APRIL 20, 2004 FORTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 20, 2004 at 9:00 AM. Board members present were Batcheller, Clausen, Walish and Welte, Boykin was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of April 13, 2004 as submitted. Carried 4-0.

The Board approved the reclassification of John P. Pylelo, Planning & Zoning Director, Secondary Roads Dept., @$46,170/year, effective 4-20-04. Per Board discussion 4-13-04. Copy filed.

The Board approved the reclassification of Kenneth E. Grimes, Correctional Officer, County Sheriff Dept., @$14.72/hour, effective 4-23-04. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Brent R. Eickholt, Correctional Officer, County Sheriff Dept., @$14.72/hour, effective 4-30-04. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Mary E. Peters, P/T. Youth Worker, Juvenile Detention Dept., @$12.94/hour, effective 4-30-04. Per AFSCME Juvenile Detention Contract agreement, from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.

Motion by Clausen second by Walish to approve and authorize the Chairman to sign the Request to De-authorize County Positions for two (2) Deputy Sheriff positions, four (4) Correctional Officer positions, and one (1) Process Server position for County Sheriff Dept., effective 7-1-04. Carried 4-0. Copy filed.

Bob Schmeckpeper from Western Iowa Tech Community College gave a presentation on safety training program and services.

Deb Durham from Siouxland Chamber of Commerce gave an update on Siouxland Initiative.

Motion by Batcheller second by Walish to approve a contribution of $5,000.00 to the Siouxland Initiative. Carried 3-1, Clausen opposed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign Resolution No. 9760 approving petition for suspension of taxes through the redemption process for C.S.N. Carried 4-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS

WHEREAS, Carol Sue Nuzum as joint titleholder of real estate located at 4512 Grant Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #303270

Lots Seven and Eight (7 & 8) Block Four (4) Leeds Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Carol Sue Nuzum, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel # 303270 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

North Ten Feet (10 ft) Lot Twenty-one (21) Block Three (3), North Riverside 2nd Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Jessie G. Kissinger as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Batcheller second by Clausen to postpone action to receive the bids for Fiber Optic Program. Carried 4-0.

Motion by Clausen second by Walish to approve bidding process on items for the Interoperable Communications Grant. Carried 4-0.

Motion by Batcheller second by Welte to approve and award the contract to R. L. Craft Co., Inc. of Denison for a total contract amount of $300,930.00 for Phase VI Courthouse Restoration, per recommendation of the architect to be funded from proceeds of a loan note. Failed 2-2, Walish and Clausen opposed.

Motion by Clausen second by Walish to approve and award the contract to R. L. Craft Co., Inc. of Denison for a total contract amount of $300,930.00 for Phase VI Courthouse Restoration, per recommendation of the architect and to split the costs evenly between Infrastructure and Riverboat funds. Carried 3-1. Welte opposed. Copy filed.

Motion by Walish second by Clausen to receive County Auditors Quarterly Report for the third quarter ending 3-31-04. Carried 4-0. Copy filed.

Motion by Walish second by Clausen to receive preliminary plats for Jager Addition Subdivision, Parcel #876813, submitted by Todd Jager and refer to the Zoning Commission for review and recommendation. Carried 4-0. Copy filed.

The Board heard an update from Kevin Alexander on the status of K & L Landscaping.

Motion by Batcheller second by Walish to allow limited work to occur at the site for an additional ninety days. Carried 3-1. Clausen opposed. Copy filed.

John Pylelo from Planning and Zoning discussed Glen Ellen Sub-watershed Project concerning distribution of funds request.

Motion by Clausen second by Batcheller to approve distribution of funds request as presented. Carried 4-0. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign Resolution No. 9763 setting public hearing for paving project LP 03(1)73-97. Carried 4-0.


RESOLUTION NO. 9763

NOTICE OF PUBLIC HEARING FOR PAVING PROJECT LP 03(1)73-97

WHEREAS, Woodbury County has proposed to pave a section of Oscar Avenue from 155th St. south 0.3 mile to the end of existing pavement. Said project is located in Section 6 Rock Township T88N, R42W.

WHEREAS, said project is included in the FY 2004-05 Construction Program submitted to Iowa DOT for approval.

WHEREAS, said project does not meet 50 point minimum criteria developed for local funded paving.

THEREFORE, Woodbury County is required to schedule a public hearing and take action prior to approval of the Construction Program by Iowa DOT and proceeding with the project.

NOW BE IT RESOLVED by the Woodbury County Board of Supervisors as follows:

1. That a public hearing on the proposed project shall be held on the 4th day of May, 2004 at 10:20 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That this resolution be published as notice of the proposed hearing and action.

Motion by Batcheller second by Clausen to receive and approve proposal from Bedrock Gravel, Odebolt, Iowa, for maintenance gravel, per recommendation of the county engineer. Carried 4-0. Copy filed.

There was a presentation of Certificate of Appreciation to retiree, Larry Harshfield.

The Board discussed Building Services Five Year Capital Improvements Project Plan.

The Board discussed Grant Policy procedure.

Motion by Batcheller second by Clausen to approve suspension of the Grant Policy procedure for thirty days while a new policy is developed by Williams and Company in cooperation with the Board of Supervisors, grant administrators and the County Auditors Office; while the new policy is developed, Board approval for new grant applications is required and any financial reports of exiting grants must be reconciled with the general ledger balance before submission to the grantor. Carried 4-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Motion by Batcheller second by Clausen to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 4-0 on a roll call vote.

Motion by Batcheller second by Walish to go out of Executive Session. Carried 4-0 on a roll call vote.

Motion by Batcheller second by Clausen to approve the recommendation of the attorney in Executive Session. Carried 4-0.

The Board adjourned the regular meeting until April 27, 2004.
