OCTOBER 5, 2004 FOURTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 5, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

An executive session was held to deal with urgent personnel action.

Motion by Clausen second by Batcheller to go into executive session under Section 21.51(c) of the Iowa Code. Carried 5-0.

Motion by Boykin second by Walish to go out of executive session. Carried 5-0.

Motion by Batcheller second by Boykin to authorize the Chairman to sign a letter to an employee to approve a request. Carried 5-0.

Meeting called to order.

The Board approved the appointment of Rosalie L. Merrigan, Temporary Election Clerk, County Auditor/Recorder Dept., @$10.91/hour, effective 09-28-04. Not to exceed 120 days. Copy filed.

The Board approved the appointment of Levi L. Harry, Correctional Officer, County Sheriff Dept., @$14.18/hour, effective 10-18-04. Job vacancy posted 7-28-04. Entry level salary $14.18/hour. Copy filed.

Motion by Clausen second by Walish to approve and authorize the Chairman to sign a resolution for abatement of taxes for the City of Sloan, Iowa. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, City of Sloan are the titleholders of real estate Parcels #649320, #649321, #644010, #649326 and #649324, located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the above stated property has an unpaid balance of taxes owing, and these parcels are owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the City of Sloan Iowa, is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 5th day of October, 2004.

RESOLUTION # 9877

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Myrtle Ellen Cress, is titleholder of real estate located at 307 West Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

South Thirty Feet (30 Ft) North Sixty Feet (60 Ft) Lots Three-Four (3-4) Block Eight (8) Sioux City Davis Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Myrtle Ellen Cress as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SO RESOLVED this 5th day of October, 2004.

The Board reviewed with Richard Storm, County Engineer, a letter received from the City of Cushing concerning a proposed 28E agreement.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a temporary removal of embargo on Warrior Road. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to receive recommendation of County Engineer Richard Storm for calcium chloride letting and accept the bid of Harcross Chemicals, Omaha, NE, to furnish 157.5 tons @ $292.20/ton for a total cost of $46,021.50. Carried 5-0. Copy filed.

Bid letting was held for generators for Radio System Emergency Generators Project.

Motion by Clausen second by Boykin to receive the bids for Radio System Emergency Generators Project and refer to Gary Brown from Emergency Services and Glenn Sedivy from Communication Center for review and recommendation. Carried 5-0. Copy filed.

The Board introduced SIMPCOs Matt Tobias, as Woodbury Countys Community Assignment contact person.

The Board discussed establishing an Economic Development Department fund.

Motion by Batcheller second by Walish to establish an Economic Development Department fund and to transfer $100,000.00 from the economic development and infrastructure fund.
Carried 5-0.

Motion by Batcheller second by Boykin to receive the recommendation of Mark Elgert and accept the bid from Boiler Room Services for the boiler contract at Climbing Hill in the amount of $23,100.00. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve the funds for an engineering investigation at the Prairie Hills Facility, concrete removal preliminary engineering investigation, and a sewer video tape not to exceed $3,500.00. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Welte to go into executive session per request by employee per Iowa Code section. Carried 5-0 on a roll call vote.

Motion by Batcheller second by Boykin to go out of executive session. Carried 5-0 on a roll call vote.

The Board adjourned the regular meeting until October 12, 2004.
