MARCH 2, 2004 THIRTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 2, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Meeting called to order.
Motion by Clausen second by Batcheller to approve the Board minutes of February 24, 2004 as submitted. Carried 5-0.
Motion by Batcheller second by Boykin to approve the minutes of the 1st Executive Session of February 24, 2004 as submitted. Carried 5-0.
Motion by Walish second by Clausen to approve the minutes of the 2nd Executive Session of February 24, 2004 as submitted. Carried 5-0.
Motion by Clausen second by Batcheller to approve the minutes of the 3rd Executive Session of February 24, 2004 as submitted. Carried 5-0.
The Board approved the appointment of Lori A. Morgan, Legal Secretary III, County Attorney Dept., @$14.02/hour, effective 3-26-04. Per AFSCME Cthouse. Contract agreement, from Grade 6, Step 2 to Grade 6, Step 3. Copy filed.
The Board approved the separation of Larry Harshfield, Survey Party Chief, Secondary Roads Dept., effective 5-31-04. Retirement. Copy filed.
Motion by Batcheller second by Walish to approve lifting tax suspension for D.M.T. Carried 5-0. Copy filed.
Motion by Walish second by Clausen to approve lifting tax suspension for E.L.E. Carried 5-0. Copy filed.
Motion by Boykin second by Batcheller to approve and receive for signatures Resolution No. 9741
proclaiming March 2004 Mental Retardation Awareness Month in Woodbury County. Carried 5-0.

RESOLUTION NO. 9741
PROCLAMATION
IN SUPPORT OF MENTAL RETARDATION AWARENESS MONTH
WHEREAS mental retardation is a condition which affects more than 7 million Americans and their families; and
WHEREAS public awareness and education enhance a communitys understanding of the issues affecting people with mental retardation; and
WHEREAS the month of March has been designated National Mental Retardation Awareness Month, with more than 120,000 members and 1,000 chapters of the Arc undertaking public awareness, educational, and fundraising initiatives; and
WHEREAS The Arc of the United States is the nations leading volunteer-based organization advocating for and with people with mental retardation and related developmental disabilities and their families; and
THEREFORE the Woodbury County Board of Supervisors hereby proclaims March 2004
MENTAL RETARDATION AWARENESS MONTH
In Woodbury County, Iowa, and urges the citizens to give full support of efforts toward enabling people with mental retardation to live full and productive lives of inclusion in our communities.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign an application for a Class C Beer Permit Renewal and Sunday Sales Privilege for Salix Grocery, 1556 275th St., Salix, IA. Carried 5-0. Copy filed.
Motion by Boykin second by Walish to approve and receive for signatures Resolution No. 9742 opposing further cuts in state aid to local governments. Carried 5-0.
WOODBURY COUNTY, IOWA
RESOLUTION #9742
WHEREAS, Last year, the Iowa Legislature voted to cut state aid to Woodbury County by $423,000, after the budget was certified and
WHEREAS, this sudden cut in state aid negatively affected the people of Woodbury County in the following ways: major cuts in public safety and other governmental services provided to the citizens of Woodbury County,
THEREFORE, BE IT RESOLVED THAT, Woodbury County requests that the State Legislature refrain from making additional cuts in state aid to local governments and that the state fully fund property tax replacements.
SO RESOLVED this 2nd day of March, 2004.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Jerry Semple, 1227 Buchanan Avenue, Sioux City, addressed the Board with issues regarding the Zoning Commission and the Comprehensive Plan Task Force.
Judy Stafford, 7 W. Gilman Terrace, Sioux City, approached the Board about an ordinance dealing with sexual orientation.
Motion by Batcheller second by Boykin to go into Executive Session per Iowa Code Section 20.17(3). Carried 5-0 on a roll call vote.
Motion by Clausen second by Boykin to go out of Executive Session. Carried 5-0 on a roll call vote.
The Board adjourned the regular meeting until March 9, 2004.
