OCTOBER 4, 2005 THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 4, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Suzanne Coburn-Van Veen, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Batcheller second by Clausen to approve the Board minutes of September 27, 2005 as submitted. Carried 5-0. Copy filed.
The Board approved the separation of Fern J. Marrinan, Motor Vehicle Clerk II, County Treasurer Dept., effective 09/26/2005. Retirement. Copy filed.
The Board approved the promotion of Dennis J. Wilson, Jail Sergeant, County Sheriff Dept., $20.54/hour, effective 10/05/2005. Promotion from Correctional Officer to Jail Sergeant, effective 10/05/2005. Copy filed.
The Board approved the transfer of Linda G. Shelton, Motor Vehicle Clerk II, County Treasurer Dept., $14.57/hour, effective 10/10/2005. Transfer from Percentage Deputy to Motor Vehicle Clerk II per in-house posting 09/20/2005. Copy filed.
The Board approved the transfer of Diana L. Christensen, 2nd Deputy, Motor Vehicle Dept., County Treasurer Dept., $40,000/year effective 10/10/2005. Elected Official appointment. Copy filed.
Motion by Clausen second by Walish to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for the following positions:
(1) Motor Vehicle Clerk II, County Treasurer Dept., entry level: AFSCME Courthouse Grade 4, $11.36/hour/.
(2) In-house Jail Sergeant (new position), County Sheriff Dept., entry level: DSA in-house posting
$20.54/hour.
(3) Senior Tax Clerk II, County Treasurer Dept., entry level: AFSCME Courthouse Grade 4, $11.36/hour.

Motion by Batcheller second by Monson to approve retiring employee, Fern J. Marrinan, remain on County health and dental insurance plans at her own expense. Carried 5-0. Copy filed.
Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Resolution for the abatement of taxes for the City of Moville. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES
WHEREAS, the City of Moville, Iowa are the titleholders of real estate Parcels #894429479005, #894429479006, #894429479007, #894429479008, #894429479009, #894429479017 located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcel is owned by a political subdivision of the state; and
WHEREAS, the political subdivision, namely the City of Moville, Iowa, is failing to immediately pay the taxes due; and
WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Discussion was held to determine the funding source for payment of architect expenses for the expansion of the fourth floor, Trosper-Hoyt, and for alterations to the Law Enforcement Center.
Motion by Monson second by Clausen to use Riverboat Funds as the funding source for payment of architect expenses for the expansion of the fourth floor, Trosper-Hoyt, and for alterations to the Law Enforcement Center. Carried 5-0.
The Board discussed final plats for Bollmeyer First Addition Subdivision (parcel #883515) with John Pylelo, County Zoning Administrator.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign final plats for Bollmeyer First Addition Subdivision for Parcel #883515. Carried 5-0.

RESOLUTION NO. #9970
RESOLUTION ACCEPTING AND APPROVING BOLLMEYER FIRST ADDITION TO WOODBURY COUNTY, IOWA
WHEREAS, the owner and proprietor did on the 15th day of September, 2005, file with the Woodbury County Zoning Commission a certain plat designated as Bollmeyer First Addition to Woodbury County, Iowa; and
WHEREAS, it appears that said plat conforms with all of the provisions of the Code of the State of Iowa and ordinances of Woodbury County, Iowa, with reference to the filing of same; and
WHEREAS, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; and
WHEREAS, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.
NOW therefore, be, and it is hereby resolved by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, that the plat of Bollmeyer First Addition to Woodbury County, Iowa be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, are hereby directed to furnish to the owner and proprietor a certified copy of this resolution as required by law.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Mid American Energy, to rebuild overhead electric distribution line on the south side of D22 from 3935 Hwy D22 to Minnesota Avenue, per recommendation of the County Engineer. Motion by Clausen second by Walish to approve and authorize the Chairman to sign an application to adopt-a-highway, submitted by River City Anglers, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Walish second by Monson to approve and authorize the Chairman to sign amendments to Hungry
Canyon Projects #04-13 and #04-9-F, specifying that all work under these agreements will be completed by September 30, 2006, per recommendation of the County Engineer: Carried 5-0. Copy filed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
