APRIL 27, 2004 FORTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 27, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen and Walish; Welte was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Clausen second by Walish to approve the Board minutes of April 20, 2004 as submitted. Carried 3-0, Boykin abstained.
The Board approved the reclassification of Letitia A. Ford, Secretary II, Secondary Roads Dept., @$14.91/hour, effective 5-01-04. Per AFSCME Cthouse. Contract from Grade 6, Step 5 to Grade 5, Step 5. Copy filed.
The Board approved the reclassification of Joseph P. Bukovich, Correctional Officer, County Sheriff Dept., @$14.72/hour, effective 5-03-04. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.
The Board approved the reclassification of Brian L. Hagler, Correctional Officer, County Sheriff Dept., @$16.80/hour, effective 5-06-04. Per DSA Contract agreement, from to Class 1 to Senior Class. Copy filed.

Motion by Boykin second by Clausen to approve and receive for signatures a resolution requiring employment contract to operate pumps of the Wolf Creek/Pumping District for crop year of 2004. Carried 4-0.
RESOLUTION NO. 9764
WOLF CREEK DRAINAGE DISTRICT/PUMPING STATION
RESOLUTION REQUIRING CONTRACT
TO OPERATE PUMPS
WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Wolf Creek Drainage District and as the governing body has approved and established certain pumping stations in connection therewith; and
WHEREAS, the Board of Supervisors as the governing body of the Wolf Creek Drainage District and its pumping station(s) has previously contracted for the pumping of excess surface waters in the Wolf Creek Pumping Station District; and
WHEREAS, it appears that authority for pumping of excess surface waters including the use of the district owned pumping equipment should be renewed in the event of rainfall which might require pumping in the affected area.
NOW THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors that this Board as Trustees of Wolf Creek Pumping Station District should enter into a contract for the crop year of 2004, for the operation and maintenance of the pumping stations in the Wolf Creek Drainage District heretofore established by this Board.
BE IT FURTHER RESOLVED, that the Chairman of this Board be and he is hereby authorized and directed to enter into that Employment Contract with Douglas Washburn, as per the attached form of Employment Contract, subject to the Guidelines for the operation of the Wolf Creek Pumping Station District.
IT IS FURTHER RESOLVED that in connection herewith, the Contractor, Douglas Washburn, will furnish evidence of insurance as required by Paragraph 4 of said Contract.

Motion by Boykin second by Walish to approve tax abatement for Purina Mills, Inc., personal assessed as real estate, Parcel #993705, due 1999-2000 in the amount of $2,624.00 plus interest; for Rick Spreng, building on leased land for mobile home, Parcel 641068, due 2003-04 in the amount of $18.00 plus interest; and for Conesco Finance, building on leased land for mobile home, Parcel #641337, due 2003-04 in the amount of $30.00 plus interest. Motion by Walish second by Clausen to receive County Recorders Report of Fees Collected for the period of 1/01/04 through 3/31/04. Carried 4-0. Copy filed.
Motion Walish second Boykin to postpone the bid letting for a Fiber Optic Project until Thursday, April 29 at 2:00 PM. Carried 4-0.
Motion by Clausen second by Boykin to approve and authorize the Chairman to sign Resolution No. 9765 approving petition for suspension of taxes for D.A. Carried 4-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES
WHEREAS, Delores Allen, as titleholder of real estate located at 500 S. Irene, Woodbury County, Iowa, and legally described as follows:
Parcel # 458265
Guaranty Title & Realty Companies Sub Division Block Twenty-eight (28) Lot Fourteen (14) Block Twenty-eight (28)
WHEREAS, Delores Allen as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Public Hearing and Sale of Real Estate Parcel #52220 also known as 505 W. 20th Street, to the City of Sioux City only per Code of Iowa 331.361(3) was held at 10:15 AM. The Chairman called on anyone wishing to be heard on said sale.
Motion by Clausen second by Boykin to close the Public Hearing on the sale of Real Estate Parcel #52220 as there was no one present wishing to be heard on said sale. Carried 4-0.
Motion by Boykin second by Clausen to accept the offer of $1.00 plus recording fees from the City of Sioux City, Iowa, for Real Estate Parcel #52220. Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
By City of Sioux City in the sum of One Dollar ($1.00) for the following described real estate, To Wit:
Parcel #052220
East Thirty Feet (30 ft) of Lot Two (2) in Block Four (4), North Sioux City Addition, City of Sioux City, Woodbury County, Iowa (a.k.a. 505 W. 20th Street)
Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said
amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said
Real Estate.
BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.
