AUGUST 23, 2005 THIRTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 23, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Denise Fletcher, Executive Secretary, and Diane Swoboda Peterson, Deputy/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Batcheller to approve the Board minutes of August 16, 2005 as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Joel A. Bertrand, Correctional Officer, County Sheriff Dept., $14.18/hour, effective 08/24/2005. Job vacancy posted 07/13/2005. Entry level salary: $14.18/hour. Copy filed.

The Board approve the separation of Timothy M. Byers, Temporary Summer Laborer, effective 08/12/2005. End of temporary work. Copy filed.

The Board approved the reclassification of Jayme A. Kirsch, Assistant County Attorney, County Attorney Dept., $52,863/year effective 09/02/2005. Per AFSCME Assistant County Attorney Contract, from Step 5 to Step 6. Copy filed.

The Board approved the reclassification of Kimberly K. McKern, Clerk II, Motor Vehicle Dept., $14.57/hour effective 09/13/2005. Per AFSCME Courthouse Contract, from Grade 4 Steep 4, to Grade 4 Step 5. Copy filed.

The Board approved an employment start-date correction for Suzanne Coburn-VanVeen, Assistant County Attorney/Civil Division, County Attorney Dept., $41,873/year effective 08/22/2005. Copy filed.

The Board approved the separation of Chad M. Einerwold, full-time Youth Worker, Juvenile Detention Dept., effective 08/17/2005. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for one full-time, male, Youth Worker, Juvenile Detention Dept. Entry level: AFSCME JD: current salary. Carried 5-0. Copy filed.

Motion by Clausen second by Walish to approve and authorize the Chairman to sign a Resolution for a tax suspension through the redemption process for Arthur Dan Detches. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS

WHEREAS, Arthur Dan Detches as joint titleholder of real estate located at 818 Jackson Street., Sioux City, Woodbury County, Iowa, and legally described as follows:

Known As Perkins Apt S Units 7 & 7-A Sioux City East Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Arthur Dan Detches, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel #894728181007 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

WHEREAS Woodbury County, Iowa was the owner under a warranty deed of a certain parcel of real estate described as:

Out Lot 29 Except the North 98 Feet Thereof in Coles Addition, City of Sioux City , Woodbury County, Iowa (aka 1117 Pacific St.)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 6th Day of September 2005 at 10:15 o'clock a.m. in the meeting room the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the
6th Day of September 2005, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $223.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the proposal, hearing and sale.

Motion by Walish second by Monson to approve adoption and authorize the Chairman to sign a Resolution designating Siouxland Mental Health as Woodbury County provider of targeted case management services under the Childrens Mental Health Waiver. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION #9953
Designation Regarding Targeted Case Management

WHEREAS, Woodbury County currently provides directly or contracts for the provision of Targeted Case Management (TCM) services for certain populations of county residents; and

WHEREAS, the State Medial Plan requires that every county adopt a resolution designating the TCM provider for county residents who are on the Childrens Mental Health Waiver; and

WHEREAS, in order to have TCM services provided to county residents in a timely fashion, it is crucial that each county make this designation as soon as possible; and

WHEREAS, the Board of Supervisors has fully considered all of the options available,including designating the countys existing TCM provider, designating another county and designating the Iowa Department of Human Services;

NOW THEREFORE BE IT RESOLVED that the Board of Supervisors hereby designates Siouxland Mental Health as its TCM provider for county residents who are on the Childrens Mental Health Waiver.

Motion by Monson second by Walish to approve and authorize the Chairman to sign a Memorandum of Understanding with Western Iowa Tech for Project Serve. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve the adoption and authorize the Chairman to sign a letter to the Board of Regents, State of Iowa, an invitation to seat a Regents governed university in Woodbury County. Carried 5-0. Copy filed.

The Courthouse Security Committee reviewed Courthouse security with the Board.

Motion by Monson second by Batcheller to create, upon rescission of court order dealing with Courthouse security filed on August 9, 2005, a Board line item of $100,000.00 for security purposes and to continue to discuss and consider Courthouse security issues. Carried 5-0.

Motion by Walish second by Monson to fund Courthouse security expenses from the Riverboat Fund. Carried 5-0.

Bid letting was held for propane for the 2005-2006 season.

Bids were as follows:

Sapp Bros. Petroleum, Inc. Bid received too late

There were no more bids.

Motion by Walish second by Monson to receive the bids and accept the recommendation of County Engineer Richard Storm to approve the bid of Johnson Propane and Heating., for $1.199 per gallon. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a Certificate of Completion for project #LC-05(2)73-97.
Carried 5-0. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign two Utility Accommodation Permits, submitted by Northwest Iowa Telephone Company for (1) Section 14 and 23 Liberty Township, Route D-51 and (2) Section 14 Liberty Township, Route K-35. Carried 5-0. Copy filed.

County Treasurer Bob Knowler gave a demonstration of the security camera at the Motor Vehicle building and in the Treasurers Office.

The Board discussed consideration of abatement of taxes on the Badgerow Building with Attorney Dan Moore and Larry Rietz of Badgerow Building LLC.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a Resolution approving the abatement of taxes for the Badgerow Building. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION #9954

WHEREAS, pursuant to section 445.16, Code of Iowa, County Treasurer Bob Knowler recommended in writing to the Board of Supervisors to abate the taxes, special assessments, interest, fees and costs now due on the property known as the Badgerow Building located at 622 Fourth Street, Sioux City, Woodbury County, Iowa, in the sum of $50,892.00;

IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that said taxes, special assessments, interest, fees and costs now due on the property known as the Badgerow Building located at 622 Fourth Street, Sioux City, Woodbury County, Iowa are hereby abated, and the treasurer is hereby directed to strike the amount due from the county system as that term is defined in section 445.1(3), Code of Iowa.

Don Claeys, Gander Landing and property owners Collin Chad Gill discussed matters at the Gander Landing/Port Neal Road Superfund Site with the Board.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until August 30, 2005.
