MAY 18, 2004 FORTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 18, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.

Motion by Batcheller second by Walish to approve the Board minutes of May 11, 2004 as submitted. Carried 5-0.
The Board approved the appointment of Eric R. Petersen, Temporary Engineering Aide, Secondary Roads Dept., @$9.50/hour, effective 5-13-04. Job Vacancy Posted: 3-17-04. Salary Range: $7.50-$11.00/hour, based on experience with Woodbury County. (Not to exceed 120 days.) Copy filed.

Ms. Sharon G. Klumpp, Vice President of Sringsted, Inc., St. Paul, MN, presented a proposal for updating of position descriptions, job evaluation study, and update of County personnel policies and procedures, and discussion took place.
Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign Agreement for Management Consulting Services with Springsted, Inc. for position description update and job evaluation study, and update of personnel policies and procedures for Woodbury County. Funding is to come from Riverboat funds with a maximum of $15,500.00. Carried 4-1, Clausen opposed. Copy filed.
The Public Hearing and sale of Real Estate Parcel # 051391 was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.
Motion by Clausen second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel # 051391 as there was no one present wishing to be heard on said sale. Carried 5-0.
Motion by Batcheller second by Boykin to approve the sale of Real Estate Parcel # 051391 to Rodney M. and Marilyn J. Wellman only as previously sold on May 21, 2002. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

for the following described real estate, To Wit:

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Boykin second by Batcheller to authorize the Chairman to sign a contract with Siouxland Regional Transit System for FY 2005 for period July 1, 2004 to June 30, 2005. Carried 5-0. Copy filed.
The Board discussed extending contract with Century 21 Davenport Associates for listing extension for six months.
There was no action taken to extend contract of 201 5th St., Sioux City, listing extension for six months to change expiration date to 11/7/04.
Motion by Walish second by Boykin to approve and receive for signatures Resolution No. 9774 thanking and commending James E. Peters for his service to Woodbury County. Carried 5-0.

A RESOLUTION THANKING AND COMMENDING
James E. Peters
FOR His SERVICE TO WOODBURY COUNTY
WHEREAS, James E. Peters has capably served Woodbury County as an employee of the Woodbury County Secondary Roads Department for 26 years, from October of 1977 to June 2004; and
WHEREAS, the service given by James E. Peters as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends James E. Peters for his twenty six years of service to Woodbury County; and
BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, James E. Peters; and
BE IT SO RESOLVED this 18th of May, 2004.

The Board discussed with Patty Erickson-Puttmann, Social Service Coordinator, Project Safe Neighborhoods Grant Application.
Motion by Boykin second by Walish to approve Project Safe Neighborhoods Grant Application for FY 2005. Carried 5-0. Copy filed.
There was a review of Conservation Easement Agreement for Preservation of County Courthouse drafted by the Iowa Attorney Generals Office, State Historical Society of Iowa and Woodbury County.
Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign Conservation Easement Agreement for Preservation of Woodbury County Courthouse. Carried 5-0. Copy filed.
Motion by Batcheller second by Walish to approve the use of the Courthouse Rotunda on the evening of July 21, 2004 for a dinner hosting the Iowa County Auditors Association and the transfer of the required liquor license. Carried 5-0.
Motion by Boykin second by Batcheller to approve the rate of pay for precinct chair-people at a rate of $7.00 per hour. Carried 5-0.
The Board discussed with Dennis D. Butler, Budget/Tax Analyst, suggestions for allocation of proposed Capital Loan Note.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
John Slump approached the Board with a concern about a county easement.
Mark Olsen of Juvenile Detention discussed with the Board a concern expressed by Department of Human Services of being required to use a back door to gain access to the building after hours.
Motion by Walish second by Batcheller to go into executive session under Section 21.5(j) of the Iowa Code. Carried 5-0 on a roll call vote.
Motion by Clausen second by Batcheller to go out of executive session. Carried 5-0 on a roll call vote.
Motion by Boykin second by Walish to reject the offer on the former District Health Building.
Carried 4-1, Batcheller opposed.
The Board adjourned the regular meeting until May 25, 2004.
