FEBRUARY 15, 2005 SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 15, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of February 8, 2005 as submitted. Carried 5-0.

The Board approved the separation of David E. Kjos, Deputy Sheriff, County Sheriff Dept., effective 02-11-05. Separation. Copy filed.

Motion by Monson second by Walish to receive the appointment of Don Wood, 305 1st Street, Sergeant Bluff, IA, as a City Council Member for the City of Sergeant Bluff to fill a vacancy previously held by Cathy Bishop until the next City Election in 2005. Carried 5-0.

Motion by Clausen second by Walish to approve and authorize the Chairman to sign a Resolution approving petition for suspension of taxes for L. L. Y. Carried 5-0.

RESOLUTION # 9904

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES


WHEREAS, Linda L. Young, is titleholder of real estate located at #12 16th Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 105315

Except South 18 in East 1/3 Lot Eleven (11) Block Nine (9) East 1/3 Lot Twelve (12) Block Nine (9) Clarks Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Linda L. Young as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SO RESOLVED this 15th day of February, 2005.

Bid opening was held for the radio tower building for the StarComm Project.

Bids were as follows:

There were no further bids.

Motion by Walish second by Batcheller to award the bid to Summit Construction, subject to the review of the StarComm committee. Carried 5-0. Copy filed.

The Board held discussion with John Pylelo, Planning/Zoning, consideration of contracting with Mr. Riley Simpson to provide services for the development of a comprehensive development plan and development regulations for Woodbury County.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a Contract for Services with Riley Simpson/dba Flat Earth Planning and to provide access to the Countys mapping system. Carried 5-0. Copy filed.

The Board discussed with Dennis Butler, Tax Analyst, proposed tax rates, tax askings, and the effects on different classes of property.

Motion by Clausen second by Batcheller to set the public hearing date for the 2006 fiscal year budget as March 8, 2005 at 10:30 a.m.. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board discussed the paving of 220th St. and Derocher Path with Dick Storm, County Engineer.

The Board adjourned the regular meeting until February 22, 2005.
