FEBRUARY 8, 2005 SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, February 8, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion Walish by second by Monson to approve the Board minutes of February 1, 2005 as submitted. Carried 5-0.
Motion Batcheller by second by Clausen to approve the Board minutes of the executive session held on February 1, 2005 as submitted. Carried 5-0.
The Board approved the appointment of Susan P. OMeara, Election Clerk II, County Auditor/Recorder Dept., $10.91/hour effective 02-02-05. Job vacancy posted: 01-05-05. Entry Level Salary: $10.91/hour. Copy filed.
The Board approved the appointment of Linda A. Prosser, Temporary Records Clerk, County Auditor/Recorder Dept., $10.91/hour, effective 02-04-05. Not to exceed 120 days. Copy filed.
The Board approved the appointment of Michael T. McDonald, Custodian, Building Services Dept., $9.89/hour, effective 02-17-05. Job vacancy posted: 07-23-04. Entry Level Salary: $9.89/hour. Copy filed.
The Board approved the reclassification of Richard L. Nash, Correctional Officer, County Sheriff Dept., $16.80/hour effective 02-28-05. Per DSA Contract agreement, 4 years experience plus B.S. Degree: from Class 3 to Sr. Class. Copy filed.
The Board approved the separation of James L. Pickering, Custodian, Building Services Dept., effective 04-01-05. Retirement. Copy filed.
Motion by Walish second by Clausen to approve and authorize the Chairman to sign Authorization to Initiate Hiring Process for a Custodian, Building Services Dept. AFSCME Cthouse: Grade 1, Step 1, $9.89/hour and a Temporary Records Clerk, County Auditor/Recorder Dept. AFSCME Cthouse comparability $10.91/hour. Carried 5-0. Copy filed.
The Board discussed with J. D. Pellersels, Human Resources Director, County Personnel Policies.
Motion by Monson second by Clausen to approve the policies as submitted to the Board with an amendment to the employee records policy as submitted effective the end of the week. Carried 5-0.
The Public Hearing and Sale of Property Parcel #244350 (508 15th Street) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.
Motion by Clausen second by Batcheller to close the hearing as there was no one present wishing to be heard on said sale. Carried 5-0.
Chairman called for bids on Real Estate Parcel #244350. David Davenport bid $339.00 plus recording fees. There were no further bids.
Motion by Batcheller second by Walish to accept David Davenports bid of $339.00 plus recording fees for Real Estate Parcel #244350. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction by Davenport Commercial Enterprises, L.C._ in the sum of Three Hundred Thirty Nine and No/100 dollars ($339.00) for the following described real estate, To Wit::

HIGMANS ADDITION
EAST 41.2 FEET NORTH 58 FEET LOT ONE (1) BLOCK TWO (2)
City of Sioux City, Woodbury County, Iowa

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Walish second by Batcheller to approve and authorize the Chairman to sign Contract Addendum with North West Environmental Services, Inc., Alton, Iowa, for environmental services at Davidson Oil Co. site, Moville, Iowa, per recommendation of the county engineer. Carried 5-0. Copy filed.
Motion by Batcheller second by Monson to receive quote to purchase a Load King Gravel Trailer for $29,920.00 from RMS Co., Sioux City, per recommendation of the county engineer. Carried 5-0. Copy filed.
The Board held discussion of General Relief funding, with Jean Logan.
Dennis Butler discussed FY 2006 Budget with the Board as follows:
There chair asked to address the Wage Plan Salary costs item in two weeks.
Motion by Batcheller second by Monson to increase the Health Insurance Premiums cost by 6%. Carried 5-0.
Motion by Clausen second by Monson to rescind the action to transfer the costs of two existing deputies from the general basic fund to the rural basic fund. Carried 4-1, Batcheller opposed.
Motion by Monson second by Walish to take $155,000.00 from reserves. Carried 5-0.
The Board discussed action for the Law Enforcement Terrorism Prevention Program (LETPP) with Patty Erickson-Puttmann, Social Services Coordinator.
Motion by Clausen second by Walish to approve the LETPP recommendation of the social services coordinator. Carried 5-0. Copy filed.
Motion by Clausen second by Monson to go into executive session under section 21.5(1) (c) of the Iowa Code. Carried 5-0 on a roll call vote.
Motion by Clausen second by Batcheller to go out of executive session under section 21.5(1)(c) of the Iowa Code. Carried 5-0 on a roll call vote.
Motion by Monson second by Walish to approve the recommendation of the attorney in the previous executive session. Carried 5-0.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Janeese Martin of the Tax Research Conference asked the Board to consider a comparability study for wage plan employees.
There was a discussion of the open meetings law.
The Board adjourned the regular meeting until February 15, 2005.
