JANUARY 17, 2006--THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 17, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Monson, and Walish; Clausen was absent. Staff members present were Denise Fletcher, Executive Secretary, Diane Swoboda Peterson, Deputy Clerk to the Board and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of the January 10, 2006 meeting as submitted. Carried 4-0. Copy filed.

Motion by Monson second by Walish to approve the Board minutes of the January 4, 2006 special meeting, as submitted. Carried 3-0, Batcheller abstained. Copy filed.

No transactions reported by Human Resources.

Motion by Walish second by Monson to receive the County Recorders Quarterly Report ending
December 31, 2005, from Patrick F. Gill, Woodbury County Auditor/Recorder. Carried 4-0. Copy filed.

John Pylelo and Diane Swoboda Peterson, United Way Committee, presented the 2005 United Way Campaign Report.

The Board of Supervisors held a drawing for prizes.

The Public Hearing and Sale of Property for Parcel #004155 (aka 519 West 2nd Street) was held at
10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Walish to close the Public Hearing and Sale of Parcel #004155, as no
bids were received. Carried 4-0.

The Public Hearing and Sale of Property for Parcel #001680 (aka 615 W. 1st Street) was held at
10:17 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Monson to close the Public Hearing and sale of Real Estate Parcel #001680
(aka 615 W. 1st Street, Sioux City). Carried 4-0.

The Chairman called for bids on Real Estate Parcel #001680. Jim Parks, on behalf of Ismael and Ana Gloria Carabante, bid $385.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Monson to accept the bid of $385.00, plus recording fees, from Ismael and Ana Gloria Carabante. Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:
RESOLUTION # 9996

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction:

By Ismael and Ana Gloria Carabante as joint tenants and not as tenants in common in the sum of Three hundred eighty-five and 00/100 ($385.00) dollars

For the following described real estate, To Wit:

Parcel #001680
NE 36 Ft. of Lots 9 and 10 in Block 7, Sioux City Addition, City of Sioux City,
Woodbury County, Iowa (aka 615 W. 1st St.)


Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

1. That a public hearing on the aforesaid proposal shall be held on the 31st Day of January, 2006 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 31st Day of January, 2006, immediately following the closing of the public hearing.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign Weed Commissioner Certification Form for 2006. Carried 4-0. Copy filed.

Motion by Walish second by Monson to approve and authorize the Chairman to sign Federal-Aid agreement for bridge replacement project BRS-CO97(63)--60-97. Carried 4-0. Copy filed.

The Board discussed funding for the Highway 75/20 Nature Trail.

Motion by Batcheller second by Walish to approve funding for the Highway 75/20 Nature Trail, obtaining half of the funds from River Boat Funds and the other half from Infrastructure. Carried 4-0. Copy filed.

Budget Discussion was held for Fiscal Year 2007.

Conservation General Basic Funds:

Motion by Walish second by Batcheller to receive the Conservation Administration budget. Carried 4-0.

Motion by Batcheller second by Monson to receive the Conservation Parks budget, revised to one new employee, rather than two. Carried 4-0.

Motion by Monson second by Batcheller to remove 1099 employee from the Conservation Naturalist budget. Carried 4-0.

Motion by Monson second by Walish to receive the Conservation Naturalist budget as amended. Carried 4-0.

Conservation Non-Tax Funds:

Motion by Walish second by Monson to receive the Nature Center budget (257). Carried 4-0.

Motion by Batcheller second by Walish to receive the Recap budget (266). Carried 4-0.

Motion by Walish second by Batcheller to receive the Conservation Reserve budget (667). Carried 4-0.

Motion by Batcheller second by Walish to receive the Communication Center-General Basic budget. Carried 4-0.

Motion by Monson second by Batcheller to receive the County Fair-General Basic budget. Carried 4-0.

The Board recessed for lunch at 11:30 a.m.

Motion by Walish second by Batcheller to receive the Emergency Services budget. Carried 4-0.

Motion by Walish second by Monson to receive the Emergency Management budget. Carried 4-0.

Motion by Batcheller second by Walish to receive the SLA Grant budget. Carried 4-0.

Motion by Batcheller second by Walish to receive the Starcom budget, without the $50,000 deductible included. Carried 4-0.

Motion by Batcheller second by Monson to receive the Board Expense-General Basic budget, with an amendment of Professional Services of -$10,000. Carried 4-0.

Motion by Walish second by Monson to receive the Board Administration-General Basic budget.
Carried 4-0.

Motion by Batcheller second by Monson to receive the Civil Service-General Basic budget. Carried 4-0.

Motion by Walish second by Monson to receive the Public Bidder-General Basic budget. Carried 4-0.

Building Services General Basic:

Motion by Monson second by Walish to receive the Courthouse budget. Carried 4-0.

Motion by Batcheller second by Monson to receive the LEC budget. Carried 4-0.

Motion by Monson second by Batcheller to receive the Trosper Hoyt budget. Carried 4-0.

Motion Walish by second by Monson to receive the Prairie Hill budget. Carried 4-0.

Motion by Batcheller second by Monson to receive the Eagles Club budget. Carried 4-0.

Motion by Batcheller second by Walish to receive the WCICC Information-General Basic budget. Carried 4-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until January 24, 2006.
