OCTOBER 12, 2004 FIFTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 12, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Victoria Ritz, Deputy Commissioner of Elections, presented the Canvass to the Board for the City of Moville Special Election held on October 5th, 2004 and reported there was one (1) provisional ballot which was accepted and added to tally.
Motion by Clausen second by Batcheller to accept the Official Canvass results of the City of Moville Special Election held on October 5th, 2004 as follows: Carried 5-0. Copy filed.
For Question A Shall the following Public Measure Be Adopted:
Shall the City of Moville issue its bonds in an amount not exceeding the amount of $750,000.00 for the purpose of planning, constructing and furnishing a building for the Moville Community Center and Library?
Four Hundred (400) ballots cast, as follows:
FOR the question there were Two Hundred Sixty-One (361) votes cast.
AGAINST the question there were One Hundred Thirty Nine (139) votes cast.
We therefore declare the public measure Question A to be adopted.

Motion by Batcheller second by Walish to approve the minutes of the Special Meeting of September 17, 2004 as submitted. Carried 3-0, Boykin and Clausen abstained.
Motion by Boykin second by Clausen to approve the Board minutes of September 28, 2004 as submitted. Carried 4-0, Walish abstained.
Motion by Batcheller second by Boykin to approve the minutes of the Executive Session of September 28, 2004 as submitted. Carried 4-0, Walish abstained.
Motion by Walish second by Batcheller to approve the Board minutes of October 5, 2004 as submitted. Carried 5-0.
Motion by Boykin second by Clausen to approve the minutes of the first Executive Session of October 5, 2004 as submitted. Carried 5-0.
Motion by Batcheller second by Walish to approve the minutes of the second Executive Session of October 5, 2004 as submitted.
The Board approved the appointment of Kristi J. Armstrong, Temporary Election Clerk, County Auditor/Recorder Dept., @$10.91/hour, effective 10-06-04. Not to exceed 120 days. Copy filed.
The Board approved the reclassification of Brandon J. Black, P/T Youth Worker, Juvenile Detention Dept., @13.29/hour, effective 10-23-04. Per AFSCME Juvenile Detention Contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.
Motion by Boykin second by Walish to approve a plan recommended by the Human Resources Department to restrict flu shots to high risk employees. Carried 5-0.
Motion by Batcheller second by Clausen to receive Commission of Veteran Affairs Quarterly Report for 3rd quarter ending 3-31-04. Carried 5-0. Copy filed.
Motion by Walish second by Batcheller to receive the County Auditors Quarterly Report for 1st quarter ending 9-30-04. Carried 5-0. Copy filed.
Motion by Boykin second by Clausen to authorize the Chairman to sign 28E Agreement with the City of Bronson, per recommendation of the County Engineer Richard Storm. Carried 5-0. Copy filed.
Motion by Clausen second by Walish to authorize the Chairman to sign Application to Adopt-a-Highway submitted by Alpha Omicron Pi, Sioux City, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Batcheller second by Walish to receive the quotes for maintenance slurry leveling of selected routes and accept the quote of Fort Dodge Asphalt in the amount of $33,704.00, per recommendation of the County Engineer. Carried 5-0. Copy filed.
Motion by Boykin second by Clausen to approve a request by the City of Smithland for the assistance of the Secondary Roads Department on a project on North Broadway. Carried 5-0. Copy filed.
Motion by Batcheller second by Boykin to authorize the Chairman to sign an agreement for engineering services of DeWild Grant Reckert and Associates Company (DGR) for tank and pipe replacement and water tower dismantling. Carried 5-0. Copy filed.
The Public Hearing and sale of Real Estate Parcel #223575 was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.
Motion by Clausen second by Walish to close the Public Hearing on the sale of Real Estate Parcel #223575 as there was no one present wishing to be heard on said sale. Carried 5-0.
Chairman called for bids on Real Estate Parcel #223575. Ryan Mathewson bid $1,000.00 plus recording fees. Greg Sherman bid $1,500.00, Mathewson bid $2,000.00, Sherman bid $2,500.00, Mathewson bid $3,000.00, Sherman bid $4,000.00. There were no further bids.
Motion by Clausen second by Walish to accept Greg Shermans bid for $4,000.00 plus recording fees on Real Estate Parcel #223575.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

for the following described real estate, To Wit:

Higland Plat 3 Fawcetts Sub Division Lots A-B-C-D-E-F Lot One (1) Block Three (3), City of Sioux City, Woodbury County, Iowa (103 Casselman Street)
Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS
WHEREAS, Wanda Kay Schmidt. as joint titleholder of real estate located at 2909 E. 9th Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Seven (7) Block Two (2) East Terrace Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Wanda Kay Schmidt, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel #141300 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

WHEREAS, Michaelyne Hardy as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Jean Logan and LaRae Lyons from Community Action Agency of Siouxland discussed the General Relief budget with the Board.
Motion by Batcheller second by Boykin to approve a plan for additional matched funding of $30,000.00 in the General Relief budget, and approved changes in the General Relief Manual. Carried 5-0. Copy filed.
Glenda Castleberry from Siouxland Economic Development Corporation discussed with the Board the proposed Economic Development Advisory Board and selection of Supervisors representative.
Motion by Boykin second by Batcheller to approve the initial proposal of the Economic Development Advisory Board and directs that the Economic Development Director be responsible to the Board of Supervisors. Carried 5-0.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
The Board adjourned the regular meeting until October 19, 2004.
