JANUARY 24, 2006--FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 24, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

The Board canvassed the Drainage Ditch Elections held on January 21, 2006. Victoria L. Ritz, Deputy Commissioner of Elections, presented the canvass of the Drainage Ditch Elections held on January 21, 2006. There were no absentee or after-election ballots to be counted.

For the office of Trustee, Sub District #2 for the Farmers Drainage District, there were six-thousand, nine-hundred and sixty-eight (6,968) ballots cast as follows:

Roger Rand received 6,968 votes
Write-Ins received 0 votes

Roger Rand was duly elected to the office of Trustee, Farmers Drainage Ditch Sub District #2 for the term of three (3) years.

For the office of Trustee, Sub District #2 for the Garretson Drainage District, there were ten-thousand, four-hundred, thirty (10,430) ballots cast as follows:

Roger Rand received 10,430 votes
Write-Ins received 0 votes

Roger Rand was duly elected to the office of Trustee, Garretson Drainage Ditch Sub District #2 for the term of three (3) years.

Motion by Batcheller second by Boykin to receive the Farmers and Garretson Drainage Ditch election canvasses. Carried 5-0.

Motion by Batcheller second by Walish to approve the Board minutes of the January 17, 2006 meeting as submitted. Carried 4-0, Clausen abstained. Copy filed.

The Board approved the appointment of Tammy R. Casper, Clerk I/Typist, County Sheriff Dept., $10.64/hour, effective 01/25/2006. Job vacancy posted 12/13/2005. Entry level salary: 10.64/hour.

The Board approved the promotion of Kevin W. Gosch, Jail Sergeant, County Sheriff Dept., $20.54/hour, effective 01/25/2006. In-house posting 01/10/2006. Salary per DSA Contract agreement. Copy filed.

The Board approved the separation of Jeffery L. King, Assistant Building Superintendent, Building Services Dept., effective 02/03/2006. Resignation. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for:

(1) Male or female Correctional Officer, County Sheriff Dept. Entry level: DSA $14.18/hour

(1) Temporary full-time Custodian, Building Services Dept. Entry level: AFSCME $10.16/hour

(1) Assistant Building Superintendent, Building Services Dept. Entry level: Wage Plan $34,414-$35,446/year based on experience

Motion by Monson second by Boykin to approve and authorize the Chairman to sign OSHA 300A forms for 2005. Carried 5-0.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign an application for a Class C Beer Permit Renewal and Sunday Sales Privilege for Heritage Express-Winnavegas, 1501 330th Street, Sloan, Iowa. Carried 5-0. Copy filed.

The Board was presented with an update on the Electronic Monitoring Program, by Michael Arndt, Centralized Intake.

The Board discussed with Patty Erickson-Puttmann, Social Services Coordinator, submitting an application for the Governors Traffic Safety Bureau program.

Motion by Batcheller second by Walish to authorize the Chairman to sign the Iowa Governors Traffic Safety Bureau Section 163 application form. Carried 5-0.

The Public Hearing and Sale of Property for Parcel #673275 was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Walish to close the Public Hearing and Sale of Parcel #673275. Carried 5-0.

The Chairman called for bids on Real Estate Parcel #673275. Jerome Weber bid $265.00 plus recording fees. There were no further bids.

Motion by Boykin second by Monson to accept the bid of $265.00, plus recording fees, from Jim Parks. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Jerome and Wilma Weber as joint tenants and not as tenants in common in the sum of Two hundred sixty-five and 00/100 ($265.00) dollars

For the following described real estate, To Wit:

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS


WHEREAS, Albert Homer as joint titleholder of real estate located at 2205 W. 2nd St.., Sioux City, Woodbury County, Iowa, and legally described as follows:

East Four Feet (4 Ft) Lot Eleven (11) & Lot Twelve (12) Block Twenty (20) Hornicks 2nd Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Albert Homer, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel #894730257010 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

Motion by Batcheller second by Walish to award the bid for the County Farm to Western Slopes Farm, for their bid of $172.00 per acre ($35,844.80 per year). Carried 5-0. Copy filed.

Assistant County Attorney Bobbier Johnson discussed with the Board the possibility of adopting a County ordinance establishing a curfew for persons under 18 years of age.

Motion by Batcheller second by Monson to approve the first reading of an ordinance establishing a curfew for minors in the unincorporated area of Woodbury County. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve the second and third reading of an ordinance establishing a curfew for minors in the unincorporated area of Woodbury County. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve and receive for signatures an ordinance establishing a curfew for minors in the unincorporated area of Woodbury County. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to receive and approve the plans for Project #BRS-CO97(63)60-97, per recommendation of the County Engineer. Carried 4-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Woodbury County R. E. C., to replace an existing overhead electrical distribution line along a section of Correctionville Road from Buchanan Avenue westerly, with an underground line, per recommendation of the County Engineer. Carried 4-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign contracts with Peterson Contractors, Incorporated of Reinbeck, Iowa, and approve bonds with Travelers Casualty and Surety Company of America, Hartford, CT, for Project #BROS-CO97(72)8J-97 for RCB culvert replacement, per recommendation of the County Engineer. Carried 4-0. Copy filed.

There was no action taken to approve and authorize the Chairman to sign a Resolution approving vacating roadway right-of-way for a section of 150th Street in Banner and Arlington Townships, per recommendation of the County Engineer.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

2007 Budget discussions:

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution establishing a designated fund reserve to be used solely for the purchase of personal computers, printers, and applicable software. Carried 4-0.

RESOLUTION APPROVING A DESIGNATED FUND RESERVE

WHEREAS, the Woodbury County Board of Supervisors desires to create a Designated Fund Reserve within the General Basic Fund; and

WHEREAS, the Designated Fund Reserve will be used solely for the purchase of personal computers, printers and applicable software every three Fiscal Years; and

WHEREAS, the Board of Supervisors shall set aside $105,000 each Fiscal Year in the General Basic Fund starting in Fiscal Year 2007; and

WHEREAS, purchase of the personal computers, printers, and related software will be purchased during Fiscal Year 2009; and

NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Woodbury that a Designated Fund Balance in the General Basic Fund is hereby approved and adopted.
