NOVEMBER 23, 2004 TWENTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, November 23, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

There was a tour of LEC Engine Room.

Meeting called to order.

The Board approved the separation of Lori A. Christians, Temporary Election Clerk, County Auditor/Recorder Dept., effective 11-09-04. End of Temporary Work. Copy filed.

The Board approved the appointment of Martha K. Lafferty, Motor Vehicle Clerk II, County Treasurer Dept., @$11.90/hour, effective 1-15-04. Job Vacancy Posted: 1-7-04. Entry Level Salary: $11.90/hour. Copy filed.

The Board approved the appointment of Marvin E. Flewelling, Temporary Equipment Operator, Secondary Roads Dept., @$15.22/hour, effective 11-29-04. Not to exceed 120 days. Copy filed.

The Board approved the reclassification of James D. Loomis, Assistant County Attorney, County Attorney Dept., @$42,830/year, effective 12-01-04. Per AFSCME Asst. County Attorney Contract agreement, from Step 1 to Step 2. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign Authorization to Initiate Hiring Process for a Criminal Analyst (Grant), Wage Plan: $51,000/year; two (2) Homeland Security Specialists (Grant) Wage Plan: $44,000/year; and an Information Technology Assistant (Grant), Wage Plan: $42,000/year, for Woodbury County Sheriff Dept. Human Resource Director J. D. Pellersels and the Board discussed floating Christmas holiday.

Motion by Walish second by Boykin to approve Wage Plan employees floating Christmas holiday to be on Thursday, December 23, 2004. Carried 5-0. Copy filed.

Gary Brown, Director of Disaster and Emergency Services, discussed with the Board EMS loan agreements with Sloan and Lawton Ambulance Service.

Motion by Boykin second by Batcheller to approve a loan to Sloan Ambulance Service in the amount of $40,000.00 to purchase a 2005 E450 Ford Type III Ambulance, with payments of $8,000.00 per year over five years. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve a loan to Lawton Ambulance Service in the amount of $23,000.00 to purchase a 2005 E450 Type III Ambulance, with payments of $4,600.00 per year over five years. Carried 5-0. Copy filed.

Bob Knowler, Woodbury County Treasurer, discussed with the Board, the purchase of computers for Motor Vehicle Department.

Motion by Boykin second by Walish to approve the purchase of 10 PCs and nineteen inch screens for Motor Vehicle Department at a net cost to the county of $12,000.00 to combine with Iowa Department of Transportations $8,400.00 at a total cost of $20,400.00. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve lifting the tax suspension for C. G. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign a Resolution approving petition for suspension of taxes for J. A. E. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Julie Ann Edward, is titleholder of real estate located at 1419 Court Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 175770

Lot Eight (8) Block Two (2) Galbraiths 2nd Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Julie Ann Edward as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County board of supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Public Hearing and sale of Real Estate Parcel #223575 was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #223575 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #223575. Larry Waterbury bid $500.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Walish to accept Mr. Waterburys bid for $500.00 plus recording fees on Real Estate Parcel #223575. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public

auction of:

By Larry L. Waterbury in the sum of Five Hundred and No/100 ($500.00) dollars for the following

described real estate, To Wit:

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

Motion by Clausen second by Boykin to approve and receive for signatures a resolution closing a section of highway for maintenance, per recommendation of the County Engineer. Carried 5-0.


WOODBURY COUNTY, IOWA
RESOLUTION NO. 9887

BE IT RESOLVED, by the Woodbury County Board of Supervisors, duly assembled, pursuant to Section 306.41 of the Code of Iowa, 2003, as amended, that the following section of highway described below and shown on Exhibit B attached hereto and by this reference made a part hereof, will become temporarily closed for a period not exceeding thirty (30) days for maintenance and thereupon the County Engineer is directed to cause signs and partial or total barricades to be erected in the roadway at each end of said described highway and on said highway where intersected by other highways, reading Road Closed. Said described highway shall become closed effective upon erection of signs and barricades, and shall remain closed until said signs and barricades are removed.

Motion by Batcheller second by Walish to authorize the Chairman to sign amendments for the following USDA Natural Resources Conservation Service agreements: #69-6114-4-19; #69-6224-4-20, and #60-6114-4-21, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to receive and authorize the Chairman to sign Weed Commissioners 2003 Report for submittal to Iowa Department of Agriculture and Land Stewardship. Carried 5-0. Copy filed.

Leo Miller, Gang Prevention Specialist, gave an update on gang activity.

The Board discussed the consideration of a purchase of second Climbing Hill Boiler.

Motion by Boykin second by Batcheller to approve purchase of a second Climbing Hill Boiler. Carried 5-0. Copy filed.

There was discussion to include new valves in a RFP.

Motion by Boykin second by Clausen to authorize issuance of a Purchase Order for buying up to three tanks for fast tracking the water system not to exceed $14,000.00. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to authorize bidding process on three (3) hot water tanks. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Walish to approve a request to access the County Courthouse by the Take Back Our Children March. Carried 5-0.

There was a tour of the MPM Farms in Woodbury County.

The Board adjourned the regular meeting until November 30, 2004.
