AUGUST 24, 2004 EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 24, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Jean Jessen, Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Boykin second by Batcheller to approve the Board minutes of August 17, 2004 as submitted. Carried 5-0.

The Board approved the appointment of Amber D. Wilkinson, P/T Youth Worker, Juvenile Detention Dept., @$12.79/hour, effective 8-25-04. Job Vacancy Posted: 6-23-04. Entry Level Salary: $12.79/hour. Copy filed.

The Board approved the reclassification of Jayme A. Kirsch, Assistant County Attorney, County Attorney Dept., @$49,312/year, effective 9-02-04. Per AFSCME Asst. Attorney Contract agreement, from Step 4 to Step 5. Copy filed.

The Board approved the reclassification of Dawn R. Anderson, Vital Statistics Clerk III, County Auditor/Recorder Dept., @$15.14/hour, effective 9-04-04. Per AFSCME Cthouse. Contract agreement, from Grade 6, Step 3 to Grade 6, Step 4. Copy filed.

The Board approved the reclassification of Randy D. Robinson, Jail Custodian, County Sheriff Dept., @$11.57/hour, effective 9-12-04. Per AFSCME Cthouse. Contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

The Board approved the separation of Steven D. Hunwardsen, District Foreman, Secondary Roads Dept., effective 9-30-04. Retirement. Copy filed.

Motion by Walish second by Welte to approve and authorize the Chairman to sign the Authorization to Initiate Hiring Process for a District Foreman, Secondary Roads Dept., Entry Level-Wage Plan: $18.67/hour. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to adopt a resolution to set a Public Hearing on September 7, 2004 at 10:20 a.m. to establish a Level C designation of roadway, per recommendation of the County Engineer. Carried 5-0.

RESOLUTION NO. 9831

NOTICE OF ESTABLISHMENT OF LEVEL C ROAD

WHEREAS, Woodbury County Board of Supervisors has adopted an ordinance establishing a Level C Road System.

WHEREAS, Woodbury County has received requests to establish a Level C designation on the following described roadway and shown on attached map:

130th Street from east corporate limits of Sioux City to Buchanan Avenue.

WHEREAS, the Board of Supervisors has received a recommendation from the County Engineer to establish this section of road as a Level C Roadway.

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 7th Day of September, 2004 at 10:20 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board will take action on said request and recommendation immediately following the closing of the public hearing.

Motion by Walish second by Batcheller to authorize the Chairman to sign a Utility Accommodation Permit submitted by Woodbury County REC to install an underground electrical distribution line along a section of Carroll Avenue, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a Resolution No. 9832 approving abatement of taxes for the City of Anthon. Carried 5-0.

WHEREAS, the City of Anthon, Iowa are the titleholders of real estate Parcel #588345, located in Woodbury County, Iowa and legally described as follows:

WHEREAS, the above stated property has an unpaid balance of taxes owing, and these parcels are owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the City of Anthon, is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

1. That a public hearing on the aforesaid proposal shall be held on
the 7th Day of September, 2004 at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 7th Day of September, 2004, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a Total minimum bid of $ 79.00 plus recording
fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

There was no action taken regarding electronic doors for the Trosper Hoyt Building. Consensus was to find out what amount the State will contribute for the electronic doors.

No action taken on Boiler for County Building. Consensus was to advertise and re-bid the project.

Motion by Batcheller second by Boykin to award the contract for the Law Enforcement Center roof replacement to Ida Grove Roofing for the amount of $101,253.00. Carried 5-0. Copy filed.

Patty Erickson-Puttmann from Social Services discussed with the Board the Grant contract with Iowa Homeland Security and Emergency Management Division for the Law Enforcement Terrorism Prevention Program.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign Grant Agreement with Iowa Homeland Security and Emergency Management Division (HLSEM) for the Law Enforcement Terrorism Prevention Program Grant for FY 2005-06. Carried 5-0. Copy filed.

No action taken to approve agreement for a research study and cost reimbursement contract for Criminal Justice Research Project. Consensus was for the County Departments that would benefit from this project to include a funding request in their 05/06 budgets.

Julie Stoik from Western Iowa Tech discussed with the Board the certification of two cultural districts.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign Resolution No. 9836 authorizing certification of a cultural district for at least ten years to be named: Morningside Peters Park Cultural District. Carried 5-0.

RESOLUTION NO. 2004-9836

RESOLUTION AUTHORIZING CERTIFICATION A CULTURAL DISTRICT FOR AT LEAST TEN (10) YEARS TO BE NAMED: MORNINGSIDE PETERS PARK CULTURAL DISTRICT

WHEREAS, a Cultural District has been designated to assist the district and community to develop a public private partnership to support said district and,

WHEREAS the Morningside Commercial Club has signed a resolution of support for said Cultural district and,

WHEREAS, the Iowa Department of Cultural Affairs will be petitioned to certify said Cultural District and,

NOW, THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE BOARD OF SUPERVISORS THAT WOODBURY COUNTY, IOWA:

A. Endorses the submission of this application and agrees to participate in the development of, and may, at its discretion, participate in the financial support of said Cultural District.

B. Endorses the goal of economic development of said Cultural District within the context of preservation and rehabilitation of our historic buildings.

C. May appoint a county official to represent the county on a steering committee representing all Sioux City Cultural Districts.

D. By this action, directs county staff to actively support and cooperate with the governing board to develop and maintain said Cultural District.

E. By this action, requests all residents of city/county and especially those citizens who own property or businesses within said Cultural District to support, promote and help maintain activities and events in said Cultural District.

F. Directs the Chairman to sign and submit such resolution on creation of said Cultural District

Deb Durham from Siouxland Chamber of Commerce gave a presentation on the Long Lines Family Center Project.

Motion by Batcheller second by Boykin that the County will contribute $5,000.00 if the grant application is successful. Carried 5-0. Copy filed.

Dennis Butler, Budget/Tax Analyst from Auditors Office, discussed funding of Solutions Software with the Board.

Motion by Batcheller second by Boykin to approve funding of Countys share of Solutions Software in the amount of $15,880.00 be funded from Riverboat Funds. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Clausen second by Walish to go into Executive Session for personnel evaluation. Carried 4-0 on roll call vote. Boykin absent.
