AUGUST 17, 2004 SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 17, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Walish and Welte; Clausen absent. Staff members present were Karen James, Board Administrative Coordinator, Jean Jessen, Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Batcheller to approve the Board minutes of August 10, 2004 as submitted. Carried 4-0.

The Board approved the appointment of Brigid M. Delaney, Correctional Officer, County Sheriff Dept., effective 8-10-04. Correction of original Hire Date from 8-9-04 to 8-10-04. Copy filed.

The Board approved the separation of Joel M. Locke, Temporary Summer Laborer, Secondary Roads Dept., effective 8-18-04. End of Temporary Work. Copy filed.

The Board approved the separation of Andy R. Bremer, Temporary Summer Laborer, Secondary Roads Dept., effective 8-18-04. End of Temporary Work. Copy filed.

The Board approved the reclassification of Pamela J. Westra, Motor Vehicle Clerk II, County Treasurer Dept., @$14.19/hour, effective 8-23-04. Per AFSCME Cthouse. Contract agreement, from Grade 4, Step 4 to Grade 4, Step 5. Copy filed.

The Board approved the reclassification of Gerad W. Lukken, Correctional Officer, County Sheriff Dept., @$14.72/hour, effective 8-26-04. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Nancy M. Carstensen, Motor Vehicle Clerk II, County Treasurer Dept., @$12.81/hour, effective 8-26-04. Per AFSCME Cthouse. Contract agreement, from Grade 4, Step 3 to Grade 4, Step 4. Copy filed.

The Board approved the reclassification of Crystal R. Ryan, Correctional Officer, County Sheriff Dept., @$16.80/hour, effective 8-29-04. Per DSA Contract agreement, from Class 2 to Senior Class, due to 4 years employ + 4 year B.S. Degree. Copy filed.

Motion by Boykin second by Walish to authorize the Chairman to sign 28E Agreement with the City of Danbury for maintenance of Farm-to-Market extensions within the Citys corporate limits, per recommendation of the County Engineer. Carried 4-0. Copy filed.

Motion by Boykin second by Batcheller to receive the recommendation of County Engineer Richard Storm and accept the quote of Barry Motor Co. for Sterling Acterra in the amount of $56,755.00 from the August 10, 2004 flatbed truck letting. Carried 4-0. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize Secondary Roads Department to proceed with acquisition of easements along Route L-36 for future improvements. Carried 4-0. Copy filed.

The Board discussed the consideration of final plats of Moville Heights Addition Subdivision with John Pylelo, Zoning Adminstrator.

Motion by Walish second by Batcheller to receive the final plats submitted by Larry L. Etler and Ronald Roy Riser and refer final plats of Moville Heights Addition Subdivision Parcels # 861121, 861166, and 861139 to the Zoning Commission for review and recommendation, subject to paving agreement being executed. Carried 4-0. Copy filed.

There was a discussion of selection of an auctioneer for Glen Ellen Subwatershed Project.

Motion by Walish second by Batcheller to approve the selection of Idso-Curry as the auctioneer for sale of structures for Glen Ellen Subwatershed Project. Carried 4-0. Copy filed.

Clausen arrived at the meeting.

The Public Hearing and sale of Real Estate Parcel #106095 (also known as #9 14th Street) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Walish to close the Public Hearing on the sale of Real Estate Parcel # 106095 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #106095. Lisa Fischer bid the amount of $552.00 plus recording fees. There were no further bids.

Motion by Boykin second by Clausen to accept Lisa Fischers bid for $552.00 plus recording fees on Real Estate Parcel #106095. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS

RESOLUTION # 9828

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Lee T. and Lisa Fischer in the sum of Five-Hundred and Fifty-Two Dollars & No/100 ($552.00) for the following described real estate, To Wit:

Parcel #106095

CLARKS ADDITION, CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA
LOTS SEVEN (7) EIGHT (8) AND NINE (9) IN BLOCK FOURTEEN (14) LOT SEVEN (7)

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

following the closing of the public hearing.

Patty Erickson-Puttmann, Social Services Coordinator, discussed payment of uncompensated care to Siouxland Mental Health with the Board.

Motion by Clausen second by Walish to approve reimbursement to Siouxland Mental Health for January 1, 2004 through June 30, 2004 in the amount of $57,685.00 for uncompensated care. Carried 5-0. Copy filed.

There was a discussion by Patty Erickson-Puttmann and the Board concerning costs for the mental retardation programs portion of the Siouxland Mental Health conference.

Motion by Clausen second by Walish to approve payment of costs for the mental retardation programs portion of the Siouxland Mental Health conference not to exceed $9,500.00. Carried 5-0. Copy filed.

John Malloy Director Information Technology WCICC, and the Board discussed the consideration of County sharing in the purchase of Solutions Software.

Motion by Boykin second by Walish to approve County sharing in the purchase of Solutions Software for $15,880.00. Carried 4-1, Clausen opposed. Copy filed.

The Public Hearing on Law Enforcement Center (LEC) roof replacement project was held at 10:30 a.m. The Chairman called on anyone wishing to be heard on said project.

Motion by Batcheller second by Walish to close the Public Hearing on the LEC roof replacement project as there was no one present wishing to be heard on said project. Carried 5-0.

Bid letting was held for LEC roof replacement project.

Motion by Boykin second by Walish to receive the bids for LEC roof replacement project and submit to Mike Lee and Mark Elgert for review and recommendation. Carried 5-0. Copy filed.

Oto Township fire protection and emergency medical service item was resolved and taken off agenda.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Boykin second by Batcheller to adjourn the Board meeting to convene the Courthouse Foundation Board of Directors meeting. Carried 5-0.

Motion by Batcheller second by Walish to adjourn the Courthouse Foundation Board of Directors meeting to open discussion.

Motion by Clausen second by Walish to adjourn to the Dorothy Pecaut Nature Center. Carried 5-0.

The Board reconvened the regular Board meeting at the Dorothy Pecaut Nature Center for Woodbury County Economic Development proposal.

There was a discussion on Economic Director for Woodbury County, Iowa, and other agenda items.

Welte gave a brief presentation on the idea of creating an Economic Development Office and the possibility of funding such office.

The following individuals gave presentations why Woodbury County should have an Economic Development Office: Mark Bushcamp (Cherokee Area Economic Development Corporation), Jack Burright (Woodbury County Farm Bureau), Michelle Walker (Western Iowa Tourism Region), Chris Radford (Care 4 Iowa Rural Campaign), Gary Tucker (Plymouth County Economic Development), Darrell Gieb (Sioux Rivers RC&D).

After the presentations, there was a general discussion and question session.

Following the discussion, there was Board consensus agreeing on the concept of an Economic Development Office, but the funding of such office will need to have further discussion by the Board at a later date.

Motion by Clausen second by Walish to adjourn the meeting. Carried 5-0.

The Board adjourned the regular meeting until August 24, 2004.
