AUGUST 9, 2005 THIRTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 9, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, and Patrick F. Gill, Auditor/Clerk to the Board.

The Board canvassed the August 2, 2005 County Sales Tax Special Election at 9:00 a.m. with results as follows:

Victoria Ritz, Deputy Commissioner of Elections announced that there were seven (7) provisional ballots of which one (1) was accepted and added to the Tally. There were also five (5) after-election absentee ballots that were postmarked by August 1, or were hand delivered on election day, which were also added to the Tally.

Upon the public measure:

A previously imposed local sales and services tax for school infrastructure projects shall be extended in the County of Woodbury at the rate of one percent. The tax will be extended until September 30, 2018. The money received from the tax shall be spent for school infrastructure, including purchasing, building, furnishing, reconstructing, repairing, demolishing, improving, expanding, or remodeling of a schoolhouse or schoolhouses and additions thereto, gymnasium, athletic facilities, field house, or school bus garage, purchasing and improving grounds, opening roads to schoolhouses or buildings, the purchase, lease or lease-purchase of buildings or equipment (including transportation and recreation equipment) as authorized by law, procuring or acquiring libraries, expenditures for energy conservation measures, the rental of facilities under Chapter 28E, for public educational and recreational activities, the payment or retirement of bonds issued for school infrastructure purposes or the payment or retirement of bonds issued under Iowa Code Section 423E.5, for debt reduction or property tax relief, or for any one or more of such purposes now or hereafter authorized by law.

There were Seven-thousand, two-hundred and eight (7,208) ballots cast as follows:

For the question, there were Five-thousand, four-hundred and thirty-one (5,431) votes cast.

Against the question there were One-thousand, seven-hundred and seventy-three (1,773)
votes cast.

We therefore declare the public measure to be adopted.

The Board approved the separation of Jacob S. Byers, Temporary Summer Laborer, Secondary Roads Dept., effective 07/29/2005. End of temporary work. Copy filed.

The Board approved the separation of Cole J. Dixon, Temporary Summer Laborer, Secondary Roads Dept., effective 08/12/2005. End of temporary work. Copy filed.

The Board approved the separation of Andrew R. Bremer, Temporary Summer Laborer, Secondary Roads Dept., effective 08/12/2005. End of temporary work. Copy filed.

The Board approved the appointment of Marti S. Sleister, Assistant County Attorney, County Attorney Dept., $43,986/year, effective 08/15/2005. Job vacancy posted 06/08/2005. FY 05/06 salary range $41,873-$48,425/year. Copy filed.

Motion by Clausen second by Batcheller to set the Public Hearing and Sale of Real Estate Parcel #057465 on August 30, 2005 at 10:15 a.m.

NOTICE OF PROPERTY SALE

Parcel #057465

WHEREAS Woodbury County, Iowa was the owner under a warranty deed of a certain parcel of real estate described as:

West Hundred Feet (W 100 ft) Lot Nine (9) Block Thirty-two (32) North Sioux City Addition, City of Sioux City, Woodbury County, Iowa (aka 1508 Center Street)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 30th Day of August 2005 at 10:15 o'clock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 30th Day of August 2005, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 309.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Batcheller second by Monson to receive the appointment of Deb Huser, 2012 Roundtable Road, Sergeant Bluff, IA, as a City Council Member for the City of Sergeant Bluff, to fill a vacancy previously held by Terry Thompson, until the next City Election in 2005. Carried 5-0. Copy filed.


Motion by Walish second by Clausen to receive the County Recorders report of fees collected for the period of 04/01/2005 through 06/30/2005.

Motion by Monson second by Clausen to receive the County Sheriffs Civil Division 4th quarter and year-to-date report. Carried 5-0. Copy filed.

Motion by Walish second by Clausen to accept the Justice Assistance Program (JAG) award and authorize the Chairman to sign the grant award. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to postpone for one week action approve and authorize the Chairman to sign a memorandum of understanding between Woodbury County Social Services and Western Iowa Tech Community College for funding Project Serve for one year beginning September 1, 2005 and ending August 31, 2006, with future funding consideration dependent upon availability and performance review. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve the Countys portion of the alarm monitoring system funding, from the infrastructure fund, for the Communications Center, per recommendation of Glenn Sedivy. Carried 5-0.

The Board discussed preliminary plat of Bollmeyer First Addition Subdivision, Parcel #883515, submitted by Dennis and Judy Bollmeyer.

Motion by Clausen second by Batcheller to approve preliminary plats for Bollmeyer First Addition Subdivision, parcel #883515, and refer to the Zoning Commission for review and recommendation.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a contract and contractors bond for project #LB-01(2)73-97 bridge replacement. The contract is with Elk Horn Construction Company, Sergeant Bluff, IA.

Board Member Bob Batcheller presented the Board with an analysis prepared by Jim Duffy, regarding work on the Courthouse basement walls.

Motion by Batcheller second by Walish to approve contacting Larry Ericsson to look at the Courthouse basement walls. Carried 5-0.

The Board discussed a court order, to provide security, with County Sheriff Glenn Parrett.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until August 16, 2005.
