid Compact which is attached hereto and incorporated by reference.

Motion by Boykin second by Monson to approve a procedure, in the event a request is made under the Statewide Mutual Aid Compact, to notify the Board Chairperson and if the chair is not available, then proceed alphabetically through Board members. Carried 5-0.

Motion by Walish second by Monson to designate the Woodbury County contact, to be Gary Brown of Disaster Services and then Greg Logan of the Sheriffs Department. Carried 5-0.

Bid opening was held at 10:20 a.m. for Jail expansion work.

Motion by Boykin second by Walish to receive the bids and forward them to R.M.L. Architechture for review and recommendations. Carried 5-0.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution approving BDO Seidman, LLP as the certified public accounting firm that will conduct the annual audit of the Belle of Sioux City, LP, for Woodbury County Carried 3-0, Clausen and Monson abstained.

RESOLUTION #10,010
WOODBURY COUNTY BOARD OF SUPERVISORS

WHEREAS, on April 19, 2004 the Iowa Legislature passed House File 2302, which the Governor signed into law on May 6, 2004.

WHEREAS, House File 2302 amends Iowa Code 99F.13 (2003) and provides that the Board of Supervisors of each county where gambling operations are conducted must select a certified public accountant licensed within the State to conduct the annual audit of certain licensed gambling establishments within the county, specifically providing,

99F.13 ANNUAL AUDIT OF LICENSEE OPERATIONS. Within ninety days after the end of the licensee's fiscal year, the licensee shall transmit to the commission an audit of the financial transactions and condition of the licensee's total gambling operations, including an itemization of all expenses and subsidies. All audits shall be conducted by certified public accountants registered or licensed in the State of Iowa under chapter 542 who are selected by the board of supervisors of the county in which the licensee operates.

WHEREAS, the certified public accounting firm of BDO Seidman, LLP, is experienced in performing audits of gambling operations, is registered and/or licensed to perform such services in the State of Iowa.

NOW THEREFORE BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby appoints the BDO Seidman, LLP certified public accounting firm to conduct the annual audit for the licensee, Belle of Sioux City, L.P.

IT IS FURTHER RESOLVED that this appointment of the BDO Seidman, LLP firm shall remain in effect and renew automatically each year until the Board of Supervisors receives a request from the licensee, Belle of Sioux City, L.P., to appoint another certified public accounting firm to perform the annual audits contemplated under Iowa Code 99F.13.

The Board discussed applicants and appointment to fill an opening on the Woodbury County Board of Adjustment, to replace Chris Zellmer-Zant, whose term expired on December 31, 2005.

Motion by Boykin second by Walish to appoint Bob Brouilette, 1728 280th Street, Salix, to the Woodbury County Board of Adjustment. Carried 5-0. Copy filed.

The Board discussed the recommendations of the Zoning Commission for Ellis First Addition Subdivision (parcel #878941) preliminary plats, with John Pylelo, County Zoning Administrator.

Motion by Boykin second by Monson to approve the recommendation of the Zoning Commission regarding the preliminary plats and to approve the final plats for Ellis First Addition Subdivision (parcel #878941) and refer it to the Zoning Commission for review and recommendations. Carried 5-0.

Motion by Boykin second by Walish to approve and award the bid for one half-ton 4 wheel drive pickup for the Secondary Roads Dept. District #3 to Knoepfler Chevrolet, Sioux City, for a Chevrolet Silverado, bid price of $16,632.00, per recommendation of the County Engineer Richard Storm. Carried 5-0. Copy filed.

2007 Budget discussions:

Sanitary Landfill

Motion by Batcheller second by Boykin to receive the Sanitary Landfill budget as submitted. Carried 5-0.

Motion by Batcheller second by Monson to use $301,724 of the General Basic Reserve Fund to balance the General Basic budgets as received. Carried 5-0.

Motion by Batcheller second by Walish to approve the tax askings for the balance of the balance as received. Carried 4-1, Boykin opposed.

Motion by Monson second by Boykin to set the Public Hearing for approval of the budget for February 28th, 2006 at 10:30 AM. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board toured the County Mental Health facility.

The Board adjourned the regular meeting until February 14, 2006.
