DECEMBER 16, 2003 - TWENTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, December 16, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

Motion by Clausen second by Batcheller to approve the Board minutes of December 9, 2003 as submitted. Carried 5-0.
Motion by Boykin second by Welte to approve the minutes of the Executive Session of December 9, 2003 as submitted. Carried 5-0.
The Board approved the appointment of Ashley J. Martin, Temporary Engineering Aide, Secondary Roads Dept., @$7.50/hour, effective 12-18-03. Not to exceed 120 days. Copy filed.
The Board approved the appointment of Kyle D. Gates, Temporary Engineering Aide, Secondary Roads Dept., @$9.00/hour, effective 12-18-03. Not to exceed 120 days. Copy filed.

John Pylelo, Zoning Administrator, gave a presentation of resolution request regarding commendation to Mervin Zellmer for his long term commitment to Woodbury County community service.
Motion by Boykin second by Welte to receive for signatures a resolution thanking and commending Mervin Zellmer for his service to Woodbury County, Iowa. Carried 5-0.

A RESOLUTION THANKING AND COMMENDING
MERVIN ZELLMER
FOR HIS SERVICE TO WOODBURY COUNTY, IOWA
WHEREAS, Mervin Zellmer has capably served Woodbury County as a past member of the Countys Board of Adjustment and Zoning Commission compiling 40 years of community service to the County and;
WHEREAS, Mervin Zellmer has faithfully completed the following Board of Supervisor appointments:
Board of Adjustment:
January 1, 1983 to December 31, 1987 1st Term
January 1, 1988 to December 31, 1992 2nd Term
January 1, 1994 to December 31, 1998 1st Term
January 1, 1999 to December 31, 2003 2nd term
Zoning Commission:
January 1, 1973 to December 31, 1977 1st term
January 1, 1978 to December 31, 1982 2nd Term
January 1, 1984 to December 31, 1988 1st Term

WHEREAS, Mervin Zellmers tenure as a member of the Board of Adjustment and Zoning Commission has been characterized by dedication to the best interests and level of service for the citizens of Woodbury County and;
WHEREAS, the members of the Woodbury County Board of Supervisors appreciate the full and constructive input that Mervin Zellmer has provided toward the Board of Adjustments and Zoning Commissions quest for the proper solution to issues presented before the Board and Commission.
NOW THEREFORE, be it resolved that the Woodbury County Board of Supervisors, thank and commend Mervin Zellmer for his distinguished forty years of combined service as a member of the Woodbury County Board of Adjustment and Woodbury County Zoning Commission.

John Pylelo gave an update on applications regarding appointment to Woodbury County Board of Adjustment.

The Board discussed the consideration of preliminary plats for Ring Addition Subdivision submitted to Zoning Commission by Jerry and Sheryl Burkhart and Bill and Mary Mallett.
Motion by Clausen second by Boykin to receive and approve preliminary plats for Ring Addition Subdivision, Parcel #703410, subject to review and recommendation of the Zoning Commission. Carried 5-0. Copy filed.
County Treasurer Robert Knowler presented a plaque to Lisa Wilson recognizing her efforts for the County Sesquintennial Celebration.
Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a resolution for tax suspension through the redemption process for B.C.L. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS
WHEREAS, Ms. Bernice (Painter) Lodahl as joint titleholder of real estate located at 4400 Tyler St., Sioux City, Woodbury County, Iowa, and legally described as follows:

Lots Eleven Twelve (11-12) Block Twenty-seven (27) Leeds Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Bernice (Painter) Lodahl, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,
WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and
NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel # 306675 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

Regis Garvey of United Way presented a Thank You to Woodbury County.

Motion by Clausen second by Welte to approve amendment to 28E Agreement between Woodbury County, Iowa, and the Woodbury County Decategorization Board regarding the disbursement of funding for At-Risk Children. Carried 4-0, Boykin abstained. Copy filed.
The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.
Motion by Boykin second by Clausen to go into Executive Session per Iowa Code Section 20.17 (3). Carried 5-0 on a roll call vote.
