APRIL 13, 2004 FORTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 13, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Motion by Batcheller second by Walish to go into Executive Session per Iowa Code Section 21.5(1)(i). Carried 5-0 on a roll call vote.
Motion by Clausen second by Batcheller to go out of Executive Session. Carried 5-0 on a roll call vote.
Meeting called to order.
Motion by Walish second by Batcheller to approve the Board minutes of April 6, 2004 as submitted. Carried 5-0.
The Board approved the separation of James E. Peters, Equipment Operator, Secondary Roads Dept., effective 6-30-04. Retirement. Copy filed.
The Board approved the promotion of David A. Drew, Chief Deputy, County Sheriff Dept., @$61,140/year, effective 4-13-04. From Deputy Sheriff to Chief Deputy, Elected Official Percentage Deputy. Copy filed.
The Board discussed AFSCME Bargaining Unit contracts to include Courthouse employees, County Attorneys, and Juvenile Detention employees.
Motion by Boykin second by Walish to approve and authorize the Chairman to sign a four-year contract with the AFSCME Courthouse Employees Bargaining Unit. Carried 5-0. Copy filed.
Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a four-year contract with the AFSCME County Attorneys Bargaining Unit. Carried 5-0. Copy filed
Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a four-year contract with the AFSCME Juvenile Detention Bargaining Unit. Carried 5-0. Copy filed.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS
WHEREAS, Emily Marie Miller as joint titleholder of real estate located at 2928 S. Cornelia St., Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Eight (8) Block Three (3) Lincoln Park Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Emily Marie Miller, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel # 323625 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Proclamation
WHEREAS, Woodbury County Communications will honor men and women who serve as public safety dispatchers during National Public Safety Telecommunications Week, April 11-17, 2004 and
WHEREAS, introduced to Congress in 1991, National Public Safety Telecommunications Week is the second full week of April each year. This week is dedicated to public safety telecommunicators who aid in providing 9-1-1 emergency assistance to citizens everywhere, and
WHEREAS, every day, millions of people depend on the skill, expertise and commitment of the men and women who work in public safety telecommunications. These individuals help save countless lives by responding to emergency calls, dispatching emergency professionals and equipment and providing moral support to citizens in distress, and
WHEREAS, the term 9-1-1 is often associated with rapid emergency response, poise under pressure, aid and compassion in times of distress and critical decision-making within seconds. Many people dont stop to think about these seemingly nameless, faceless individuals until they experience actual emergencies themselves. These professionals make the difference between life and death in many instances.
THEREFORE, The Woodbury County Board of Supervisors do hereby proclaim

ISAC Certificates of Appreciation were presented to Woodbury County employees Dianne McCall, Donald Martensen, Fran Sadden, Paula Appelt, and Linda Shelton for years of dedicated service to Woodbury County government.
Jim Rixner from Siouxland Mental Health discussed Siouxland Mental Health Center Conference with the Board.
Bid-letting was held at 10:30 a.m. for Phase VI Courthouse Restoration.

Larry A. Harshfield
FOR HIS SERVICE TO WOODBURY COUNTY
WHEREAS, Larry A. Harshfield has capably served Woodbury County as an employee of the Woodbury County Secondary Roads Department for 36 years, from January of 1967 to May 2004; and
WHEREAS, the service given by Larry A. Harshfield as a Woodbury County employee, has been characterized by his dedication to the best interests of the citizens of Woodbury County; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Larry A. Harshfield for his thirty six years of service to Woodbury County; and
BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Larry A. Harshfield; and

WOODBURY COUNTY, IOWA
RESOLUTION NO. 9758
WEED DESTRUCTION ORDER
WHEREAS, it is the responsibility of each of Iowa Countys Board of Supervisors to enforce the provisions of Chapter 317 of the Code of Iowa as amended with regard to the destruction of weeds, and
WHEREAS, under Chapter 317 of the Code of Iowa as amended each county Board of Supervisors must prescribe and order a program of weed destruction to be followed by landowners, tenants, and other persons in possession or control of land, and
WHEREAS, it has been determined by the Woodbury County Board of Supervisors that a program of weed destruction for the year 2004 is necessary,
NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa that each landowner, tenant or other person in possession or control of private land shall on or before the dates stated below, destroy the below-listed noxious weeds on their land by spraying them with a suitable herbicide in a strength sufficient to kill such weeds.
1. May 25, 2004 - for musk, thistle, sow thistle, bull thistle, leafy spurge, perennial pepper grass, sour dock perennial, smooth dock perennial, and sheep sorrel perennial.
2. June 1, 2004 - for Canada thistle, Russian knapweed, buckhorn perennial, wild mustard annual, horse nettle, and teasel biennial.
3. June 10, 2004 - for field bindweed, wild carrot biennial, and quack grass.
4. June 15, 2004 - for butterprint annual, puncture vine annual, and cocklebur annual.
5. July 15, 2004 - for wild sunflower annual and poison hemlock.
6. October 1, 2004 - all thistles in the rosette stage.
BE IT FURTHER RESOLVED AND ORDERED that all weeds on county trunk and local roads and between the fence lines of such roads, whether they be noxious weeds or other weeds, shall be cut or otherwise destroyed, to prevent seed production, by the owner of the land adjoining the road on or before June 25, 2004.
BE IT FURTHER RESOLVED that weeds that are not destroyed in compliance with the above order may be destroyed by the Weed Commissioner, and the costs of destruction by the Weed Commissioner, including the cost of serving notice, plus a penalty of twenty-five percent of total costs shall be assessed against the property upon which the weeds were destroyed, in the case of private lands, or against the adjoining land, in the case of weeds on county roads. Landowners are to contact Weed Commissioner and notify him if there are areas that should not be sprayed with herbicides.

County Engineer Richard Storm and the Board discussed the consideration to allow removal of silt from the Wolf Creek Ditch along West levee 1.5 miles in length located in Section 22 and 27, Willow Township.
Motion by Boykin second by Walish to approve the recommendation of the county engineer. Carried 4-0. Copy filed.
Motion by Clausen second by Walish to adjourn the meeting of the Wolf Creek Drainage District trustees and reconvene the regular Board meeting. Carried 4-0
Motion by Boykin second by Walish to set the Public Hearing and Sale of Real Estate Parcel # 52220 to the City of Sioux City on April 27, 2004 at 10:15 a.m. Carried 4-0.

WHEREAS Woodbury County, Iowa is the owner under a tax deed of certain parcel of real estate described as:
East Thirty Feet (30 Ft) of Lot Two (2) Block Four (4) North Sioux City Addition, City of Sioux City, Woodbury County, Iowa
NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 27th day of April, 2004, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. The said Board proposes to sell the said parcel of real estate on the 27th day of April, 2004, immediately following the closing of the public hearing, to the City of Sioux City, Iowa only per Code of Iowa 331.361(3).
3. That said Board proposes to sell the said real estate to the City of Sioux City, Iowa, only for consideration of $1.00 plus recording fees.
4. That this resolution, preceded by the caption 'Notice of Property Sale and except for this subparagraph 4, be published as notice of the foresaid proposal, hearing and sale.
