SEPTEMBER 20, 2005 THIRTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 20, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Suzanne Coburn-Van Veen, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

Meeting called to order.
Motion by Walish second by Batcheller to approve the Board minutes of September 13, 2005 as submitted. Carried 5-0. Copy filed.
Motion by Clausen second by Monson to approve the Board minutes of September 16, 2005 as submitted. Carried 3-0, Batcheller and Walish abstained. Copy filed.
The Board approved the separation of Martha K. Lafferty, Motor Vehicle Clerk II, County Treasurer Dept., effective 09/23/2005. Resignation. Copy filed.
The Board approved the reclassification of Amy L. Ellis, Assistant County Attorney, County Attorney Dept., $48,425/year, effective 10/02/2005. Per AFSCME Attorney contract agreement, from Step 3 to Step 4. Copy filed.
The Board approved the reclassification of Lisa M. Welte, Part-time Youth Worker, Juvenile Detention Dept., $14.13/hour, effective 10/03/2005. Per AFSCME J. D. contract agreement, from Grade 1, Step 2, to Grade 1, Step 3. Copy filed.
The Board approved the reclassification of Zachary L. Lewis, Part-time Youth Worker, Juvenile Detention Dept., $14.13/hour, effective 10/03/2005. Per AFSCME J. D. contract agreement, from Grade 1, Step 2, to Grade 1, Step 3. Copy filed.
Motion by Monson second by Walish to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for one Motor Vehicle Clerk II, County Treasurer Dept., entry level: AFSCME courthouse grade 4, $11.36/hour. Carried 5-0. Copy filed.
The Board discussed flu and tetanus vaccinations for County employees, with J. D. Pellersels, Human Resources Director.
Motion by Monson second by Batcheller to approve and authorize flu and tetanus vaccinations to those employees who want them. Carried 5-0.
Julie Stoik and Dana Neal from Western Iowa Tech Community College requested resolutions supporting the development of a trail system.
Motion by Walish second by Batcheller to approve and authorize the Chairman to sign a resolution authorizing sponsorship of the submittal of a grant application to the Department of Transportation for Statewide Transportation Enhancement Grant Funds (TEA-21) to construct a trail building link at Loess Hills Arboretum and Nature Center on the campus of Western Iowa Tech Community College. Carried 5-0.

Recommendation: The Woodbury County Board of Supervisors is requested to pass a Resolution of Sponsorship and authorize the Chairperson to sign a letter of support for the filing of a grant applications to the Iowa Department of Transportation for the Statewide Transportation Enhancement Funds to be utilized for the construction of the asphalt trail (Phase 2A) by the Loess Hills Arboretum and Nature Center on the campus of Western Iowa Tech Community College.
Discussion: As part of the requirements by the IDOT for utilization of these Iowa Federal Recreational Trails Funds, a city, county or state agency must be the applicant. Other organizations are eligible to apply only as a co-sponsor.
Western Iowa Tech Community College has requested Woodbury County host the submission of this grant applications to the Iowa Department of Transportation (IDOT) for utilization of Iowa Federal Funds to construct approximately three miles of asphalt trail on the Sioux City campus as part of the development of the Loess Hills Arboretum and Nature Center project and the Sioux City Metropolitan Area Transportation Improvement Plan.
No funding or staff time is requested from the County for this project submittal. Staff time will need to be committed to administer this project if grant monies are received. County staff will be designated for this project when funded.
Financial Impact: There will be no County funds invested in this project. Staff time will be needed as a commitment if an award is received.

The Public Hearing and Sale of Property for parcel #116340 (aka 1117 Pacific Street) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.
Motion by Walish second by Monson to close the hearing as there was no one present wishing to be heard.
Carried 5-0.
Chairman called for bids on real estate parcel #116340. Ron Seibold bid $238.00, plus recording fees. There were no further bids.
Motion by Batcheller second by Monson to accept Ron Seibolds bid of $238.00 plus recording fees for real estate parcel #116340. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By Ronald Seibold, Sr. and Joyce Seibold in the sum of Two Hundred Thirty-eight ($238.00) dollars
For the following described real estate, To Wit:
Parcel #116340
Out Lot 29 Except the North 98 Feet Thereof in Coles Addition, City of Sioux City,
Woodbury County, Iowa (aka 1117 Pacific St.)
Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board discussed applicants and appointment to fill an opening on the Woodbury County Board of Adjustment, to replace Alan Vandehaar, whos term would have expired on December 31, 2008.
Motion by Clausen second by Walish to appoint Russell E. Walker, 638 South Street, Moville, Iowa, to the Woodbury County Board of Adjustment. Carried 5-0. Copy filed.
The Board discussed funding of Planning/Zoning vehicle purchases.
Motion by Clausen second by Monson to fund the purchase of a Planning/Zoning vehicle from Riverboat funds. Carried 5-0. Copy filed.
Motion by Batcheller second by Clausen to receive and approve plans for project #BROS-CO97(71)8J-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Clausen second by Walish to receive and approve plans for project #BROS-CO97(72)8J-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Walish second by Batcheller to receive and approve plans for project #FM-CO97(55)55-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Clausen second by Monson to receive the quotes for maintenance slurry leveling of selected routes and accept the quote of Fort Dodge Asphalt in the amount of $33,800.00, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Certificate of Completion for the 2005 Maintenance Gravel contract. Carried 5-0. Copy filed.
Motion by Batcheller to award the bid to Audino Construction that was submitted for the Moville maintenance facility modifications. Motion died for lack of a second.
Motion by Clausen second by Monson to approve the recommendation of Woodbury County Engineer Richard Storm and reject all bids that were submitted for the Moville maintenance facility modifications, to re-evaluate the project this winter, and re-bid next spring. Carried 4-1, Batcheller voted no.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Don Claeys, 2012 Greenbrier Path requested the vacation of a county road be placed on the agenda next week.
The Board adjourned the regular meeting until September 27, 2005.
