MARCH 16, 2004 THIRTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 16, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen and Walish; Welte was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Motion by Boykin second by Clausen to go into Executive Session per Iowa Code Section 20.17(3). Carried 4-0 on a roll call vote.

Motion by Boykin second by Walish to go out of Executive Session. Carried 4-0 on a roll call vote.

Meeting called to order.

Motion by Clausen second by Boykin to approve the Board meeting minutes of March 9, 2004 as submitted. Carried 4-0.

Motion by Boykin second by Walish to approve the minutes of the first Executive Session of March 9, 2004 as submitted. Carried 4-0.

Motion by Clausen second by Boykin to approve the minutes of the second Executive Session of March 9, 2004 as submitted. Carried 4-0.

Gary Brown from Emergency and Disaster Services and Glen Sedivy from the WCICC Communications Center discussed fiber optic connection to Western Iowa Tech radio tower with the Board.

Motion by Walish second by Clausen to approve to go to bidding process for materials and for fiber construction of fiber optic connection from existing Sioux City fiber, located at 6th & Lewis, to the new Western Iowa Tech radio tower (Tri-State Public Safety Communications Fiber Optic Project). Carried 4-0. Copy filed.

Woodbury County Sheriff Dave Amick and County Attorney Tom Mullin discussed with the Board the consideration of participating with the City of Sioux City in the submission of a grant application.

Motion by Boykin second by Walish to approve to participate with the City of Sioux City in the submission of the Edward Byrne Memorial State and Local Law Enforcement Assistance Grant Application to the Governors Office of Drug Control Policy. Carried 4-0. Copy filed.

Motion by Clausen second by Boykin to authorize the Chairman to sign Agreement for Federal Aid Funding for Project BROS-CO97(69)5F-97, per recommendation of the county engineer. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to authorize the Chairman to sign Agreements for Federal Aid Funding for Project BROS-CO97(70)8J-97, per recommendation of the county engineer. Carried 4-0. Copy filed.

The Board approved the separation of Connie M. Dugdale, F/T Youth Worker, Juvenile Detention Dept., effective 3-5-04. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign the authorization to initiate hiring process for six Temporary Summer Laborers, Secondary Roads Dept., Entry Level: $7.50-$8.50/hr., based on previous experience. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign the authorization to initiate hiring process for two Temporary Summer Engineering Aides, Secondary Roads Dept., Entry Level: $7.50-$11.00/hr., based on education and experience. Carried 4-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a Request to De-authorize County Positions: County Sheriff Dept., Deputy Sheriff (two positions), Cops in Schools Grant no longer funded, effective 7-1-04. This is a correction to the two Poet Grant positions de-authorized by Board approval on 3-9-04. Carried 4-0. Copy filed.

The Board discussed wage plan employees FY 04/05 compensation adjustments.

Motion by Boykin second by Clausen to approve wage plan employees FY 04/05 compensation adjustments of 2.5 percent. Carried 4-0.

The Board reviewed with J. D. Pellersels, Human Resource Director, Human Relation policies.

Motion by Boykin second by Walish to add the term sexual orientation following the term disability on the Woodbury County job application. Carried 3-1. Batcheller opposed. Copy filed.

Motion by Boykin second by Clausen to receive preliminary plats for Eberly 2nd Addition Subdivision of Parcels #882751 and #882752 and refer to the Zoning Commission for review and recommendation. Carried 4-0. Copy filed.

John Pylelo of Planning and Zoning gave a report on the Planning and Zoning March 15, 2004 Town Hall meeting in Salix.

Motion by Walish second by Boykin to receive the petition to oppose the establishment of a proposed dairy farm at 270th and Dallas St. Carried 4-0. Copy filed.
