DECEMBER 7, 2004 TWENTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, December 7, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Clausen second by Boykin to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 5-0 on a roll call vote.

Motion by Boykin second by Batcheller to go out of Executive Session. Carried 5-0 on a roll call vote.

Motion by Walish second by Boykin to approve filing a motion to stay and work with Auditor for
cash bond. Carried 5-0.

Motion by Walish second by Batcheller to approve the Board minutes of November 30, 2004 as submitted. Carried 5-0.

Motion by Clausen second by Batcheller to amend the Board Minutes of 10-26-04 by striking the paragraph which approved the promotion of Michael A. Gray to District Foreman; by correcting Ami Miells effective date approved by the Board to 10-27-04 and to amend the Board Minutes of 11-23-04 by striking the paragraph regarding the appointment of Martha K. Lafferty and substituting the following:

The Board approved the appointment of Martha K. Lafferty, Motor Vehicle Clerk II, County Treasurer Dept., @$11.06/hr., effective 11-24-04. Job Vacancy Posted: 9-28-04. Entry Level Salary: $11.06/hour. Carried 5-0. Copy filed.

The Board approved the separation of Eric J. Stolpe, Lead Custodian, Building Services Dept., effective 11-19-04. Resignation. Copy filed.

The Board approved the appointment of Kyle D. Gates, Temporary Engineering Aide, Secondary Roads Dept., @$9.50/hr., effective 12-20-04. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of David D. Bridenbaugh, Custodian, Building Services Dept., @$11.57/hr., effective 12-27-04. Per AFSCME Cthouse. Contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

The Board approved the reclassification of Angela J. Fundermann, Deputy Sheriff, County Sheriff Dept., @$21.25/hr., effective 12-30-04. Per DSA Contract agreement from Class 1 to Senior Class. Copy filed.

The Board approved the separation of Nikki D. Magnetti, Correctional Officer, County Sheriff Dept., effective 12-31-04. Retirement. Copy filed.

The Board approved the separation of David H. Amick, County Sheriff, County Sheriff Dept., effective 12-31-04. Retirement. Copy filed.

The Board approved Glenn J. Parrett, County Sheriff, County Sheriff Dept., @$73,727/yr., effective 1-01-05. Elected Official / 4 year term. Copy filed.

The Board approved G. Robert Batcheller, Board Member, Board Administration, @$27,693.00/yr., effective 1-01-05. Elected Official / 4 year term. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign the Authorization to Initiate Hiring Process for an Election Secretary/Clerk II, County Auditor/Recorder Dept., In-House Posting, AFSCME Cthouse./Grd. 4: $11.06/hour or per Contract language; and for a Correctional Officer, County Sheriff Dept., DSA $14.18/hour. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve the request of retiree, David H. Amick, to remain on the Countys health and dental insurance effective January 2005. Carried 5-0. Copy filed.

Bob Schmeckpeper from WIT discussed Woodbury County Employee Safety Training with the Board.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a resolution approving the sale of property, Parcel #284280, to correct the legal description. Carried 5-0.

NOTICE OF PROPERTY SALE

Parcel #284280

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Kendon Addition Lot 219
(1516 Rock Street, Sioux City, Woodbury County, Iowa)
(TO CORRECT LEGAL DESCRIPTION)

NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 21st Day of December 2004 at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 21ST Day of December 2004, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 500.00 plus recording
fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

The Board discussed, with John Pylelo from Planning and Zoning, the consideration of applicants and appointment to fill the expiring term of Terree Ritz on the Woodbury County Zoning Commission.

There was no action taken to fill the term of Terree Ritz which expires on December 31, 2004 on the Woodbury County Zoning Commission.

There was a discussion of applicants for the replacement of Corey Meister on the Woodbury County Board of Adjustment.

There was no action taken to fill the term of Corey Meister which expires on December 31, 2004 on the Woodbury County Board of Adjustment.

Patty Erickson-Puttmann from Social Services discussed with the Board the creation of a Homeland Security Department for Woodbury County.

The Board had a discussion with Maurey Topf, President of Mid America Transportation & Aviation Museum, concerning support from Woodbury County to apply for a Grant from Vision Iowa CAT.

Motion by Boykin second by Walish to approve the support for Mid America Transportation & Aviation Museum to apply for a grant from Vision Iowa CAT. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve a contribution of $5,000.00 to the Mid America Transportation & Aviation Museum from the Riverboat Fund, subject to a successful application to Vision Iowa. Carried 5-0.

The Board discussed with Cal Tyer, Manager of Woodbury County Fair Association, the consideration of funds for capital improvement projects.

There was a discussion of Eagles Building parking for judges.

The Board discussed Economic Development Director position.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until December 14, 2004.
