JULY 27, 2004 FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 27, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Walish and Welte; Clausen was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of July 20, 2004 as submitted. Carried 4-0.

The Board approved the appointment of Stuart W. Betsworth, Engineering Technician I, Secondary Roads Dept., @$14.97/hour, effective 8-02-04. Job Vacancy Posted: 5-7-04. Entry Level Salary: $14.97/hour per 04/05 FY C.W.A. Contract. Copy filed.

The Board approved the promotion of Todd C. Peterson, Deputy Sheriff, County Sheriff Dept., @$16.50/hour, effective 8-2-04. Per County Sheriff Appointment, from Correctional Officer, Class 2 to Sheriff Deputy, Class 3. Copy filed.

The Board approved the reclassification of Chad L. Heckert, Correctional Officer, County Sheriff Dept., @$14.72/hour, effective 8-6-04. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Loan T. Huynh, Assistant County Attorney, County Attorney Dept., @$49,312/year, effective 8-7-04. Per AFSCME Attorney Contract agreement, from Step 4 to Step 5. Copy filed.

The Board approved the reclassification of Travis L. Hutzell, Correctional Officer, County Sheriff Dept., @$15.31/hour, effective 8-9-04. Per DSA Contract agreement, from Class 3 to Class 2. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign the Authorization to Initiate Hiring Process for one (1) Correctional Officer, County Sheriff Dept., Entry Level: $14.18/hour. Carried 4-0. Copy filed.

The Board discussed interim County department travel procedure with J.D. Pellersels, Human Resource Director.

Motion by Batcheller second by Walish to approve proposed interim County department travel procedure for County Department Heads with changes involving parking reimbursement and ten business days for advances. Carried 4-0. Copy filed.

There was a discussion of interim notification of vacation process for Department Heads.

Motion by Boykin second by Batcheller to approve Department Head vacation notification and employee leave application form to submit to Board of Supervisors approval. Carried 4-0. Copy filed.

Motion by Walish second by Boykin to certify Sabre Communications as low bidder for the communication towers. Carried 4-0. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign an agreement for the OBrien Avenue tower site. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign an agreement for the WIT tower site. Carried 4-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an upgraded agreement for the Homer tower site. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to receive year two contract and funding for traffic enforcement activities through Governors Traffic Safety Bureau (GTSB) FY05 Grant Award. Carried 4-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign Change Order #3 for Courthouse Restoration Phase VI. Carried 4-0. Copy filed.

The Public Hearing and sale of Real Estate Parcel #536161, also known as East corner Garretson & Transit Avenue at 3099 Transit Avenue, was held at 10:20 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Walish to close the Public Hearing on the sale of Real Estate Parcel #536161 as there was no one present wishing to be heard on said sale. Carried 4-0

Chairman called for bids on Real Estate Parcel #536161. David Henry Jr., 2910 Garretson, bid $132.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Boykin to accept Mr. Henrys bid for $132.00 plus recording fees on Real Estate Parcel #536161. Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

The Public Hearing and sale of Real Estate Parcel #353655, also known as 1816 S. Olive Street, was held at 10:22 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Walish second by Boykin to close the Public Hearing on the sale of Real Estate Parcel #353655, as there was no one present wishing to be heard on said sale. Carried 4-0.

Motion by Walish second by Boykin to set the Public Hearing and Sale of Real Estate Parcel #262290 for the 10th day of August, 2004, at 10:15 a.m. Carried 4-0.

RESOLUTION # 9817

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, David A. Johnson & Alicia E. Johnson, as titleholder of real estate located at 4501 Arthur Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #302985
Lots Thirty-six Thirty-eight (36-38) Inclusive Block Three (3) Leeds Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, David A. Johnson & Alicia E. Johnson as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Boykin second by Walish to authorize the Chairman to sign letter authorizing Siouxland Human Investment Partnership (SHIP) to apply for the Early Learning Opportunities Act (ELOA) Grant. Carried 4-0. Copy filed.

Motion by Walish second by Batcheller to approve 28E Agreement between Woodbury County, Iowa and the Woodbury County Decategorization Board Regarding the Disbursement of Funding for At-Risk Children. Carried 3-0. Boykin abstained. Copy filed.

The Board reviewed and discussed a draft of a proposed project newsletter to residents of a section of 220th Street.

The Board discussed the consideration of granting authority of Chairman to sign auction sale contract for disposition of County owned structures pertaining to Glen Ellen Subwatershed Little Sioux River Flood Prevention Project.

Motion by Boykin second by Batcheller to postpone action for an auction contract. Carried 4-0.

Zoning Commissions recommendations on preliminary plats.

Motion by Boykin second by Batcheller to receive preliminary plats for McQuade Addition Subdivision Parcel #769890 submitted by Mr. and Mrs. McQuade and refer to the Zoning Commission for review and recommendation. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to receive preliminary plats for OConnell (formerly Miller) Addition Subdivision Parcel #720480 submitted by John J. and Debra K. O Connell and refer to the Zoning Commission for review and recommendation. Carried 4-0. Copy filed.

The Board reviewed 404 Lease Agreement.

Motion by Boykin second by Batcheller to direct the 404 Committee study the Lease Agreements. Carried 4-0.

John Malloy, Director of Information Technology WCICC, gave a presentation to the Board of antenna placement on the Courthouse.

Motion by Boykin second by Batcheller to approve antenna placement on the Courthouse to replace the existing antenna infrastructure per recommendation of John Malloy, Director of Information Technology WCICC. Carried 4-0. Copy filed.

James Thompson from Iowa Department of Human Services discussed after-hour accessibility to the Trosper-Hoyt Building by Department of Human Services staff.

There was a consensus to form security committee will look at options and report to the Board options available and to allow DHS to provide a list of names to Juvenile Detention to allow access.

The Board discussed plans and specifications of Law Enforcement Center roof with Bob Lee from
RML Architects.

Motion by Boykin second by Walish to approve moving forward with a bid letting for the law enforcement center roof for August 17th, 2004. Carried 4-0.

The Board discussed payment of invoice for computer equipment purchased in 2000.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until August 3, 2004.
