FEBRUARY 3, 2004 THIRTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, February 3, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.
The Claims were approved as presented. Copy filed.
Motion by Batcheller second by Walish to go into Executive Session per Iowa Code Section 20.17(3). Carried 5-0 on roll a call vote.
Motion by Batcheller second by Boykin to go out of Executive Session. Carried 5-0 on a roll call vote.
Meeting called to order.
Motion by Walish second by Batcheller to approve the Board minutes of January 27, 2004 as submitted. Carried 5-0.
Cathy Mengel of First Administrators, Inc. could not discuss with the Board the Countys health insurance premium because weather prevented travel.
J. D. Pellersels, Human Resource Director, and Jim Villone discussed restructuring of Woodbury County policies and procedures with the Board.
Motion by Batcheller second by Walish to rescind all personnel policies and procedures in effect at this time and to adopt the policies proposed by the Human Resources Department. Carried 5-0. Copy filed.
Motion by Clausen second by Batcheller to receive County Sheriffs Civil Division Second Quarter and Year to Date Report. Carried 5-0. Copy filed.
Motion by Boykin second by Walish to receive an Amendment to extend the contract for the Woodbury County Diversion Project. Carried 5-0. Copy filed.
Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a Resolution establishing a speed limit of 50 miles per hour on Route D-25, per recommendation of Richard J. Storm, County Engineer. Carried 5-0.
WOODBURY COUNTY RESOLUTION 9735
RESOLUTION ESTABLISHING SPEED LIMIT
WHEREAS, the Woodbury County Board of Supervisors is empowered under authority of Iowa Code Chapter 321.255 and 321.285 to determine, upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing, and may declare and determine a reasonable and proper speed limit; and
WHEREAS, on July 1, 2003, Woodbury County, by transfer of jurisdiction from the Iowa Department of Transportation, assumed responsibility for Iowa State Route 982, now known as Woodbury County Route D-25, from the Sioux City Corporate Limits to the Corporate Limits of Smithland, Iowa; and
WHEREAS, the Iowa Department of Transportation had previously completed an engineering and traffic investigation concerning former Iowa State Route 982 from the Sioux City Corporate Limits to the Corporate Limits of Smithland, Iowa and, based upon said investigation, established a speed limit of 50 miles per hour on said route, and placed speed limit signs on said route;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY that Woodbury County adopts and incorporates herein by reference the engineering and traffic investigation conducted by the Iowa Department of Transportation regarding former Iowa State Route 982, and hereby adopts by reference the 50 miles per hour speed limit established by the Iowa Department of Transportation for former Iowa State Route 982, now known as Woodbury County Route D-25, between the corporate limits of Sioux City, Iowa and the corporate limits of Smithland, Iowa, with said speed limit signs maintained by Woodbury County.

Motion by Boykin second by Walish to authorize the Chairman to sign Agreement with HGM Associates for engineering design services at the bridge on Ida Avenue over Wolf Creek Section 31-T87N, R44W, and Jasper Avenue over Wolf Creek Section 29T87N, R44W, per recommendation of the county engineer. Bid letting was held for 2004 Maintenance Culvert Pipe.

Motion by Clausen second by Batcheller to receive the bids for 2004 Maintenance Culvert Pipe and submit to the county engineer for review and recommendation. Carried 5-0. Copy filed.
Patty Erickson-Puttmann, Social Services Coordinator, and the Board discussed Change Order #1 to Klinger bid for basement office remodeling.
Motion by Batcheller second by Boykin to approve Change Order #1 for Courthouse basement remodeling of social services coordinator office area which will increase the original bid by $873.00 for a total cost of $15,883.00. Carried 5-0. Copy filed.
There was a discussion of Park Place rebasing request of cost increase to the Iowa Department of Human Services.
Motion by Clausen second by Walish to approve rebasing request and allow Park Place to receive the associated rate of $175.40, per recommendation of social services coordinator. Carried 5-0. Copy filed.
Motion by Boykin second by Batcheller to authorize the Chairman to sign a letter of delegation for reimbursement under the Environmental Protection Agencys Local Government Reimbursement Program. Carried 5-0. Copy filed.
Planning and Zoning Administrator John Pylelo discussed with the Board its request for the Zoning Commission to review Rural Residential Task Force recommendation.
Grady Marx, 1461-158th Street, and Jerry Semple, 1227 Buchanan Drive, discussed with the Board the process to re-examine the comprehensive plan.
Motion by Boykin second by Batcheller to extend the initial 20 day response period to 60 days. Carried 5-0. Copy filed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Dennis Butler, Budget/Tax Analyst, and the Board had a general discussion of FY 2005 budget.

Judge Walsh, Judge Hoffmeyer, and Leesa McNeil from Court Administrators Office addressed the Board with a concern about court security.
Jack Burright representing the Farm Bureau and Janeese Martin representing the Tax Research Conference addressed the Board with concerns about the county budget.
The Board adjourned the regular meeting until February 10, 2004.
