JANUARY 18, 2005 -THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, January 18, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Motion by Walish second by Batcheller to go into executive session under section 20.17(3) of the Iowa Code. Carried 5-0 on a roll call vote.
Motion by Monson second by Batcheller to go out of executive session under section 20.17(3) of the Iowa Code. Carried 5-0 on a roll call vote.
Meeting called to order.
The Board canvassed the Drainage Ditch Elections held on January 15, 2005.
Victoria L. Ritz, Deputy Commissioner of Elections, presented the canvass of the Drainage Ditch Elections held on January 15, 2005. There were no absentee or after-election ballots to be counted.
For the office of Trustee, Sub District #3 for the Farmers Drainage District, there were four-thousand, three-hundred and fifty-six (4,356) ballots cast as follows:
Fred Johnson received 4,356 votes
Write-Ins received 0 votes
Fred Johnson was duly elected to the office of Trustee, Farmers Drainage Ditch Sub District #3 for the term of three (3) years.
For the office of Trustee, Sub District #3 for the Garretson Drainage District, there were one-thousand, five-hundred, thirty-eight (1,538) ballots cast as follows:
Wilbur Ray (Write-In) received 1,538 votes
Wilbur Ray was duly elected to the office of Trustee, Garretson Drainage Ditch Sub District #3 for the term of three (3) years.
Motion by Batcheller second by Walish to receive the Farmers and Garretson Drainage Ditch election canvasses. Carried 5-0.
The Board approved the separation of Lori A. Limoges, P/T Youth Worker, Juvenile Detention Dept., effective 02-03-05. Resignation. Copy filed.
The Board approved the reclassification of Terry C. Ganzel, Assistant County Attorney, County Attorney Dept., $66,391/year, effective 02-08-05. Per AFSCME Asst. Attorney Contract agreement, from Step 11 to Step 12. Copy filed.
Motion by Walish second by Batcheller to approve and authorize the Chairman to sign Authorization to Initiate Hiring Process for a P/T Female Youth Worker, Juvenile Detention Dept., per AFSCME J. D. $12.79/hour. Carried 5-0. Copy filed.
Motion by Batcheller second by Walish to receive for signatures a resolution determining that applications for County Economic Development Director will be discouraged, if available for general public examination. Carried 5-0.
RESOLUTION NO. 9899
RESOLUTION DETERMINING THAT APPLICATIONS FOR COUNTY ECONOMIC DEVELOPMENT DIRECTOR WILL BE DISCOURAGED
IF AVAILABLE FOR GENERAL PUBLIC EXAMINATION
WHEREAS the Woodbury County Board of Supervisors (Board) has accepted applications for the position of County Economic Development Director; and
WHEREAS the Board has been advised and does believe that otherwise qualified applicants will not make application for the position of County Economic Development Director if their applications are made public because of possible repercussion with their present employer; and
WHEREAS the Board is advised and does believe that, pursuant to Iowa Code 22.7(18), the Board may find that otherwise qualified applicants would be discouraged from making applications if their applications were available for general public examination.
NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED by the Woodbury County, Iowa Board of Supervisors that it hereby determines that otherwise qualified applicants for the position of Economic Development Director for Woodbury County, Iowa, will be discouraged from making application for the position if their application is available for general public examination.
BE IT FURTHER RESOLVED that the applications for Woodbury County Economic Development Director be and the same are hereby ordered to remain confidential pursuant to the authority granted by Iowa Code 22.7(18) (2003).
SO RESOLVED this 18th day of January, 2005.

The Public Hearing and Sale of Property Parcel #179535 (619 Colon Street) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.
Motion by Batcheller second by Walish to close the hearing as there was no one present wishing to be heard on said sale. Carried 5-0
Chairman called for bids on Real Estate Parcel #179535. Omar Maldonado bid $250.00 plus recording fees. There were no further bids.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction
By Omar Maldonado____ in the sum of Two Hundred Fifty and No/100 ($250.00) dollars
For the following described real estate, To Wit:
Parcel #179535
Garden View Addition, Lot Forty-Eight (48), City of Sioux City, Woodbury
County (619 Colon Street, Sioux City, Iowa)
Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: Said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board discussed with Richard Storm, County Engineer, appointment of a contact person to work with the City-County Trails Agreement.
Motion by Batcheller second by Monson to approve a request from the City of Correctionville to close a portion of highway 31 and L-36 for their Sesquicentennial parade on June 18, 2005 from 10:00 a.m. until 2:00 p.m. Carried 5-0.

Motion by Batcheller second by Walish to receive the Recorders Administration Budget as submitted. Carried 5-0.
Motion by Monson second by Clausen to receive the Auditors Administration Budget as submitted. Carried 5-0.
Motion by Batcheller second by Walish to receive the Elections Administration Budget reduced by $2,000.00. Carried 5-0.
Motion by Clausen second by Batcheller to receive the General Primary Budget as submitted. Carried 5-0.
Motion by Walish second by Monson to receive the School Election Budget as submitted. Carried 5-0.
Motion by Walish second by Clausen to receive the remaining election Budgets as submitted. Carried 5-0.

Motion by Clausen second by Batcheller to eliminate Board Administration line item 6360 office equipment, for $14,000. Carried 5-0.
