JULY 19, 2005 TWENTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 19, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin and Monson; Clausen and Walish were absent. Staff members present were Karen James, Board Administrative Coordinator, and Patrick F. Gill, Woodbury County Auditor/Clerk to the Board.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Batcheller second by Monson to approve the Board minutes of July 12, 2005 as submitted. Carried 3-0. Copy filed.
The Board approved the appointment of Lisa M. Hudson, Claims Clerk II, County Auditor/Recorder Dept., $11.20/hour effective 07/20/2005. Job vacancy posted: 05/10/2005. Entry level salary: FY 05/06 $11.20/hour. Copy filed.
The Board approved the appointment of Thomas R. Jorgensen, Part-time Youth Worker, Juvenile Detention Dept., $13.14/hour effective 07/20/2005. Job vacancy posted: 05/24/2005. FY 05 entry salary: $13.14/hour. Copy filed.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a Resolution setting public hearing and sale of excess real estate property in Woodbury County. Carried 3-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a warranty deed of a certain parcel of real estate described as:
West Thirty-Seven and One-half (W 37 ) Feet of Lots Five (5) and Six (6) in Block Seventy-Eight (78) of the Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 2nd Day of August 2005 at 10:15 o'clock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 2nd Day of August 2005, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $ 628.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 2nd Day of August 2005, immediately following the closing of the public hearing.

Motion by Batcheller second by Monson to receive the Semi-Annual Report of Funds in the Hands of the Woodbury County Treasurer at Close of Business. Carried 3-0. Copy filed.
Motion by Monson second by Batcheller to receive County Sheriffs Report of Unadjudicated Condemnation Funds. Carried 3-0. Copy filed.
The Board discussed preliminary plats for Harrison Replat parcel #869700.
Motion by Batcheller second by Monson to refer preliminary plats for Harrison Replat parcel #869700 to the Zoning Commission for recommendations. Carried 3-0.
Motion by Batcheller second by Monson to receive and approve the recommendation of County Engineer Richard Storm and award the bid for project LB-01(2)73-97, bridge replacement-rail car on 100th Street, to Elk Horn Construction in the amount of $103,303.50. Carried 3-0. Copy filed.
Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a utility accommodation permit submitted by Frontier Communications, Fort Dodge, IA, to install underground cable along a section of 120th Street, per recommendation of the County Engineer. Carried 3-0. Copy filed.
Motion by Batcheller second by Monson to approve and authorize the Chairman to sign an agreement for professional services with HGM Associates, Inc. for project BRS-7092(601)60-97 (bridge replacement project in Smithland). Carried 3-0. Copy filed.
The Board reviewed with County Engineer Richard Storm information and correspondence received from Dr. Tim Luse and Charles Corbett, in regard to DeRocher Path Assessment District establishment.
Sheila Luse asked to present a letter to the Board on behalf of her husband Tim Luse of 4540 DeRocher Path.
The Secretary to the Board reminded the Board Chair that this was not a public hearing and the public hearing on this issue was continued to a later date.
The Board Chair acknowledged that it was not a public hearing and stated that he could receive information if he desired to do so.
Sheila Luse presented an updated letter to the Board on behalf of Tim Luse. Chuck Corbett spoke on behalf of the Richard K. and Connie L. DeRocher, of 4900 DeRocher Path.
Motion by Batcheller second by Monson to receive a letter by Tim Luse from Sheila Luse in regard to the proposed DeRocher Path Assessment District. Carried 3-0.
The Mayors Youth Commission Legislative Committee gave a presentation to the Board on beer keg registration. Faculty advisor Carolyn Goodwin and student members Alex Solsma, Stephanie Mobley and Emily Nelson addressed the Board.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until July 26, 2005.
