MARCH 15, 2005 ELEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 15, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, and Monson; Clausen and Walish were absent. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
The Board canvassed the March 8th, 2005 Western Iowa Tech Community College Area XII Special Election at 9:15 a.m. with the following official results:
Diane Swoboda Peterson, Deputy Recorder, announced there was one (1) provisional ballot that was accepted and added to the Tally and six (6) after-election absentee ballots that were received timely and added to the Tally.
For the Question: Shall the Board of Directors of Merged Area XII Community College District (Western Iowa Tech Community College), in the counties of Buena Vista, Carroll, Cherokee, Crawford, Harrison, Ida, Monona, Plymouth, Sac, Shelby, Sioux and Woodbury, State of Iowa, be authorized to levy a tax not exceeding six cents per thousand dollars of assessed value in any one year for a period of ten consecutive years, commencing with the levy for fiscal year 2006, payable beginning July 1, 2005, for purposes of program sharing between community colleges or for the purchase of instructional equipment?, there were four-thousand, five hundred, ninety-three (4,593) ballots cast as follows:
For the question there were Two-thousand, four-hundred and thirty-one (2,431) votes cast.
Against the question there were Two-thousand, one-hundred and thirty-seven (2,137) votes cast.
Total Voters: 4,593
We therefore declare the public measure to be adopted.
Motion by Batcheller second by Monson to accept the official canvass of the Western Iowa Tech Community College Area XII Special Election held on March 8, 2005. Carried 3-0. Copy filed.

Motion by Batcheller second by Monson to approve the Board minutes of March 8, 2005 as submitted. Carried 3-0. Copy filed.
No motion taken to approve the Board minutes of the executive session held on March 8, 2005.
The Board introduced Robert B. Marqusee as Woodbury Countys Rural Economic Development Director.
The Board approved the appointment of Robert B. Marqusee, Rural Economic Development Director., $50,000/year effective 03/21/2005. Job vacancy posted 11-05-04 and 12-15-04. Entry level salary: $50,000/year. Copy filed.
Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a resolution approving petition for tax suspension for L. G. D. and S. J. D. Carried 3-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES
WHEREAS, Leroy and Shirley DeMey, are titleholders of real estate located at 2804 1st Street, Sioux City, Woodbury County, Iowa, and legally described as follows:
Parcel #334485
Except South Forty-two Feet (42) Lot Nine (9) Block One (1) Ludwigs Addition,
City of Sioux City, Woodbury County, Iowa
WHEREAS, Leroy and Shirley DeMey as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.
SO RESOLVED this 15th day of March, 2005.

Motion by Batcheller second by Monson to receive the appointment of George Allan, 334 N. Second Street, Moville, IA, as a City Council Member for the City of Moville, to fill a vacancy previously held by James Fisher, until the next City Election in 2005. Carried 3-0.
Dr. Maxwell and Brian Creighton gave a presentation on the Moville Community Center Project. A discussion was held concerning funding for the project.
The Board discussed Woodbury Countys telecommunications service provider with John Malloy, Director Information Technology WCICC. Mr. Malloy stated the telecommunications advisory group recommends converting Woodbury Countys telecommunication local and long distance service to FiberComm of Sioux City.
Motion by Batcheller second by Monson to approve converting Woodbury Countys telecommunications local and long distance services provider to FiberComm of Sioux City. Carried 3-0.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until March 22, 2005.
