FEBRUARY 10, 2004 THIRTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 10, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of February 3, 2004 as submitted. Carried 5-0.

Motion by Batcheller second by Walish to amend the Board minutes of January 27, 2004 by striking the motion to approve and authorize the Chairman to sign Health Resources and Services Administration (HRSA) Health Care Facilities Grant for renovation of Siouxland District Health and substituting the following:

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign the Notice of Federal Interest for renovation of a facility housing Siouxland District Health. Carried 5-0. Copy filed.

The Board approved the reclassification of David C. Skilling, Assistant County Attorney, County Attorney Dept., @$48,016/year, effective 2-17-04. Per AFSCME Asst. County Attorney Contract Agreement, from Step 4 to Step 5. Copy filed.

Ms. Cathy Mengel of First Administrators, Inc. discussed Woodbury County Health Insurance premiums with the Board.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign Resolution No. 9736, Resolution Approving the Petition for Suspension of Taxes for D.K.H. Carried 5-0.

RESOLUTION # 9736

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Diane K. Harper, as titleholder of real estate located at 1421 Court Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #175785

Lot Nine (9) Block Two (2), Galbraiths 2nd Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Diane K. Harper as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9; and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

SO RESOLVED this 10th day of February, 2004.

Mark Elgert, Building Superintendent, discussed with the Board moving property from Bekins Building to the old County Home.

Motion by Batcheller second by Walish to approve United Van Lines moving property for storage from the fifth floor of the Bekins Building to the old County Home building. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to accept the bid of Northern Iowa Construction Products, Cedar Falls, Iowa, for furnishing 2004 maintenance culvert pipe in the amount of $41,151.58, per recommendation of the county engineer. Carried 5-0. Copy filed.

The Board discussed with Zoning Administrator, John Pylelo, consideration of retention of legal counsel, abstractor, and real estate closing agent for Glen Ellen Relocation Project.

Motion by Boykin second by Clausen to approve the recommendation of the zoning administrator to proceed with the Glen Ellen Relocation Project. Carried 5-0.

Motion by Walish second by Boykin to postpone action pertaining to Eberly Second Addition Subdivision of Parcels #882751 and #882752 to a later date, per recommendation of the Zoning Office. Carried 5-0.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign final plat for Rings Addition Subdivision Parcel #703410, per recommendation of the Zoning Commission. Carried 5-0.

RESOLUTION NUMBER: 9737

RESOLUTION ACCEPTING AND APPROVING RINGS ADDITION TO WOODBURY COUNTY, IOWA.

WHEREAS, THE OWNER AND PROPRIETOR DID ON THE 10TH DAY OF FEBRUARY, 2004, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS RINGS ADDITION TO WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OR WOODBURY COUNTY IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF RINGS ADDITION TO WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNER AND PROPRIETOR A CETIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

The Board discussed Zoning Commission update report of R-1 Zoning District.

Don Groves of the Zoning Commission presented the Zoning Commissions recommendations to the Board.

Zoning Commission recommended that all parcels currently located within the county, pursuant to the Countys Zoning Map as adopted July 1, 2004, in the R-1 zoning district be rezoned to TA as Transitional Agriculture zoning district. Additionally, recommended that the recommendation of the Zoning Task Force of January 20, 2004 be rejected.

The Zoning Commission further recommended that the Board of Supervisors consider using a citizens committee to work within the confines of the preceding ordinance to continue to work toward amending the ordinance to resolve any remaining concerns of the county residents.

John Pylelo supported the recommendation.

Motion by Boykin second by Clausen to approve the recommendations of the Zoning Commission.

Grady Marx, 1461-158th St., Tom Bride, 619 S. Cecelia St., and John Hollenbeck 1459-240th St., opposed the recommendation.

Motion failed 2-3, Welte, Walish and Batcheller voting no.

Motion by Welte second by Batcheller to propose an amendment to the Woodbury County Zoning Ordinance by changing the R-1 designation to AR-Agricultural Residential District and TA to AG-Agricultural District as defined prior to the zoning amendment adopted June 3, 2003 and re-adopted August 12, 2003 and direct the Zoning Commission to meet with the task force established January 20, 2004, to propose other amendments to resolve remaining issues and that all these proposed amendments be considered at a public hearing set for March 2, 2004 6:30 PM at Climbing Hill.

John Pylelo opposed the motion, Grady Marx, 1461-158th St., and Steve Husk, 5800 Stone Ave., spoke in favor of the motion.

Motion carried 5-0. Copy filed.

Jim Bauerly, President of the Deputy Sheriffs Association, Greg Logan with Deputy Sheriffs Association, Linda Phillips with Siouxland CARES, Jerry Self with Moville Police Department, Janna Widman, 1995-180th Street, and Jack Burright with Farm Bureau, discussed with the Board possible layoffs and public safety issues.

Letters were presented to the Board by Jim Bauerly, President of Deputy Sheriffs Association.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Mike Sauser, 207 S. 5th Ave., Mark Bumsted, 409 W. Main St., Richard Wagener, 2051 Rock Branch Rd., and Bob Knowler, Woodbury County Treasurer, discussed the possible closing of the Treasurers Office in Anthon.

Dennis Butler from County Auditors Office had a general discussion with the Board regarding FY 2004 budget.

Motion by Batcheller second by Boykin to transfer $325,000.00 of expenses of the Sheriffs uniform patrol from the General Services Fund to the Rural Services Fund. Carried 3-2, Welte and Clausen opposed. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until February 17, 2004.
